Robert Remensperger, President of the Auxiliary, in the audience, spoke on the success of the previous projects fron uhich funds are derived to give assistance to retarded adults and children and to participate in csnmunity activities; that based upon prior experience, approxirnately 25,000 people sould visit downtown Burlingame betrreen october 24, through Saturday, October 31, with the building vacated by llovember 2 . tl[r. Eauser, General ttlanager, Burlingame Chaniber of Conmerce, spoke on his conference sith the apon6or6 of the Eaunted llouse project and that some doubt has been expressed by the merdrants that weather conditions ray forestall the demolition of the building in November, thus delaying the conEtruction of the parking lot; business sales during the holiday season average between $2O0,O0O.O0 to 930O,O00.00in Noveriber and between $4OO,00O.00 to $500,000.0O in Decenber, and that although there is no objection to the use of the building for the purpose intended, there is a conflict of dates. Ur. Eauser stated that the merctrant s are appreciative of the businese last year's project activated r however, there ie a question in his mind hrith respect to the use of a public building that has been condenned. It{rs. Ruth steiner, a member of t}re euxiliary, speaking on the condemna- tion of the building, stated that this point should not preclude its usager that there is sufficient insurance to cover all contingencies and requested that Council take a favorable action. Council man titartin, conmenting upon the relatively few parking spaces proposed in the area, to include also an acceas-rvay, obeerved that it has been reported that an attendance of approximately 25,000 people visiting the project, will also circulate in the business area. !tr. P. R. (Bud) Taylor, a member of the Burlingame Charuber of Comme rce Parking Corurittee, stated that several years have elapsed since pro- ceedings were initiated to formulate a parking district; the bonds will soon be sold, plans are laid to demolish the building in August, and parking spaces will be made available in Decemberi that in his opinion, it would be poor planning to delay an action. I{r. Taylor's corurent that the use of the old City Hall as a "Haunted I{ouse " was inappropriate, was concurred sith by Councilman Atn8trup, howeve r worthwhile the project. A poll of council thereafter indicated Councilrnan Atnstrup, Councilman ilohnson, Councilman Uangini and llayor crosbtr in agreement with proceeding with plans to improve the Bubject lot. ltrs. Remensperger, soliciting the assiatance of Council in locating another site in Burlingame for the Haunted House project, lras referred to Realtor PauI constantino, in the audience, who volunteered to as8ist the Auxiliary by approaching the orrners of the vacant l,lontgomery Ward store as a possible project aite. Iilayor crosby spoke on the untiring efforts of the Parking Cor0mittee to obtain additional lots for inclusion within the Parking District, the arrangements under*ray to demolish the building and his personal opinion that priority should favor the creatj,on of the parking lot. 81.8 COI,TMI'NICATIONS 1. ROY FI'RES APPE,AL IN RE: USE PERII{IT TO @NSTRUCT ROOII{ A communication rras read from lttr. Ray Plores, 1257 Drake Avenue, appealing the decision of the Planning Commission in denying his requeat for a use pennit to convert an existing covered patio into an enclosed rurpus room. The courmunication noted that "one negative vote that night" defeated the application. 1!he hearing before Council was scheduled on l.{onday, .Iuly 2O . In reply to councilman l.langini's inquiry coneerning the negative vote rejecting the application for a use permit, ttre City Planner advised that a legal quorum hraE present; however, the attendance of four cormissioners from a total menbership of seven requires unaninity and that failing, the subject is now before Council on an appeal. 2. APPI.,ICATION FOR A CIIY LICENSE TO OPERATE AIitUS EI,{ENT RIDING DEVICES A communication rras read from ltonald w. Hager, Advance Agent, E. A. Leavitt Attractions, Inc., requesting a city license on behalf of the Burlingame Plaza Shopping Center Uerchants Association to operate eight modern amusement riding devices and one confection trailer on the parking lot of the Center in conjunction with a "Promotional, Saler" event to be conducted by the merchants in the area. An accompanying report from the Police Department endorsed ttre application and a footnoted memo ttrereon, frorn the City uanager, recoEmended that the permit be approved Councilman llartin referred to a policy set by Council wherein applicatians- requiring inspection reports be first submitted to Council for its authorization. The City llanager stated that because of a time elenent, a police report vras requested in advance of the Council meeting. Discus6ion arose on the adequacy of the insurance coverage, with Irlr. Ilager, the applicant, in attendance, consenting to an inclease in the liability coverage. Councilman uangini conplimented trtr. Eagar on hi8 excellent presentation of letters received from agencies in other cqanrunities that accompanied his application. A motion was introduced by Councilman Johnson that a pemit be issued to !{r. Ronald w. Hager, to operate auusement riding devices and a confection trailer at the Burlingane Plaza shopping center on .Tuly 22 through July 26, 1970, subject to the follouring: that liability be provided in the anount of $3OO/5OO/25. lIhe motion was seconded by Councilman aostrup and carried. 3. PEIUNST'LA EARLY LE,ARNING CENTER REQUESTING AIIIEIIDI{ENT TO @NDITIONS A cotruounication was acknorrledged fron l,tr. :Itrdaas A. Palmer, Attorney, aseociated with the law fim of cushing, Cullinan, Hancock & Rothert, dated June 3O, written in behalf of the Penineula Earl. y Learning Center, Inc., and requesting that the condition upon which the permit lras grantd, "that the students be transported to and frorn the school in a trans- portation van" be amended to allotv studeBts to be transPorted to school in a car pool . 4. CHANGE TN ZONING CIDE IN RE: PI'BLIC HEARINGS ON VIOLATIONS A c@nunication wa8 read from the City Planner, dated .rune 23, L97O, and referred to a draft of a proposed anendment to the Burlingame Municipal Code recommended by the Planning cormission, which provides for a procedure by r"rhich the Planning Commission nay hold a public hearing in certain inatances wherein the recipient of a use permit or a vari.rnce does not meet the agreed conditions or otherwise does not confom to Iaw. In a verbal report, the city Planner advised that the material was obtained fron the County of San lt{ateo by the City Attorney and prepared in ordinance form. councilman l,lartin questioned the inclusion of a procedure relating to violations that may occur affecting dance permits, building codes, sign ordinance requirementa, etc., and whether the policy of nailing notices of hearing to property o\rners at the tine of the original application should not also apply in suctr instances of variance violations . fhe City Planner advised that the proposed amendment affects the zoning code, that he rsould study, horrever, procedures to resolve violations of other type per its. fhe City Attorney concurred with Councilman Martin in that there should be a reviev of all licenses granted under code provisions and that \,,rith respect to this particular ordinance, it is deserving of special treatment as it affects City Planning proceases. Irhe City Attorney advised that he would have no objection to the setting forth of a procedure requiring the mailing of notices to those notified at the time of the original variance application. llhe City Attorney was thereafter requested to re-word the proposed ordinance to include the procedure recormended. 5. BROADWAY PROPERIY OI{NERS PARKING DISTRICT PROTEST A ccramunication from ilohn A. Cost, Attorney-at-Lae, representing property &rner6 affected by the Broadrray Area Off-Street Parking and Beautification Assessment Diatrict, advised that he has been requested to transmit to Council the strong feelings of his clients that the proposed Broadrray Area Off-street Parking District is not feasible and should be abandoned. fhe City PLanner recomended that the comrunication, together with the petitions, be referred to Kenneth I. ilonea. Attorney, representing the Parking District. f.rr. Philip Neerman, Broaderay merchant, identifLed himself as a membe r of a committee advocating the establishment of a parking district in the Broadway area and expressed surprise that a petition was filed protest- ing its fornation. !lr. Nerman advised that in Uardr of this year, an invitation waa extended to all Broadway merchanta to attend a meeting at City llall, the City Planner rras present. and the subject was widely discussed. Net^man that the sub j ect petition evidently was circulated without the knowledge of many of the merchants. al-r lrhere being no one preaent to speak on the subject, the City t{.rnager rras requeated to notify I{r. Palmer, or a repre6entative of the corporation, to be present at the July 20 Council meeting. 81'8 Uayor Crosby stated that he was hopeful that the merchants would be interested in beautifying the area and !lr. NewBan replied that he would continue to work in behalf of the project. 6. REQUEST FOR DEPOSITORY RE: A communication was acknowledged from Hr. Frank E. Sieglitz, 5O5 Burlingane Avenue, dated July 1, 1970, requesting that tlre City of Burlinganre make available facilities to aerve as a depository for recyclable materials. A conmuni cat ion was also acknowledged frorn the San t{ateo County Scavenger Cotopany, dated irune L2, 1970, replying to an inquiry from the City Uanager concerning "neyrspaper recycling. " ltr. Louis ar. Devincenzi, Secretary, advised of the unsatisfactory past experience in this type of undertaking, that present information as to a possible Bay Area-vide program is about eight or nine nonth s away and the construction of a local paper nill to handle the material is approximately tuo years array. Ur. Sieglitz, in attendance, r,as invited by the Chair to conment onhis proposal . I{r. Sieglitz spoke on the current interest and publicity concerning the recllcling of various rraste materials and of his interest in the City of Burlingane'B participation in a program to assist in the preservation of natural resources. !tr. Sieglitz advised that he has conferred wiur the Sunset Scavenger Corporation in san Francisco, rdro are working on a feasibility strdy and who will reply to his inquiries concern.ing the types of materiale appropriate for reqlcling and the frequency of the collection. Discussion concluded with l.{ayo! Crosby suggesting to ttr. Quentin Cook, Attorney, representing the Lincoln Property C@pany referred to the contract betueen the City of Burlingane and !lr. Oscar Peraon and to the recent offer of Lincoln Properties to develop the 12.?5 acre site ourned by Ur. Person. Referrillg also to the Lincoln Properties representatives meeting with Council at its last study eession, wherein it was suggested that the proposed plan of the company be initiated through variance procedure at the Planning Conmis6ion level. Council thereafter indicated no obj ection to the Linc.oLn Property company applying to the Planning Conunission for a variance. RECESS A recesa was declared by the Chair at 9:4O p.m. - lrhe meeting was again convened at 9:55 p.m.RECOIIVENE FOR REtrCLABLE I,IATERIALS llhe City t{anager pointed out some of the ramifications that may be experienced and recomnended that the City keep in close touch with the local scavenger company. COIO{I NICATIO}{S - Continued. A comnrunication addressed to the City llanager from the Chief of the fire Department, dated June 26, 1970, suggested that in coarpliance with requests received fror neighboring cities, the City consider the adoption of a written mutual aid agreement. Copies of mutual aid agreements presented to Council for examination, accompanied the communication. A memo from the city t{anager, dated iluly 2, 1970, advised that a verbal mutual aid agreement ha6 been in effect for a number of years and recommended that legislation be directed to formalize the agreement. IOWRIE PAVING COT{PANY CONTRASP ACCEPTAICE A conununication from the City Engineer, dated July 2, L97O, advised that the Lorrie Paving Conpany rpill have satisfactorily completed its contract for the resurfacing of miscellaneous streets within the City of lurlinganre on Friday, .Iuly 3, and recoulended that the contract be formally accepted. RESOLUTION NO. 57-70 "Acce pting Resurfacing l{iscellaneous City Streets - ifob No. 7O-2' (Lpflrrie Paving company) was introduced by Councilman ifohn8on, who moved its passage, seconded by counciluran Arstrup and unanimously adopted upon Roll CaII. 10. AGREEUENT COT'NTT-CIMT OT BURLINGAUA RE: BROADIIAY OVERPASS IITPROVEUENTS A communication fron the city Engineer, dated irune 25, L97O, referred to an accompanying agreement between the County of San l{ateo and the city of Burlingame relative to a reinbursement from County cas Tax funds to be applied to&rard the financing of the Broadway Overpass Improvement Proj ect . "UI,TUAL AID AGREEI,TEI{T" FI'RNISH FIRE PROTECTION councilman llartin, in questioning the fire Chief concerning the dispatch- ing of equipment and personnel particularly to the Burlingame Hills area, was advised that there will be no change in poliqlr that is currentLy in effect in an agreement nith the Division of Forestry. A brief discussion concluded sith the city Attorney requested to prepare legislation for adoption at the July 2oth Council meeting. 9. RESOLUTIONS lIhe City Attorney explained that a trrenty and one-half foot parcel, formerly omed I the Trousdale Corporation, conveyed to the Texo Realty Company, when the fonner released its holdings in the Mills Estate and l,tillsdaIe Industrial area, is being sought by Mr. Richard o'Hara for inclusion within his current agreement of sale with the City and it was recoarnended that Council accept the parcel in the form presented. IJNFINISHED BUSINESS 1. DOGS RI'NNING AT LARGE titayor Crosby initiated discussion on the subject of dogs running at large by comrnenting upon complaints he has received fron citizens. Itlr. Hauser, Chardber of comnerce ceneral llanager, also reported on the telephone calls he has received and particularly from elderly uomen uho have been frightened while hralking on the Avenue r that the dogs do appear to be without lj.cense and running loose. I{ayor Crosby stated that the issue had been discussed at the last study meeting and read from a report prepared thereafter by the City Uanager, dated iluly 2. llhe City lt{anager advised that he had conferred with the Iluroane Society who have stated that citation procedure is applied only in flagrant and continuing cases of violation and that that agency is seeking a code section to be adopted by all cities to aid in the enforcement of flagrant vioLations. In a verbal report, the city lLrnager advised that only eight cS.ties within the county have J.egislature in this reqard and whi1e such a measure is not a panacea to the problem it would be of sone asEistance to the HurBane society. The City Engineer advised that several meetings have been held on the preparation of a plan for the area in collaboration with the Park Superintendent and a report will be made at the next study meeting.
