POLICE STATION BIDS REIIIODELING A communication from the City llanager, dated February 12, 1970, recom- mended that Council authorize the advertisement of bids for the remodeling of the Communications Room at the Burlingame Police Stati.onin compliance with legal requirements. There being no objection from Council, the City Uanager wae authorizedto advertise for bids for the project. 2. PRIMROSE LANES DA}ICE PERUIT APP ROVED A co rmunication from the City tlanager, dated Pebruary 12, 1970, advised that pursuant to inspection of the premises of Primrose Lanes, 134O Howard Avenue, the Police, the Fire and the Health Departments, having reported favorably, reconuaended that the applicatlon for a dance permit be approved. litr. Christnan, ovrner, questioned by Councilman ilohnson, stated that the establishment includes a reataurant, a billiard parlor a bowl ing alley and a cocktail lounge; the latter section wherein foodwiII be served wiLl be enlargTed to accommodate a sma1l dance floor. Replying further to Councilman alohnson, !1r. Christman advised that a business license is issued to operate the entire establishment, entitling minors admittance to each of the several areaai that under this license, the cod<tail area, featuring the sale of food and dance music, will also admit minors unless Council directs other:rrise. in approving and recommended Primrose Lanes. Council concurred and a motion vras thereupon introduced by Councilman Johnson that a dance permit be issued to Primrose Lanes with a pro- vision that minors be prohibited the use of the danee floor. llhe motion was seconded by Councilman Crosby and unanimously carried. 3. TIA MARIA RESTAURANT DANCE PERMIT APPLICATION A communication received from l{r. w. L. Sinmons, Chairman, Board of Directors. Tia Irlaria Restaurant, dated February 4, L97O, requested the issuance of a permit to conduct dancing at the new Ti,a Maria Reataurant Iocated on old Bayshore Hi.ghway, immediately north of Charlie Bror,'rr's. RESOLUTION NO. 13-70 "Resolution of covern ing Body of the City of Burlingame Requesting County Clerk of San Mateo County to Render Specified Election Services Pursuant to Section 22OO3 of the Election Code and to Furnish Voting !{achines" was introduced for passage on motion of CounciL- man lTohnson, seconded by Councilman Amstrup and unanimously adopted upon Ro1l ca11. RESoLUTION No. 14-70 "callin g a Public Hearing to Determine Whether Public Neces6ity, Eealth, safety or welfare Requires the Formation of an Underground Utility District - City Hall Site and Contiguous Areas" (uarctt 2, L97O, public hearing) was before Council for consj.deration. Mayor Martin. referring to a request received from the Peninsula Itospital and Medical center for the removal of utility poles, guestioned the City Attorney whether this particular section could be considered simultaneously $rith the City EaII site area. The City Attorney advised that the absence of a precise description of the area within the hospital affected, Iegally required, precludes consideration at the forthcoming public hearing. ORD INANCES - Consideration thereof: oRDINANCE No. 911 "An ordinance Amendin 9 Sec. 25.70.OI0. 25.?O.O2O, and 25.70.030 and Adding Sec. 25.70.05O and 25.70.060 to Chapter 25.70 "off-street Parking' of the Burlingame Municipal code" was given its second reading and upon motion of Councilmarn Johnson, seconded by Councilman crosby, said ordinance passed its second reading and was adopted by the following RoIl CalI vote: Ayes: Councilmen: funstrup-crosby-.rohnson-ltartin. RESOLUTIONS -- I 2?4 ORDINAIICE NO. 913 "An Ordinance Addin 9 Chapter 15.Io to Title 15 'water and selrers' of the Burlingame ttunicipal Code and Regulating Discharges Into the Sanitary sehrage System" was introduced by Council- man Johnson and given its first reading. 1. FERRIS ENTERPRISES REQUEST PERUIT OPERATE I,IECIIANICAI RIDES IN PLAZA AREA A comnunication was acknowledged from Mr. L. C. Ferris, Agent, Butler's tunusements, dated February 16, 197O, requesting a perrnit to a1low the operation of seven mechanical "kiddie" rides on the parking lot in the Burlingame Plaza area, between Trousdale and Uurchison Avenuea on EI Camino Real, on ltarch 4 through Uarch 8, 1970, as a part of a Key lt{arket sales promotion program. Mr. Ferris, the applicant, in attendance, explained the operation of the temporary amuEement ceuter, stating that it would remain open only during store hours. The City Planner recomnended that it be stipu!.ated that approval there-for shall not be considered a precedent to construct buildings for other permanent conrmercial usages. Council concurred and a motion was introduced by Councllman Crosbythat the amusement center be permitted to operate on the days desig- nated; that the applicant furnish the city with insurance certificatesin the anount of $ 300,/g5OO/910O; and that approval thereof shall not be interpreted as a precedent to construct permanent commercial build- ings on the parking lot. LE BARON HOTEL DEFICIENCIES A memo from the City I'{anager, dated February L2, Lg?O, referred to anoriginal list of deficiencies noted in the construction of the I€ Baron Hote1 and to a revised list wherein deficiencies still exist. It nas the recommendation of the City l.{anager that Le Baron be cited for failure to complete within a tirne specified. The City Engineer advised that as of the current date, Item *6 (Vent Openings in front of building entrances) and ltem *15 (sprinkler head to existing sprinkler pi.pe) may be deleted from the list of deficiencies. Following discussion, the City Attorney lras requeated to initiate .rn appropriate action against Le Baron and to submit a report to Councitat the next meeting. 2 AI{ZA AIRPORT PARK I'NIT NO. 6 A revised Eina1 Subdivision tlap of Anza Airport Park, Unit No. 6, filed in the Office of the City Engineer, February 11, 1970, was presented to Council for review. Ihe amendments \.rere noted and the City Engineer, replying to an inquiry from the Chair, expressed his approval thereof and advised that the major change vras the deletion of four large unfilled blod<s from the subdivision. NEW BUSINESS Questioned by the Chair, !tr. Ferris conaented to increasing the prop- erty damage insurance coverage to $1O0,OO0.OO and that certificates of insurance be approved by the City Attorney, FINAL SI'BDWISION }TAP APPROVED 229 Mr. Keyston, ansxrering llayor Martin's question concerning the twenty-fivefoot access along the bayfront, referred to the ,,O$mer. s Certificate,, appearing on the Subdivision Map, stipulating that the owner wiIIdedicate to the City of Burlingame "non-exclusive,' use of easements. The City Attorney advised that his Office has not been the recipient oflegal documents and that it wae his understanding that from a prior conference, a "trust agreement" r,rould be prepared for execution whereinthe public generally would have the use of the threnty-five foot stripfor access to the bay. Further discussion concluded with the City Attorney, replying to the Chair, advising that an oral resolution accepting a grant of a non- exclusive easement with access thereto may be introduced and a motion approving the map may be adopted. RESOLUTION NO. 15-70 "A Resolution Acce pting Deed of Easement - Anzapacific Corp." (non-exclusive easement access) was introduced for passage on motion of Councilman Amstrup, seconded by Councilman Johnson and unanimously adopted upon RoIl CaIl. Councilman Crosby moved that the Final Subdivision lilap, Anza Airport Park, Unit No. 6 be approved, subject to the submission of a "grant of easement" approved by the City Attorney. lihe motion rras seconded by Couneilman Johnson and unanimously adopted. 3. HILLSIDE DRIVE SPEED LIUIT Councilman tunstrup questioned the status of the traffic survey referred to the Health, Safety & Traffic Conrmission, particularly with respect to the speed limit on l{illside Drive. It'he City Clerk advised that the Commission, having conducted a hearing on the issue at its regular meeting, February 11 . will present its recotlmendation to Council for placement on the uarch 2, Council agenda. (Action on tlre issue taken by Council later in the evening is herewith recorded for purposes of continuity. ) Councilman Crosby initiated further discussion on the subject of the speed limit on Hillside Drive and referred to the considerable objecti.ons received from residents and property o\^rners protesting an increase of from 25 UPH to 35 Ii{PH. Councilman crosby suggested that either the Police Department withdraw that portion of its recomrendation within the traffic survey or that council defer an action for a period of at least six months. Councilman Amstrup expresaed a preference that aqr action be tabled indefinitely. uayor Irlartin voiced his approval of the recommended increase in the speed limit, stating that he r.rould entertain a motion, hot ever, to resoLve the issue at the pleasure of Council . Further discussion concluded with Councilman Crosby introducing a motion that the subject of increasing the speed linit on Hillside Drive, as recomnended in a survey presented by the Police Traffic Department, be withheld from the agenda of council and tabled indefinitely. The motion r,ras seconded by CounciLman Amstrup and recorded as carried, with Mayor Martin casting a negative vote. 4. HOWARD AVENI'E PLAYGROI'TiID P ARK In reply to council, the City Manager reported that an offer has been submitted to the owne r of one of the lots adjacent to the city's Park and playground area on Howard Avenue and the acquisition of the second lot is under negotiation. 2P6 5. NEW CIjrY HALL PROGRESS REPORT councilman Johnson, Council city Hall liaison, advised that the City's SeaI Mosaic has been installed in the entraceway of the new city HaIl and that consideration is now being given to acquiring pictures and clocks for the various offices. Uayor Uartin guestioned the City llanager whether a date to move into the new city HalI has been scheduled. The City llanager, replying in the negative, stated that partitions in the women's lavatory area and railings on stairways to be installed and unsightly carpet seams to be corrected, are items that are fore- stalling the move. tlayor Martin suggested that the project may be accepted subject to "conditions" and at his request, council authorized the Chair to communicate with the contractorrs headquarters in Santa Ana. Councilman crcsby coNnented briefly on his forthcoming meeting vrith Chadber of Commerce representatives on Ihursday, February 19, at 4:0O p.m., to for:roul ate appropriate dedicatory ceremonies and invited the City l{anager to be present. REFERENCE TO " GARAGE SAIES " As a point of information, the City Attorney advised that in response to a recent inguiry appearing in a League of California Cities news- letter, his Office fonvarded a copy of the City's newly adopted ordinance regulating "garage saIes" and a return reply advised that Burlingame is the first city in California to have adopted a measure controlling said sales.
