A regular meeting of the Burlingame City Council was held on the above
date.
1rhe meeting was called to order at 8:IO p.m., by l{ayor R. D. lrartin.

the pattern for a mosaic to be presented to the city by Peninsula
National Bank of Burlingame; space for the mosaic has been reserved in
the main entrt4ray to the new City tlall, between the Council Chambers
and business offices.
Folloring discussion of vehicle decals, during which ur. Giberson reported
that the Fire Department expressed a desire to continue wi.th its gold
decal, and members of the Council suggested alternates to the blue and
white currently displayed on all other City vehicles, the matter was
referred to Councilman ilohnson, !1r. Giberson and the City Uanager for
recommendation.
Comnenting on artistic values of the design, Council expressed appre-
ciation to !tr. Giberson for his efforts in creating a most acceptable
ns City seal .

A communication from Inge Leihner, l50g Sherman Avenue, appealed the
decision of the Planning Commission in approving a special use permit
to Peninsula Early Learning Center, Inc., to c-onduct a pre-sctrool and
day care center in an existing single-family dwelling, L247 EL Camino
Real .
A public hearing before Council was scheduled for tlonday, October 2O,
1969, at 8:O0 p.m.
!tr. Ihomas A. Palmer, attorney for the principals in the applj.cation,
was accorded the privilege of the floor and petitioned Council to
proceed with the hearing at the present meeting, explaining that a
delay will result in financial hardship to the proponents, by causing
unexpected outlay of funds for building rental, and inconvenience to
parents and children ar'raiting opening of the facility.
In response to li{ayor llartin, the City Planner quoted f rom l.tunicipal
Code Section 25.16.O8O providing "At its next regular meeting follow-
ing the appeal or the suspension by the council, or at .iny meeting
thereafter to which the matter may be continud. the council shalI
conduct a hearing thereon. "
Ir{r. Palmer, thereafter, offered no further objection to the date of
the hearing.
A second communication on the sane subject from Ur. and !lra. Ario
cregori, 1258 Balboa Avenue, dated Septelober 23, 1969, commented on
various aspects of the proposed facility.
A communication dated Septedber 24, L969, from East of Bayshore Improve-
ment Association, Burlingame, signed by ceorge O. Braden, President,
and Leonard C. Waldo, Secretary-Treaaurer, concerning landscaping of
the dump road, and a copy of a letter dated September 19, 1969, from
George N. Keyston, Jr., President, Anza Pacific Corporation addressed
to Mr. George O. Braden, offering to purchase a reasonable nurdber of
plants if the city would plant and maintain them, tere referred to
the Park Departnent and Beautification Conunission for recommendations.

ment Association, Bur1ingare, signed by George O. Braden, Presj.dent,

to ctranging the street designation "Old Bayshore Highway, " betlreen
the Broadhray overpass and MiLlbrae overpass, to "Airport Boulevard "
was acknowledged. (a copy of the Association's conununication to the

Councilman George referred to objections voiced by business firms

and financial outlay involved in acquiring new statj-onery.
Ur. Leonard Waldo reported that the Association's membership, and other
affected property orrners, have indicated no objection, providing thereis proper notice, from ninety days to six months.
In response to CouncilmErn Johnson, ur. Waldo advised that five ohrners on
the street are menbers of the Association and that the survey extended
beyond actual medbership.
The communications were referred to Health, Safety and Traffic Commission.

4. EXPENDITURE OF UNDERGROIJNDING FI'NDS
A communication dated Septeniber 25, L969, from East of Bayshore Improve-
ment Association, Burlingarne, signed by Leonard C. Waldo, Secretary-
Treasurer, requested consideration to diverting accumulated undergrounding
funds to irnproving the area from Broadway Overpass north to the drainage
channel bordering East l{illsda1e, as this is the one remaining area east
of Bayshore with old-style power lines at the front of the lots.
The coramunication stated that Publie Utility Commission regulationsprohibit such funds being expended in residential areas.
!lr. Leonard Waldo, in response to Mayor Uartin, reported that he rras
informed by Pacific Gas and Electric company of the Public utili.ty
Commiseion ruling.
The communication was referred to the City I'{anager for investigation
and report.
WIDENING OF PORTION CHAP IN AVENUE APPROVED.
communications from the City Planner dated september 23, 1969, and from
the City Engineer, including the City Manager's favorable recommendation
noted thereon, dated september 24, L969, requested consideration to
increasing the width of tbe travel-way of chapin Avenue five feet for a
distance of approximately 15O feet westerly from the intersection with
El Canino Real.
lhe City Engineer'a communication stated that the sidewalk has been
damaged and must be reconstructed at the site of a nerd apartment building
at the southlresterly corner of El Canino Real and Chapin Avenue i that
the clontractor has agreed to the proposed widening for the total frontage
of the property, thereby providing a stacking lane for turning movements
into the EI Canino (sirnilar to an improvement at Burlingame Avenue and
El camino Real) and to as6ume the cost of sidewalk replacement r approxi-
mate total cost, $3.OO0.OO, less $700.00 for sidewalk, approxfunate net
cost to City, $2,3OO.O0.
In response to Uayor litartin, the City Attorney advised that the appro-
priation may be approved by motion of Council, being under $2,500.OO.
A motion introduced by councilman Crosby, seconded by councilman Anstrup,
approving widening of a secti.on of chapin Avenue, approximately 150 feet
in length $resterly from the aouthlresterly intersection of EI Camino Real,
in accordance with staff recommendations and cost estimates, was carried
unaninously.

Anstrup and unanimously carried, Council accepted the structural
engineer's reporti authorized E. L. Norberg, A.I.A., to proceed rrith

BURLINGAIITE AVENUE AREA OFF-STREET PARKIIIG DISTRICT
PROJECT NO. 1969-1
A conmrunication dated Septedber 23, L969, from hlilson, Jones, I.{orton &
Lynch, Attorneys and Counsellors at Law, San lr{ateo, signed by
Kenneth I. Jonea, sutrnitted original petitions for acquisition of
present City HaII site and Post Office parking area as off-streetparking lots for the Burlingame Avenue Area Off-Street ParkingDistrict, and a series of resolutions requiring an action by theCity Council to initiate the project.
In response to Mayor Uartin, Ur. Kenneth I. Jones confi.med thatacquisition and improvement of properties and the financing will
proceed under the 6arne bond acts as the existing parking district.
With reference to compensation for services to be rendered by the
City Engineering Department, Mr. Jones advised that the engineer's
report may include a cost figure for services and that Council has
the choice of accepting or rejecting that portion of the report.
I{ayor l{artin reeognized Mr. Robert lltrompson, Attorney, and Chairman,
Charuber of Commerce Off-Street Parking Committee, who reviewed the
Conmittee's acti.vities and advised that signatures on file represent
approxirnately 50% of the assessed valuation of the land within theDistrict.
In response to Councilman Crosbyr s inguiry ehether a decision eras
made on precise location of a pedestrian access from Donnelly Avenue
parking lots through to Burlingame Avenue, t{r. llhompson replied in
the negative, explaining there is a difference of opinion as tofeasibility of such access, that it is included as a proposal, andthat the language of the petition gives to Council discretion to
retain or delete at the time of public hearings.

Change orders, Nos. 2 and 3, Burlingame city Hall Project, for formal
consideration.
In an addendum to the conununication, the city Manager recornmended
approval, stating that the Change orders, providing for raising the
ceiling in the Council Chambers, and for a proper cornerstone, were
reviewed by Council in study session.
A motion introduced by Councilman Johnson concurring in the reconunendation
of the City I'tanager to accept Change Orders as presented was seconded by
Councilman George and carried unanimously.

and re commended that the work be formally accepted.

Planning Advisor, Burlingame Parking Commission, reported that at a
regular meeting on August 27, t-he Parking Conmission, at the request
of the City Council, considered the question of arnendment or repeal
of regulations on overnight parking; heard comments from persons in
attendance and, following thorough discussion, unani.rnously agreedto recommend to the Cj,ty Council that:

fee of $5.00; that no vehicle be permitted to stand unmoved for longer
than seventy-two hoursr and that entire procesa of application, inves-tigation and collection be placed $rith the Police Department, insteadof License Collector and Police Department.
A communication dated Septedber L2, 1969 from .foseph A. Aliamus,
Chairman, Itealth, Safety and Traffic Commission, reported that at a
meeting on August 14, the ordinance regulating on-street parking
between the hours of 2:0O and 6:00 a.m., r{aa discussed, as requested
by the city council,
Ihat the Conmission unanimously agreed that the ordinance be
retained with consideration to amendments providing for seventy-thro
hour parking lfunit; .rnnual permits at a fee of $5.OO; removal of all
but current sticl<ers; Police Department to admini.ster entire processi
upon issuance of permit, permittee to be requested to park in front
of his property; that permits not be issued qrhere apartment building
tenants can rent on-site spaces.
A letter from Thornton K. Robertson. l1O5 Douglas Avenue, urged that
the ordinance be continued and enforced and related incidents where
trucks remain on the street unmoved for the entire weekend and, during
the week, automobiles are parked five to six hours in a two-hour zone.

Itlr. Andrer., Chambers, 912 EI Camino Rea1, reported that he moved into
Burlingame approximately nine months ago and had no alternative but
to park on the street, the one garage space allotted to his apartment
is used by Mrs. Chambers; that he had no knorJ.edge of the ordinance
until receiving a citation. Mr. Chanbers suggested there should be
some effective method of notification to nery residents.

Po1ice Chief Lollin, in response to Irtayor Uartin, stated that Welcome
IYagon organization attempts to reach a1I newcomers and that tenantsin apartment buildings are usually made aware of the law where thereis an owner or manager in residence. Police Chief Lollin reported
that ner,, signs informing the public of the ordinance are now displayed
at entrances to the City.
Councilman crosby referred to a prior discussion erherein the suggestion
wae made that a warning notice, in lieu of citation, be issued where
an officer discovers an autonobile rrithout a permit displayed on his
initial patrol in an area.
Councifunan George inquired if the officer would be in position to
recognize whether or not there had been a prior warning and whether
a practical method of verification could be devised.
Councilman Anstrup concurred with councilman George, conunenting further
that an accurate record of all warnings r*ould be reguired for the
system to work efficiently.
I{ayor Martin stated that the ordinance is directed tovard the "chronic
parker, " who flagrantly disregards the law by parking illegally night
after night, and suggested that the officer could be permitted the
discretion of issuing a citation ol leaving a warning notice, and
thereby be relieved of the onus of verification.
Ir{r. D. R. sharpe, 1759 lttarco Polo Way, stated that as a former resident
of the City of san Francisco accustomed to on-street parking, he
continued to do so wtren relocating to Burlingame, despite having a
garage space reserved for his use; that he received no information
from any aource on the prohibition and that, when ticl<eted, he paid
the fine.
ur. Jeff Quinn, 1455 Cortez Avenue, protested that reconunendations of
the Parking comnission and Health, safety and Traffic Commission ignore
suggestions of interested citizens who attended both meetings, viz.,
that the permit be retained, the fee excluded.
l{r. Herman H. Fitzgerald, 3O8O Arguello Drive, President of Mills Estate
Home Ovrners Association, approved increasing the cost of the permit,
suggested that a system of warning noticea rrould apPear to be inappro-
priate unless the officer was furnished an accurate check l-ist, that
seventy-two hour parking prohibition, although Eomevrhat harsh, may have
merit, and that the ordinance should be made reasonably restrictive,
if sustained.

that numerous letters received in his office point to the absence of
street signs alerting residents to the law.

the fee, per se, and especially to the suggested increase.

!1r. and llrs. E. Quinn, 1455 Cortez Avenue, maintained that orrners
should be permitted the privilege of unrestricted parking in frontof their property.
Mr. Ralrmond R. Stehrart, 2920 Dolores Way, corunended the cooperationof the Police Department in a recent incident involving a prowler
and stated that he appreciated the diligence of the patrol officer
who ticketed his car when parked on the street overnight.

Councilman ceorge reported that he made an intensive survey of allof the ramifications of administration of the ordinance and that theCity's cost is 916.93 per hour for three employees in the police
Department concerned with investigation and clerical work. Councilman
George stated that the City neither intends nor desires to realize aprofit frqr service fees but is entitled to compensation, in part,for all.owing to some the privilege of using the public street as a
parking area.
Councilman Anstrup commended the Parking and Health, Safety & Traffic
Commissions for conscientious attention to the matter, pointing outthat both Commissions are thoroughly familiar with the ordinance .rnd,after hearing comments pro and con from their respective audiences,
submitted recormendations whictr they considered reasonabLe and
essential. to proper enforcement.
llayor l{artin's request for an opinion from Council on Commission re com-
mendations initiated a period of discussion:
Comments were heard from Police Chief Lo1lin, advising that the Police
Department can administer the entire process, should Council so desire,
and reported that in a recent conversation with the City Treasurer,
the latter suggested that collection of fees is a function of that
Department; additionally, the Treasurer questioned the feasibility of
imposing a mandatory Ernnual permit, pointing out that numeroua appli-
cations are received from persons in the City on a temporary basis,
including a substantial number of airline employees, subject to
frequent transfer.
Councilman ,.fohngon referred to comments at a prior Council meeting
wherein citizens complained of personal inconvenience entailed in
making personal visits to the Police Department and City EaIl to
secure a permit. Councilman ilohnson outlined in detail the entire
process. noting that the permittee has an option of applying in person,
by telephone, or by mail .
In additional comment, Councilman Johnson referred to the discussion
before the Eealth, Safety and Traffic Conunission, wherein al1 inter-
ested persons vrere permitted to cornnent. Councilman Johnaon displayed
a collection of correspondence favoring retention of the ordinance
and stated that not one of the many persons from whom she received
telephone ca1ls requested repeal.
Following a poll of Council, Uayor !{artin requested the City Attorney
to prepare amendatory legislation for Council's consideration, pro-
viding for:

Iuayor llartin announced a continued public hearing, from the meeting
of Septerdber 15, 1969, on a proposed addition to the Municipal Codeof the City of Burlingane creating a "waterfront Commercial Distrlct. "
The City Attorney stated that the proposed ordinance is before Council
on this occasion for consideration of amendments by the City P1anner,in response to Council's direction at the meeting of Septedber 15, andthat proper procedure requires the Planning Commission's approval to
such amendments prior to adoption by the City Council.
1[he City Planner reported that the last paragraph of 525.41 .O5o
Landscapinq and Desi gn Requirements rras expanded to include a require-
ment for landscaping plans, and 925.41.O7O to provide for applicationsfor variance.
The subject matter was referred to the Planning Conunission and the
hearing before Council continued, pending receipt of the Conrmission's
recommendation.
NEW BUSINESS
1. Name Signs for Office Personnel
Councilman Amstrupr s recommendation that name signs be provided for theclerical staff in the City's various departments initiated a brief period
of conment. The City Manager, thereafter, was requeated to pursue the
matter and to report to Council .

proposed revisions in Broadway Interchange area.
In verbal comment, the Director of Public Works advised that in a meet-

policy and on State legislation providing for ABAG appointrnents to
BCDCr and referred to a proposed amendment to ABAG Bylaws having to
do with election of President and vice-President, reporting that he
will ask for Council's direction. uayor Martin requested the City
tlt.rnager to furnish copies of the proposed amendment and the prelim-
inary program and agenda for the ceneral Assembly meeting to all
Council members.
6. A memo from the city uanager dated october 2, 1969, advised that
Albert Kahl, Architect, has had considerable exPerience in designing
fire stations and cited specific proiects undertaken by !tr. xahl.
Council concurred with the City Managerrs recommendation that a
contract be prepared for I,{r. Kahl's servi.ces for the addition to
Fire Station No. 3.
