lthe City Council of the City of Burlingame met on iluly 21, 1969, at the
hour of 8:0O p.m.
1. At l,ord from the Chair, all in the CounciL Chamber arose and gave the
Pledge of Allegiance to the Flag.
2. Upon RolI call, thoae present were: Councilman Amstrup-CroEby-ceorge-
Johnson-uartin.
3. llhe Minutes of the regular meeting of JuIy 7, L969, submitted to
metdbers of Council previously, were approved and adopted.
An application filed at a regular meeting of the city council on JuIy 7,
1969, by ur. c. L. Hylton, requesting permission and license as required
for dancing and entertainment to be applied in the operation of the Les
ilon Restaurant, 1330 Bayshore Boulevard, was before Council for disposition.
Reports from the Pire, the Health and the Police Deparunents, subsequent
to investigation, indicated approval, with the Fire Inapector reporting that
the inner construction of the restaurant is yet to be completed and recom-
mending that the use therefor be approved in principle only.
t{r. Hylton, the applicant, rras recogmized by the Chair and in reply to
inquiries from the latter, stated that entertainment will consist of a
pj.ano, a bar and a snall combo, limited to three pieces; the type of music
wilL be sophisticated, to begin at 5:00 p.m., and end at 1:0o a.m.i and
and that the operation will be a bonafide restaurant, serving lunches and
dinners seven days per week.

permits have been issued and in reply to inquiry f rom l,layor lilartin,
Ur. Hylton advised that the Anza Pacific Corp., has engaged a contractor
to perfotm the heavy construction work and the contractor engaged by
hirnself , will perform the decorative details.

tion for a dancing and entertainment permit be approved, subject to the
cornpletion of the conEtruction rrork and the approval of both the building

APPEAT RE: CONVALESCESIT HOSPITAL (Marco Polo Way)
Mr. Harry S. Somers, representing the Baywood lttedical Building, Inc.,
the applicants seeking a repeal from the decision of the Planning Corunis-
sion in denying an application to permit a four-story building on property
located on llarco Polo way, addressed council to request a two week delay
in the scheduled hearing.
A letter filed by !1r. somers, in behalf of Edward H. de wolf, the architect,
dated July 18, 1969, requested the delay until the return of the City
Planner from vacation.

Mayor l,lartin, expressing his interest in the subject matter, announced
that he r*ould be on vacation and absent from the August 4th Council
meeting and suggested that the hearing be continued to the lSth of
August.

3. REVOCATION BUSINESS LICENSE (cordon Jacopi)
Mayor t{artin announced that in compliance wit}r City Code reguirements,
a public hearing had been scheduled on a recommendation from the Chief
of the Fire Department that the business license of Mr. Gordon Jacopi,
32I California Drive, be revoked, cancelled or suspended for failure
to comply with building and fire standards, in the conduct of his
business .
Ihe City Attorney, answering inquiries from the Chair, advised that
his office has been informed by the Fire Inspector that the fire doors,
the subject of the difficulty, have noh, been installed.
tlhe Fire Inspector confirmed that the installation has recently occurred
and recomrnended that the notice of revocation be rescinded.
lhe Building Inspector reported that in addition to the installation of
the fire doors, several building violations as yet have not been
corrected .
Itre City Attorney advised that Council may continue the hearing for a
period of two weeks and that if, in the interim, the regulations of the
Code are fully complied with, an action may be discontinued.
fhe hearing was thereafter c.ontinued to the regular meeting of Council
on Augnrst 4, L969.
4. ADOPTION 1969-1970 BUDGET
Mayor Martin announced that this evening had been pre-scheduled as a
second hearing on the proposed budget for the fiscal period 1959-1970
and referred to Councilman George, Council Budget Conmittee Co-Chailtnan.
Councilman ceorge reported that following the first public hearing on
the budget on JuIy 7, and a study meeting on JuIy 9, he, in collabor-
ation rrith Councilman Crosby, his Co-Chairman, reviewed the figures and
have submitted a budget in the total amount of $3,987,473.OO; that the
increase from the previous year's budget, in the amount of $494,475.00,
includes some of the capital expenditures necessary to the improvement
of the City; that the current tax rate of $1 .25 per $1OO.OO Assessed
Valuation has been retained and that the budget figure also includes the
replacement of departmental equipment to meet present day standards.
Councilman George concluded his presentation with an observation tltat
the saLes tax revenue received by the City alleviates some of the tax
demands made upon the taxpayer.
A letter was acknovrledged from the Tri-County Apartment Association, Inc.-
dated irune 30, 1969, signed by E. c. Christenson, Executive Vice-
President, urging "elected officials" and other "public officials" to
"not play politics by maintaining the current tax base" but to instead
"lower the tax rate by prudently trinuning the fat from the budget and
having the new tax rate decrease in proportion to the increase in the
assessed valuation. "
There being no cotEnents from those in the audience, or from members of
Council and the City staff, the Chair declared the hearing closed.

1. REPORT ON BROADWAY OVERPASS
A conrmunication from the City llanager, dated July L7, L969, reported
a meeting rtrhere in he and the City Engineer discussed with officials of
the State uivision of Highways the recommendations of the latter for
the interj:n improvements to the Broadway Overpass to be included in
its 1971-1972 budget and progran.
Recalling th at the expenditure for the improvements was estimated at
$450,000.00, of hrhich sum $32O,00O.O0 was the Statds portion, the
City ljlanager reported that the State has advised that the expenditure
has not been included in its 1970-1971 budget; that the project will
be forwarded to the main office for engineering approval as part of
its 1971-1972 program with a report forthcoming to Council in September
of this year.
It was the recommendation of the City Manager that if the City is going
to subrnit a proposal in an attempt to expedite the interim improvements,
it should be discussed and defined at a study meeting.
llayor Uartin stated that he would be absent at the next study meeting
and hrould suggest that Council consider an approach to the State for
a determination on a sum to be allocated by the city sufficient to
include the project within its 197O-1971 budget and also, to solicit
the asaistance of the legislators in requesting the State Division of
Highways to progran the interira improvements at an earlier date.
The subject was thereafter referred for Council study on wednesday,

2. ACCEPTAIICE RESURFACING PROGRAIII
CONTRACT COMPLETION L. C. SI/IITH CO.
A comrnunication from the City Engineer, dated July 16, 1969, advised
that the L. C. Smith Conpany has satisfactorily completed the resurfacing
of miscellaneous city streets in compliance with cgntract agreement
(Irlarco PoIo way, Be1levue and Floribunda Avenues, Ansel and Primrose Roads)
and recommended that the project be formally accepted.

Councilman George introduced for first reading, the following Ermendment
to Ordinance No. 899, adding to Section 1 (a) Unclassified Service,
sub-section 4, the words " and one private secretary if authroized. "
A vote on the adoption of Ordinance No. 899 was withheld, pend ing the
second reading of the forego ing amendment at the regular rneeting of
Cormcil on August 4.
4. IfASTE TREATI.,IENT PTANT TRUCK
A memo from the City l.{anager, dated July 17, 1969, referred to a dis-
cussion occurring at the last study meeting concerning the purdtase of
a repJ.acement truck for the exclusive use of the plant operator at the
Wastewater Treatment Plant and also to a resolution prepared authorizing
the invitation of bids for the purchase of a 3/4 ton truck.
llhe City Uanager stated that the paasage of the resolution is required
to apply for a Federal contribution and as a supplement to its original
grant of assistance for the construction of the serrer plant.
The City Engineer, in reply to inquiries from Council, explained the
purpose for which the truck would be used, including the hauling and
the depositing of dried sludge after the materi.al leaves the centrifuge.
Discussion arose on the nuniber of occasions within the week when the
dumping of the material is reguired and the possibility that the Park
Department's dunp truck may provide this particular service.
Councilman George questioned the status of the Federal grant and the
position of the City if, at some future date, the truck should be
replaced.
Ttle City Brgi-neer advised that he would seek a clarification on this
point for report to Council at the next study meeting.
The City !{anager hras thereafter requested by Council to investigate the
feasibility of purchasing a small truck for the Sewer Plant and to use
the Park Department's new dump trucl< when waste materials from theplant are to be unloaded.
Councilman crosby initiated a discussion on the baseball diamond area
to be constructed within the adj acent vicinity of the sewer plant and
the disposal property, questioning the progress thus far on the grading
of the land.
ftre City lilanager stated that the project is proceeding according to
plans prepared by Hanamoto and Company, the architects.
ftre City Engineer advised that stales are being placed for the pre-
liminary grading and in reply to lt{ayor Martin's inguiry concerning
the logic of this procedure when more fill is to be deposited, stated
that sqne appropriate height of fill must be first determined and
that the grades at this point of the development are temporary.
Discussion concluded with the City Engineer, answering an inquiry from
Councilman Crosby, advising that the grading of the ball diamond area
will be accomplished first, the parking area secondly, \rith total
completion of the grading approximately within a period of one month.
5. INSTALLA?ION CHAIN LIT{K FENCE REQUEST

East of Bayshore Improvement Association, recolunending that in planning
the landscaping in the area of the water Treatment Plant, Council
consider relocating the chain link fence to expose the City's attractive
Wastewater Treatment and Reclamation Work s sign to better visibility.
Tlhe City Manager, questioned by the Chair, stated that the observation
basin containing a discharge of treated water at the base of the sign,
if exposed beyond the fencing, may be an attraction for acts of vandalism.
lrhe City Engineer stated his reluctance to placing the sign outside the
protective fencing and also expressed his concern that drildren may have
a tendency to play in the $rater or that acts of vandalism may occur to
handicap the function of the discharge basin.
A series of questions and answers fo1lowed, concerning costs to relocate
the fence and the sign, with both the City Manager and the City Engineer
advising that the relodj.on of the sign, because of its stationary position,
would be particularly costly.
Further discussion concluded with the majority of council, in response
to a poll call by the Chair, indicating objection to relocating the
fence and subjecting the sign and the discharge basin to possible
vandal ism.
6. PARK A}ID RECREATION COMMISSION RE:
SIGNS IN BT'RL]NGAI{E NATURE PARK
A communication from the Burlingame Park and Recreation Commission,
dated iluly 16, 1969, recommended the erection of signs to discourage
"hunting " and "shooting" in the Burlingame Nature Park.
A model of a proposed sign for posting the area was displayed.
fthe City Manager was requested to ascertain the number of signs reguired
and the cost thereof for report to Council at the next study meeting.
RESOLUTIONS
RESOLUTION NO. 66-59 "A Resolution Acce pting Deed of Easement" and
granting a terenty-five foot strip of Anza Airport Park Unit No. I, to
the City of Burlingane, nas introduced for passage on motion of
Councilman George, seconded by Councilman Johnson and adopted unanimously
upon Roll CaIl.
PARCEL MAP ATIZA PACIFIC CORP.
A Parcel l{ap, a subdivision of a portion of the Land s of Anz a Pacific
Corp., dated January, L969, previously subrnitted, was before Council
for approval.
Councilman Amstrup moved that the Parcel l,lap be approved, subject to the
irnprinting thereon of the twenty-five foot easement prior to recording.

Councilman Johnson displayed a proposed new City Seal, prepared in
draft form by A. wood s ciberson, and presented to Council for corrnents.
The reaction of Council being favorable, the City Uanager rras requested
to confer with Mr. Giberson on the inclusion of such details on the
Seal that may be applicable to the several City departments.
2. ABRAHAIT{ LINCOLN STATUE
Councilman Johnson reported a telephone call she recently received
concerning I*1r. Arnold Comfort, who cast the original mold of the
statue of Abraharn Lincoln, Iocated in the Council Charnbers, and his
offer to nake the repairs necessary to the statue before the occupation
of the new City Hall.
Uayo r Martin suggested, with Council concurring, that Councilman
Johnson, City Hall liaison, confer with !tr. Al.bert Kahl, the City Hall
architect.
NEW BUSINESS
1. ACTION REQI'ESTED BY MAYORS I COT'NC IL
Uayor l,lartin referred to subjects introduced at a recent meeting of
the San ltateo County Council of t{ayors and requiring a decision from
Council:
(a) Ttre position of Council relative to the stand taken by the san
Mateo County Board of Supervisors in the employment of San Uateo
county plumbers at the Airport.
Itlayor Ir{artin recommended that Council take an affirmative position
on the issue.
Couneilman .Tohnson moved that the membe rs of the Burlingame City
Council endorse the position taken by the san llateo county Board of
Supervisors in the hiring of san uateo County plumbers at the San
Francisco International Airport. fhe motion was seconded by Councilman
Arnstrup and unanimously carried.
Cb) 1rhe reaction of Council to his appointment, in his role as
Chairman of the Mayors' Council, of a fact-finding comnittee to
investigate and to recommend, to the Board of Supervisors, an
appropriate method to proceed with a rapid transit plan.
Ir{ayor Martin explained that opinions expressed at the I,{ayors' Council
meeting indicated that although the measure was defeated by the elec-
torate, some initiative should be taken to preserve the efforts thus
far expended in behalf of implementing rapid transit.
Mr. William J. Hauser, General llanager, Burlingane Chadber of CorEnerce,
in attendance, observed that the issue is one of concern to the business
public and advised that the Chamber of commerce is of the opinion that
with the amount of funds that has been expended on the proposal, the
project should not be completely abandoned.

The City Attorney referred to a teletype received from the Office of
the covernor announcing the "Day of National Participation, to be
observed consistent with Section 6700 /s/ ot the covernment Code, "stating that this particular section of the covernment Code is incor-
porated within the Civil Service Rules and Regulations of the City.
Commenting on the enforcement of parking regulations, the City Attorney
stated that the ordinance could be amended to enumerate the particular
holidays wherein parking regulations would be exempt.
A brief discussion on the subject of "holiday observance " concluded
with the City Attorney requested to research the prerogative of Councilin establishing a policy on special holiday closing.
