A regular meeting of the Burl ingarne city council was held on the above
given date. I.teeting called to order at 8:10 p.m. , - I{ayor Johnson in
the Chair.
PLEDGE OF ALLEGIAIICE
At word from the Chair, all in the Council Cha ber arose and gave the

MINUTES
The liinutes of the regular meeting of .fune 17, 1968, submitted to
Council previously, were approved and adopted.
HEARING - APPLICATION BEL-MATEO
ENTERPRISES - TN(ICAB PERI.IIT TRANSFER
Ir{ayor ilohnson announced that a public hearing had been scheduled onthis date, in compliance with code requirements, to consider an
application submitted by the Bel-ttateo Enterprises, Inc., to operate
taxicabs in the City of BurJ.ingame.
!tr. F. Herschel Campbell, Attorney, representing the Bel-Ir{ateo Enter-prises, Inc., in addressing Council, advised that a "Certificate of
Public Convenience and Necessity" had been filed requesting thatpemits be issued to operate six additional vehicles.
Mr. Campbell explained that the applicant is presently operating ataxi service in the City of Burlingame under the name of the "Ye1low
Cab Company " and now desires to acguire, by purctrase, the Burlingane
Checker Cab Company fron the estate of the late Mr. Oscar Hansen,
who operated said company in the City for a period of thirty years.
Ur. Campbel l stated that upon the approval of Council, it is proposed
to place four taxicabs in operation retaining the "Checker Cab Company"identity and to add t\,ro taxicabs to the YeIIow Cab Company, increasing
the permits of the latter from six to eight, with each comp.rny to be
operated independently.
llhere being no comments from the Floor either in favor or in protest
and no communications on file either in favor or in protest thereof,
Irlayor Johnson referred to metribe rs of Counci} .
Councilman ceorge questioned the paragraph in the application pertain-
ing to the waiting room facility and the statement that it is "kept
open for approximately twenty-four hours. "
I{r. Charles w. Smith, co-owner of the Corporation, explained that the
taxicabs are in operation on a twenty-four hour basis, with the
Burlinganre office closing between the hours of 2:00 a.m., and 4:00 a.m.,
when the least amount of calls are received; that ca1ls coming in,
hoqrever, at that time, are processed through the San Mateo office.

Itr. Smith stated that tvo-way radios are installed in all the taxicabs,
and in reply to an inquiry from Councilman Diederichsen, Btated that
whenever possible, 1ocal residents are employed to operate the taxicabe.
To Councilman llartinr s inquiries concerning the nunrber of taxicab
permits requested and his expression of concern that permits may be
issued in excess of ttre numbe r of taxicabs in operation, l{r. Smith
advi8ed that one of the local ta:ricalr companies has recently gone outof buginess and to provide a prompt and flexible service to BurI ingame,his company proposes to operate a total of t\relve taxicabs.
The City Attorney referred Council to a provision in the Ordinance
whereby Council may revoke a certificate if the owner should discontinue
the operation of a taxicab for a period of forty-five days without
permission.
A memo from the City Uanager, dated June 27, 1968, referred to a report
received from the Police Department, dated June 25, 1968, corunenting
favorably on the proposed tranafer of the taxicab permit.
the application was read in its entirety and in the discussion there-
after, Ur. Campbell stated that the uaiting room will remain open and
that the company prefers to retain the "Checl<er cab company " designation.
Mr. Snith requested approval to paint the taxicabs "yellow" and to
install a " checkered" insignia top 1ight.
A motion t/ras introduced by Councilman Diederichsen that the application
be approved and that the taxicals to be operated by the "Checker Cab
company " for identification purposeE, be painted yellow with checkered
top lights. fhe motion was seconded by Councilman ceorge and unanirnously
carried.
COUI'tt NICATIONS
1. " GENERAL PLA}I "" BCDC PLAN "
A comnunication from the city Planner, dated June 27, L96A, advised that
a preliminary draft of the general plan for the city of Burlingame is
nearing conpletion and will be soon printed for corunent and revierr. Ehe
City Pl.anner stated that the preaent program is to assenible a citizens
committee in Septenber and to initiate a "plan-adoption" process at that
time.
The conununication also advised that !1r. Alvin Baun, a member of the
Bay Conservation and Development Comrittee, has suggested that a joint
meeting of the Council and the Planning comission be scheduled, at
whidr t ime a ataff urember will be in attendance to explain the BCDC
plan as it affects the city of Burlingame.
Monday, July 29, 1968, in the Council Chambers at 8:00 p.m., was
selected as the time and place to meet as reconmended by !tr. Baun.
lltre City Uanager r^ras requested to notify members of Council and the
Planning Commission in advance of the scheduled meeting.
2. "SAN ARANCISCO PI"AtiI " PRESEIITATION
A metno from the City l.tanager, dated June 27, 1968, referred Council
to a preliminary report on the San Francisco Bay plan, presented by the
Bay conaervation and Developnent cotrmittee. Ilre report was acknowledged
and filed for reference in the future.

A memo from the City Uanager, dated ilune 27, 1968, in anawer to a
request from Councilman !{artin at the last regular meeting, related
in some detail an advertising program to be conducted by the Public
Relations firm, Williarn c. Pocock & Asaociates, to attract c€nven-
tions to San llateo County. Ttre conuaunication and report was acl(nowl-
edged and placed on file.
A comnunication from the City !{anager, dated June 27, 1958, advisedthat the State L,egislature has enacted a bill al lor,ring a cost ofliving increase to retired City employees varying from 2% to L2%in accordance wittr date of retirement.
Councll was further advised that the annual increased cost to theCity for its forty-one retirees approximates $708.00 for miscell.rneous
employees and 9434.00 for safety employees and if approved by Council.
an amendnent to the City's PERS contract is required.
Councilman tJtartin's recommendation that legislation be adopted to
amend the City's contract was concurred in by Council and the City
Manager vras requested to so advise the Board of Administration,
Public Employees' Retirement Systen.

A communication from the City Attorney, dated alune 27, L968, related
dates wherein certain access rights were transferred from the Stateof California to the City of Burlingame and affecting a recent
purchaEe of land by the Mobil Oil Corporation from litr. Ariades l,uppi.
The City Attorney reconunended that a Quitclaim Deed be executed to
release the access rights permitting Mr. Luppi to convey free titleto the Uobil oil corporation.

1. APPROVAL TENTATIVE PINAL MAP
Mr. Stan Schupp, identifying himself as project m.rnager for the devel-
opment of the Uills Estate No. 27 Subdivieion, stated that he was
available to answer inquiries.
Hr. willian Caplan, speaking in behalf of Ur. Herman H. Fitzgerald,
President, Mills Estate Ilone Orners' Association, stated that the
subdividers have consented to include in the deed restrictions, a
height limitation of "1ess than ei-ghteen feet" and also have indicated
their willingness to confirm by agreement with the city that the height
limitation will be maintained and enforced.

I!tr. caplan referred to the desire of the adjoining property ownersthat the covenants indicate also that the larger parcels will not be
subdivided to create additional building lots.
To the latter, ur. Schupp stated that the subdividers wiLl include
that stipulation in the covenants.
The City Attorney advieed, in reply to Councilman Georgera question
concerning the po8ting of bonds, that a resolution has been prepared
by his Office setting forth a perid of sixty days in which bonds
shalL be executed and presented.
Council lvas thereafter requested brlz the Chair to conment.
Councilman ilartin questioned the City Engineer with respect to the
cul-de-sac, who replied that it has been re-designed to the satis-
faction of his office.
The Park Department Superintendent, invited by Council to be present
on this occasion, in reply to Councilman l.{art in. expressed concern
with the steepness of the slope, stating that the extent of the
maintenance will depend upon the tlT)e of planting.
!tr. Schupp, in reply, stated that a " trro to one" cut slope is indi.cated
on the map and the proposed landscaping plan has met with the approval
of the adjacent property owners.

MITLS ESTATE NO. 27 CONTINI'ED
Mr. Schupp referred to the landscape engineer wtro advised that an
assoruoent of five typea of plants have been proposed for an appropriate
planting.
Following a brief discuseion initiated by Councilman Martin's inquiry
as to the length of time that rrill be required to properly maintain
the landscaped area, li!r. schupp stated that the subdividers are willing
to maintain the area for a period of two years.
lr}re city Attorney, in reply to !tr. caplan, concerning disposition of
the "height lirnitation" and the "creation of no additional subdivisions "
referred to Councilman l.{artin's suggestion at the last meeting, that
conditions be set forth on the title page of the map.
Councilman litartin recounended that an agreement to that effect be
prepared by the city Attorney.

Further diecussion wae concluded with the city Attorney advising, in
reply to Councilman !{artin, that an agreement vrith respect to the
subdividers willingmess to maintain the landscaped area for a period
of tso years can be prepared as an addendum to the overall agreement.
Ihe city Attorney added that the recording of the map will be deferred
until the stipulation haa been received.

upon motion of Councilman ![artin, seconded by Councilroan Diederichsen
and unanimously adopted upon Roll Call.
Ur. Cyrus J. Mcuillan. Attorney, representing the subdivider of the
Anza Airport Parks Nos. 4 and 5 Subdivisions, advised that the City
Attorney is still of the opinion that the subdivider post bonds;
however, by reason of the lack of tirne since the Iast Council meeting,
bonds are not as yet available for preaentation.
It lras suggested by Ur. Itlcuillan that Council approve that portion
of the agreement affecting "access to lands of Anza pacific."
Ttre City Attorney, in reply, pointed out that the resolutions recite
that bonds have been presented and that he would prefer that Council
postpone an action to either an adjourned or a regular meeting.
Councilman uartin questioned qrhether there were additional obstructions
that may further delay an action by Council .
t{r. Robert De1zell, 1345 De Soto Avenue, addressed Council and refer-
red to his Letter dated June 28, 1968, requesting permission to speak
on the City's agreement with the Anza Pacific Corporation regarding
the " northern acceEs road."
A series of communications received by Council, pertinent to the
subject, were acknowledged and read from the following:
Ur. Robert O. Delzell , 1345 De Soto Avenue, dated ilune 28, 1968,
requesting that the public be fully appraised of the significance ofthe access road in the future development of Burlingame and its Bay
shoreline; Leonard P. Kel1y, 1 cananea Road, dated June 20, 1968,
urging Council to employ nethods to stop Bay fill; Save San Francisco
Bay Association, signed by uarcella ilacobson, Vice-President, dated
July 1, 1968, stating that the proposed road is in violation of the
recommendations of the Regional Planning Cotrunittee of San l{ateo County
and those of the Bay ConEervation and Development Corunittee; !trs.
Juanita E. ALving, 409 RoUing Hills Avenue, San ltateo, dated iluly 1,
1968. requesting that a permit be refused the Anza Pacific Corporationuntil a report of BCDC can be acted upon by the State Legislaturet
and ltlr. John L. Morrill, 505 Costa Rica Avenue, dated July 1, 1968,
protesting the construction of an access road involving further filling.
Verbal objections and requests for a public hearing were heard from
persons in the audience, identifying themaelves as olrner6 of property

Councilman l.lartin, speaking in rebuttal, advised of the apparent mie-
information on the part of those voicing objection to filling lands
for an "access" road.
By refelence to a recent newspaper article and to paragraphs in the
report prepared by the Bay Conservation and Development Conmittee,
Councilman t{artin made the observation that " some fill will be
necessary in the development of bayside properties."
For clarification purposes, councilman lhrtin, preparing a sketch on
the blackboard, indicated an area proposed for a city of Burlingame
Bayside Park and an adjacent area under development by the Anza Pacific
Corporation and in some detail explained the posi.tion of the roadway
that wj.11 permit an access to the Bay for all, and will also provide
a Fire Department entry to industrial properties.

Comnenting briefly on his conversations with BCDC on roadways requested
by that Agency to provide access, tlre City Planner stated that the BCDCplan envisions a plan whereby persons may walk or c1zcle from the airport to
Coyote Point.
A period of questiong and answers followed wherein the intentions of
bour the City and the subdividers concerning the construction of the
accesa road were clarified.
Councilman I{artin and Councilman ceorge eadr protested the inferences
that Council was not acting in good faith and was negligent in upholding
its previously-stated policy to thwart attempts to fill the Bay.
Mayor Johnaon, in a special Proclamation, recognized and commended the
Burlingarne Lions' club upon itB thirty-nine years of service to the
comnunity.
llhe City U.rnager rras requested to schedule Council interviews lrith two
nominees to fill a vacancy on the Library Board, ilonday, JuIy 15, at
7:3O p.m. , and at 7:45 p.m.

Burlingane school District, dated June 13, 1968, expressing apprecia-
tion to the Burlingame PoLice Department for services rendered during
his thirty-year tenure as a school official; Mr. Hovrard L. Robinson
and Ur. Robert E. Fiaher, dated June 17, 1968, commending Park Department
tree pruning work on Burlingane Avenue i u. E. Linxrriler, dated June 26,
1968, opposing restrictive laws affecting shotgun and rifle ot nersi

referred to the City Attorney for the preparation of a similar

the League of California Cities and more particularly one dated June 26,
1968, add ing a new section to the Brolrn Act, requiring the giving of
notice to all news media of the t irne and place of meeting, affecting,in addition to the "Iegislative body " advisory agencies, boards,
conunissions and cornmittees. Council requested l'{ayor Johnson to enter
f'he City Planner ilisplayed a sketdr prepared by his Office illustrating
an eighty-four foot "industrial street section."
Uayor Johnson thereafter declared the discussion closed and the subject
matter before Council concerning agreements wittr the Anza Pacific
Corporation was continued to the regular meeting of JuIy 15, 1968.

LEAGUE CONFERENCE RESERVATIONS
A memo from the City Manager reminded Council to fon ard reservations
to the convention headquarters for attendance at the October League
of l.tunicipalities Conference in Los Angeles.
RICHARD O.HARA REQUEST
A memo from the City uanager, dated ilune 27, 1968, recommended that
Mr. Richard O'Hara reimburse funds expended for the purchase of an
odd parcel of property o*rred by the City, with the understanding
that he construct a culvert according to engineering specifications
and to thereafter dedicate a required drainage easement to the City.
Council concurred and the City l.{anager eras authorized to so notifyI{r. O'Eara.

ltayor Johnson noted the presence of a large group of young adults.
Ur. Irving Amstrup identified those present as members of "Our Lady
of Angels'Young Adult Forum" and suggested that their attendance be
ad<norrfledged by written conrmunication to the Churc]r of Our Lady of
Angels.
