John Jenks, Consulting Sanitary Engineer, would be presentto discuss a change order for the wastewater Treatment Plant projectin the anount of $707.25. At the reguest of the Chair, the City Engineer explained the circum- stances that, arose to require additional wiring and to install animproved "flocculator drive system" at the new Sevrage Plant and therequest thereafter for a change in the work order. Mayor Martin red.led his original question concerning the Consult-ant's statement in a letter dated Decembe r 26, 1968, indicating thatthe Dorr-Oliver company had manufactured an irqrroved unit not accounted for the plans and specifications used by the contractorin sutnri tting his bid and to a Eecond letter dated January 8, 1969,explaining that his Office had inadvertently utilized drawings frma previous project. Mayor lr{artin Etated that Council has been presented hri t}r uro different reasons in the request for a change in the work order and invitedlrlr. Jenks to clarify the issue. Irlr. ilenks confirmed that the plans prepared by his Office incorrecttyutilized drawings from a prior circuitry; that bids were received on that basis, subsequent to which it bras learned that the manu-facturer had modified the unit the reby requiring a ne$, tlrpe Etarter and additional wiring and it was recommended that a change orderbe approved to include the inproved unit in the se\{age plant plans. ftre point at igsue was debated between I[r. Irtr. irenkE stated that the additional cost of the equipraent reguiredto have the Sewage Plant function properly is a justifiable expenditure accruable to uhe city. (tre City Engineer stated that the proposal was initiated by the Cityof San litateo, currently under contract to widen the south half of Peni.nsula Avenue and hopefully to declare the street within aD under- ground utility dietricti that the najority of the utility PoleE are located on the Burlingame side of the street and that it. will not bepossible for the city of San llateo to establish the district without the cooperation and consent of the City of Burlingame. ltle City Engineer further stated that the cost to the property cr,tner includes a trenching from the sidevalk area to the entrance service,back-filIing the trench, plus the necesEary labor and material to connect the service with the residence and that cost eEtimates received fr@ electrical contrlctors for the converted service rangefron $30O.00 to $800.0O, excluding industrial properties. ltre City Planner, in reply to Mayor t{artin, explained the role of the pubLic utility companies in the underground utility Districts and the budgeted fund s allocated to the cities to aecoulodate under- ground wiring and that Peninsula Avenue is the first district in Burlingane proposed for the conversion under this program. the city Planner continued by stating that Peninsula Avenue is a thoroughfare, the large po).es are unsightly and the program to hriden the street would serve a!, an opportune time to proceed with the undergrounding project; hourever, the issue iE one of money; thepriceg are quoted higher than those estimated but the improvement would increase the value of the property. ltre City Planner confirmed, in reply to the Chair, that the cftrnerg are obligated to finance the trench work required and the internalwiring, the the utility co;ranies bearing the major coats of the conversion. cround rules were announced by the Chair and thoae favoring the under- ground utility project were invited to speak. lhere appearing no one present to apeak in favor, the opponents qrere invited to c@[ent. Mr. clyde Williams, 156 lriayfair Avenue, Daly City, protested the $420.00 cost againet his property located at 812 Peninsula Avenue,stating that the street is one in an old section of the City andthat no new single fani ly residences have been constructed in thearea Eince the 1930 's. Irlr. Janes Skaff, 3812 Ferrnrood, San llateo, stated that the $575.00cost against his property at 604 Peninsula Avenue is cmpletely outof line and that the lighting derived from the proposed service will be no greater than that currently supplied. ur. Ra]rnond R. Kliemer, crrller of comercial property at 1016 Peninsula Avenue, with an e stimated cost of 9905.00, reported that very fewpoles are in evidence on Peninsula Avenue and that the one located on his property Eerves as a "dividing line" betrpeen properties. Mr. Kliemer stated that the wiring to hLs property emanates from the San llateo side of Peninsula Avenue and questioned the statu8 of hisservice in relation to the proposed project. HEARING 40 Ihe inquiry wag referred to a Telephone Company repreEentative who advised that the underground diEtrict must, be consented to by bothcities and if to the contrary, the poles will remain. A representative from the Pacific caE and Elect.ric Company, confirmedthe statement, adding that after the r.ridening procese, poleE wiIIbe re-located to the new property line. l,trs. Edith M. Hughes, speaking for her moth, reaiding at 8O8Peninsula Avenue, protested the $295.00 coat, Etating that the conversion will benefit only a fel, and that the aEsessment wouldprovide a burden to her mother living on a very limited incme. !tr. In reply to inquirieE fron @uncil, the spokesman for the Pacific Gas and Electric Conpany advised that the two citiee eichrr.y91116 receive an allocation of $52r8OO.OO for the converEion programfor this particular project. Following further discussion, the hearing was declared cloEed withthe Chair requesting the pleasure of Council. Counci lman Crosby, cmenting on the siroilarity betlreen the reactionsof the property o\dners included in the subject proposal with that in ttre matter of rezoning the area several years prior, stated that it would appear that the service is not desired. fhe city Planner Euggested that Council may explore the poesibilityof establishing an aasessnent district wherein colrts may be spreadover a period of time. It{r. Kenneth f. alones, Attorney, qualified on the subject of assesE- ment procedure, stated that assessment districts for undergroundutilities is permissible, hcnrever, the law places a Lieitation of $250.00 on the amount a property olrne r may be assessed and that thecosts indicated on this occasion are in excess. A motion was thereupon introduced by councilman Crosby that the formation of an Underground Utility District on Peninsula Avenue bedenied. the motion waE seconded by Counci Iman George and unanimouslycarried. A colununication fron Robert L. Chrisman, 621 california Drive,April 10, 1969, requested a license to continue operating the premises at 1340 Ho^rard Avenue (Burlingame Bcnrrl) as a bovrling a pool room, a restaurant and a bar. dated alley, The city Manager vras requested to obtain the reguired reports from theFire, the Police and the Health Departments and uay 5, 1969, was scheduled as the date to conduct a public hearing on the application. FIRE AP PARATUS SIGNALS JOB 68-19 CONTRAET ACCEPTAIICE A communi cati on fron the City Engineer, alated April 15, 1969, advisedthat the Kennedy Electric cqrpany has completed a contract with theCity for the furnishing and the inEtallation of fire apparatus signalsat Fire Station No. 3 on Rollins Road in full conpliance with plans and specifications and it was recormended that the job be formally accepted. A meno footnoted on the cormunication from the Ci ty l{anage r. datedApril 17, 1969, concurred with the recoruaendation. A verbal c@nent fron the Fire Chief, in reply to Councilman George, confimed that ttre inEtallat,ion is satisfactory. SIDEI,TALI( CLENIING COST E STIMATE A memo frqa the city uanager, dated April 17, 1969, submitted a report on the estinated cost of cleaning the siderralks on Brrlingame Avenue and on Broadway, if the service is provided by the city. fhe City titanager suggeEted that the legality of requiring the storeproprietors to assume the cost try some means be researched, Councilman Johnson, recomnended, with Council concurring, t}rat anaction be withheld and that lr{r. PROIIIBITION PARKIT{XG OI,D BAYSHORE A eqununication from the city Manager, dated April L7, L969, advisedthat in conpliance with a request frql the East of BayEhore Improvement 4. 42 AsEociation for restricted parking on a brenty-four hour basig withinspecific areas on the Old Bayshore, the area has been inveatigated by the Police Department. A recqraendation that legislation be directed to effectuate the change, vras concurred in by the City UaDager and the Health, Safety and ?raffic Couaission. the City Attorney was thereafter directed by Council to prepare the necessary legislation for Council adoption at the regular meetingof May 5, 1969. 6. !.{ONITORING PROGR/NI REOUIREMENTS A cor [unication from the San Francisco Bay ltegion Regional water Quality control Board, dated April 10, 1969, referred to certified copies of it8 detailed specifieations for the CityrE lloni toring Program at the Sewage P1ant. A memo fr@ the City ltanager, footnoted on the coruruni cati on, datedApril 17, 1969, advised that the self-monitoring progran will beginwithin a period of ten dayE after the new Plant begins operation. In reply to inguiries frqrt t]re Chair, the City Engineer confirmedthat rrri thin tendays after the opening of the Plant, the monitoringprogram will cormence; that the receiving waters will be monitored once a month, with consideralrly more monitoring conducted hrithin the Plant itself. lItre City E:ngineer advised that a new laboratory technician sill be employed at ttre Sewage Treatment Plant stadirg on Uay 12. couDci L wag recminded by the city Engineer that hig Office had EqueEted the passage of a resolution to be sulmitted to the Federal Wbter Quality control Board seeking an allocat.ion of funda that nay be applied to\.rard the purchaae of a sr0a11 boat to be used in themonitoring prosrram. lrhe City lilanager and the City Attorney were requested to collahrate on the preparation of an appropriate resolution. 7 I,TINOR III{PROVEUENTS AUTIIORIZED EASI BAOADINY-BURLINGA!,{E OVERPASS A conununication frorn the city l{anager, dated April ?, 1969, requeated authorization to proceed wi th minor street improvements on the eastside of the Broa&ray-Burlingame Overpass, in compliance r.rith a request from the East of Bayahore Improvement Asgociation. ltre City uanager advised that the improvement cost ritas estimated at approximately 92,000.00, of whieh sum the AsEociation has offered tocontribute the cost of materials in the amount of $500.O0. The city Engineer, answering the Chair's inquiries, Etated tf,rat the area in question vrould be improved by relocating a section of the curb along the Old Bayshore to allow an additional southbound lane andby re-striping a section to allow two laneE of traffic northbound and that in his opinion, the interim plan is not incornpatible wi tfithe State Highway plan. ltre city Manager advised that the city is in receipt of the $500.00contribution from the Improvement Association. ur. l{'i lli an J. ttr rdy, a raenber of the East of Bayshore fmProvement Aseociation, expressed the pleasure of the merube rs for the cooperation received i.n overeoming some of the traffic bottlenecks and statedthat the proposed iiprovment is entirely comPatible with the Statersplan for the Overpass. REOUEST USE OF I{AqINGTON PARK A communication from the city !{anager, dated April 17, 1969, advised that the Burlingame Police Association has requested the use of the Washington Park Baseball Field for a circus, the proceeds of urhi ch wi]l be used for youth and,/or charitable activities. Ihe City Manager recommended that Permission be granted upon the condition that cotnplete insurance coverage be provided, that any and all city expenses be paid, with the exception of the licensing fee . A brief discussion concerning the contract features were discussed and the insurance coverage determined to be adequate. The city llanager waE authorized to notify the Police Association of the consent of Council. The City Enginecr stated that the associat.ion has engaged a rateanalyst and it is hoped that the Public Utility cormission will delaydecision to allo, the association additional time to *udy the propoEed revision in water rate schedules. 10.
