previously to council, corrected to record a Council study meeting
was scheduled on wednesday, August 6, L959, were thereafter approved
and adopted.
COMI'II'NICATIONS
1, PRESENTATION OT' AGREEMENT RE:
BAYF RONT BALLFIETD CONSTRUCTION
A conununication, dated July 31, 1969, was read from the City Manager,
referring to an agreement submitted by Hanamoto and Associates
relative to the construction of the ballfields at the Bayfront Park.
Questions to be resolved concerning provisions of the agreement were
reserved for discussion at the Council study meeting on wednesday,
Augu st 6.
2. SAN FRANCI SCO BAY AREA WATER USERS
ASSOCIATION MEI{BERSHIP DUES-ASSESSI{ENT
A conrmunication, dated July 31, 1969, was read from the City Manager,
advising that the officers and Directors of the San Francisco Bay
Area l{ater Users Association have voted to lewy a unit assessment
against the medbership, of which sum, the City of Burl ingame has been
invoiced in the amount of S1,O5O.OO.
In replying to the Chair, the City Engineer advised that the sum
represents $5O.O0 for 1969 dues and a special levy of $1,Ooo.0o is
based upon an assessment of fifty cents per hundred thousand cubic
feet of water purchased by the City from the San Francisco Water
Department during the 1967-1968 fiscal period.
The City Engineer further advised that the funds derived from the
conaumer agencies are being used to finance the water usersr Association's
efforts to obtain non-discriminatory water rates for suburban customers
of the San Franeisco Water Department and that to date, the Assoeiation
has been instrumentaL in forestalling a public hearing before the Public
Utilities Conunission on the proposal of the Water Department to increase
rrater rates by twenty percent.
1lhe City Engineer and the City Irlanager each reconunended that the City
participate in the reactivation of the Association and that the asaess-
ment be approved.

The City I{anager advised that (1) the $3,500.00 cost of eguipment can
be expended from cas Tax monies and that additionally, (2) it is
proposed to install a thirty-foot cantilever signal over Broadway
and California Drive, the work to be performed by the public Works
Department at an approximate cost of $700.00.
In reply to the Chair, the City Engineer advised that the replacement
was originally suggested by the Director of Traffic in collaboration
with the San Uateo County Traffic Engineer and confirmed that the
installation meets with his approval.
The City Uanager, reporting verbal1y, stated that the current system
has been a continual source of maintenance problems and that the newinstallation would expedite the flow of traffic particularly during
peak hours.
Councilman Johnson moved that Council concur with the reconunendation
of the City Manager and that both the multi-dial system controller
and the cantilever extension be approved. The motion was seconded
by Councilman Amstrup and carried.
4. SUBMISSION OF 'GENERAL PLAN''
A conununication, dated July 10, 1969, was acknowledged from the City
Planner, reporting on the completion of the City's preliminary general
plan study by the Planning Conunission and its submission to Council
for adoption or revision.
A motion to schedule a date for a public hearing $ras prefaced by a
motion introduced by Councilman Johnson, that the first meeting of
Council in September be scheduled on the seeond day. The motion rras
seconded by Councilman funstrup and carried.
Councilman Johnson moved that a public hearing on the "ceneral

5. LE BARON HOTEL REOUES"
PERMIT FOR DANCING
A communication, dated July 23, 1969, wae read from Joseph O. Lampe,
Director of Operations, Le Baron Hotel, requesting the issuance of
a dance pernit to be applied in the operation of the Le Baron Hotel
vIP Lounge,
Reports from the Health Department and the Police Department, subsequent
to investigation, indicated approval. A report from the Fire Inspector
advised that considerable construction is yet to be accomplished and
recommended that an action be temporarily withheld.

I{r. Almeida stated that it is anticipated that all building
requirements shall be satisfactorily met within a period ofeight hours.

recommended that action on the permit be held pending the issuance of
the necessary occupancy permits.
Trhe City Planner stated that the LeBaron Hotel is being constructed
under the conditions of a use permit, requiring complete compliance
with submitted plans and that the eurrent status of construction fore-
stalIs the assignment of occupancy permits.
The City Attorney reminded Council that "safety measures" are the
subject of discussion and stated the opinion that the application for
a dance permit is premature.

6. HIGHWAY RELTNQUISIIMENT
FRONTAGE ROAD NEAR OVERPASS
A communication, dated ,Iuly 28, 1969, was read from the state Divisi.on
of Highvrays. notifying Council that through the recordation of a
California Highway Commission resolution, the state has formally
relinquished a frontage road near the Broadway overcrossing (Road
O4-SM-IO1) to the City of Burlingame for inclusion within the City's
street system-
7. COOPERATIVE PERSONNEL SERVICES
A communication was acknowledged from the State Cooperative Personnel
Services, dated June 13, 1969, advising that the existing contract
between the City and the Cooperative Personnel Services will expire
on Nove ber 3O of this year.

8. GREGORY & SONS USE PERMIT
HOWARD JOIINSON HOTEL COMPLEX
A cormnunication dated July 28, 1969, was read from Robert R. Thompson,
Attorney, representing cregory & Sons, advising that drafts of the
sewer. !,rate r and storm drainage easements that hre re a condition of
the u6e permit granted to cregory & Sons to construct a "Ilo\rard Johnson"
hotel, will be prepared and presented to the City Engineer and to the

City Attorney for their approval prior to presentation to Council
on August 4.
t{r. R. E. Slater, representing the interests of cregory & Sons,
addressed Council to advise that subsequent to the approval by Council
of a use permit to the applicant on December 16, 1968, one of the
remaining items concerning sehter, water and Etorm drainage easements
has norr been resolved and a request is therefor before Council that
the necessary deeds of easement be executed.
In repLy to Council inquiries, the City Attorney advised that the
documents are appropriate with respect to form and the City Engineer,
commenting on the functions of the eaaements. confirmed that descrip-
tions incorporated within the documents are adequate and satisfactory.
The City Attorney, recalling that one of the conditions of the easement
stipulated that the City wiII not build or construct any structures
over or upon the easement, recommended that the City Engineer or the
City Planner advise whether the subject project will disturb, in any
Lray, the Hananoto and Associates bayfront plan.

will create no conflict with the bayside p1an.

a Corporation" was introduced for passaqe on motion of Councilman
Johnson, seconded by Councilman Amstrup and unanimously adopted

Ordinance No. 899 "Division of Administrative Service Into Classified
and Unelassified Service" rras before Council for second reading and
adoption.
Reference was made to a communication from the City Attorney, dated
July 31, 1969, setting forth sections of the "Civil Service Enabling
Act of 1935" and the notice thereof of authorization wherein by
eleetoral vote, the City's Civil Service System was placed into
effect on April 6, 1936.

as its purports to remove department heads from the claseified to the

Councilman Johnson, City Hall liaison, reported on her consultation
with Mr. Albert Kahl, the City Eall architect, as directed by Council
at its last regular meeting, and his indication that the statue of
Abraham Lincoln. when repai.red, may be relocated in the new City Hall
either by placing it in the Council Chambers or in the lobby, !,rith
preference given possibly to the latter.
Councilman Johnson requested an opinion concerning the placement of a
corner-stone in the new City Hall.
Mr. William J. Hauser, General llanager, Burlingame Chamber of corunerce,
expressed the opinion that a cornerstone would be appropriate and that
the contents placed therein souLd be of historical value to generations
to come.

recently, recommended that citizens be encouraged to contribute brief
messages to be deposited within the cornerstone.

SISTER CITY PRESENTATION TO CITY
Councilman Johnson advised of a call she received from Mr. Edr"rard
nojas of Cuernavaca, wherein she was notified that in behalf of t}re
Cuernavaca tionsr C1ub, a statue of General Morelos was being sent
via airmail, as a qift to the city of Burlingame.
Councilman Johnson stated that a delegation from Cuernavaca will be
in San Francisco on AugTu st 23 and 24 and that a request has been made
that a ceremony be prograrmred at Cuernavaea Park to officially receive
the statue.

mindful of their public image, which is also of great concern to all
police departments of our nation" and in addition to which, the helmets

oeeasions of emergency.

Burlingame submit materials representative of its eommunity, forinclusion in a special time capsule to be fil1ed and buried in
concrete during the current San Mateo County Fair and Floral Fiesta.

CO}IPLAINT RE: UNSIGHTLINESS
JACOPT AUTO BODY REPAIR SHOP
Mr. ceorge Garbuio, 840 Linden Avenue, entered a protest concerning
the unsightly appearance of the ,Jacopi Auto Body Repair Shop property
and initiated a discussj.on on the continual vigilance of the premises
maintained by both the Fire Department and the Police Department.
The city Attorney observed that in the case of the Jacopi ProPerty,
this is the first occasion in which a recormrendation haa been before
Council to revoke a businees license.

YELLOW TAXICAB COMPANY SERVICE
Mr. Angelo Dellacassa, 14I Victoria Road, commented on the poor
service rendered by the Yellow Taxicab Company and suggested that
an additional taxicab company be permitted to operate within the City.
The City Attorney advised that sufficient evidence must be produced
to substantiate complaj.nts agai.nst the taxicab company.
Following a brief discussj-on, the city Attorney, in reply to an
inquiry from the Chair, consented to aceept bona-fide evidence that
may be presented against the taxicab company.
AIRPORT EXPANSION PLANS
The City l,lanager announced that an invitation has been extended to
the city to attend a meeting at 3:45 p.m., at the Airport conference
Room, August 5, 1969, at which time a presentation would be made on
the long range airport expansion plans and the effect on cities within
san lrlateo County.

The meeting was adjourned at 9:45 p.m-, to meet on wednesday, August 6,
1959, at 8:OO p.m., on motion of Councilman Johnson and seconded by
councilman Amatrup.
