I[oroney, Inc., in spite of the 1ow bid being approximately 138 over estimate. The Director of Public Works recommended further that Alternate "A", a lump sum deduction of $11729.00 be refused so that the emergency exit door will remain in the contract. In an addendum to the communication dated August L , 197 4, the City l{anager stated "Under present condj-tions, it is recommended that the low bid be acceptecl so the Easton Library work can be completed." The City Council concurred in the recommenda- tions, including refusal of the lump sum deduction. COMMUNICATIONS 1. IIEARING SCHEDULED CRAIGHEAD DEVELOPMENT COMPANY PROJECT Under date of July 22, L97 4 r dr application was filed by Maury Kolos for Craighead Development Compdny, 1I9 Park Boulevard, Millbrae, for special permit to exceed 308 lot coverage in connection with a pro- posed office and warehouse building on Rollins Road. A public hearing was scheduled for the regufar meeting of the City Council on Tuesday, September 3, 1974, delayed one day because of Labor Day holiday. 2. FINAL PARCEL MAP L469 EL CAMINO REAL (continued) A communication from the Director of Public Works, July 31, L974, reported that the map, a subdivision of Lots 3,4 and portion of Lot 2, Block 50, I'{ap of Easton Addition to Burlingame No. 4, was unanirirously approved by the Planning Commission at its meeting on July 22, L974, 227 and recorflmencled to the City Council subject to Council's acceptance of a public improvements agreement for construction of sidewalks, driveway, curb and gutter across EI Camino ReaI frontage of the property, In an acldendum to the communication, August 1, L974, the City Manager informed the Council that the item was listed for consideration subject to the agreement and presentation of the final parcel map for inspection. The Director of Public lrlorks, upon recognition by Mayor Pro Tempore Amstrup, stated he received the agreement shortly before 5:00 P.M. todayr-and that the map was not available unless the applicant had it with him. The Director of Public Works recommended a continuance of two weeks to the next regular meeting for the reason that there had not been adequate time for proper review of map and agreement. i'{r. Robert E. Church represented the proponents. He asked that the map not be delayed, pointing out that the application has been before the city since becem6er , 1973, and further delay could be significant to the project. He stated that the agreement is not complex ancl that he intended to arrange for a certificate of deposit, the city to be a co-owner, in an amount to cover costs of the public improvements. The City Council felt that the request of the Director of Public Works for a continuance was reasonable. Councilman Mangini's motion to continue to Lhe meeting on August 19, 1974, was seconded by Council- rnan Cusick and unanimously carried. 3. RECOMMENDED A}4ENDMENTS TO TITLE 25 ZONING A cornmunication dated July 23, L974, from the City Planner transmitting code amet:dments covered by Environmental Impact Report EIR-29P, recoflrmended by the Planning Commission, was acknowledged and referred to the City Council study meeting on August 27, L974, as was the ordinance prepared by the City Attorney providing for such amendments. 4 MILLS ESTATE },IEDICAL CENTBR Hugir A. Banks of WEBcoR Builders, Inc., ]-B2B E1 Camino Real, Burlingame, atfvised in a let,ter dated August I, L97 4, that an error in laying out Lhe parking structure for the above development resulted in 4-5/8" encroachment on city property for 27'4" along California Drive between Trousciale and l,lurchison Drives. The City Council's permission to maintain this encroachrnent was requested. Sketches clarifying the area of encroachment were filed. In response to Councilman Cusick, the Director of Public Works reported that city sidewalk at this frontage is 10 feet in width, and that he had no objection to 2-l/2 feet to 5 feet of minor landscaping in front of the wa1l, provided access to public ut,ilities in that area is not disturbed. Thomas W. Sine, member of the Planning Commission, and experienced in the construction field, informed the Council that if a surveyor was retained to lay out the 1ot, the developer or contractor obviously raad.e a rnistake in the layout. LIBRARY BOARD APPOTNTMBNTS Acknowledgment was made of communications frorn the City Clerk and City Manager, dated July 23 and July 31, L974, respectively, concerning expiration of terms of Library Board Trustees Mrs. Edit,h Cohendet and Mrs. Genevieve M. Phelan, both receptive to reappointment. The Cit.y Manager was requested to place this matter on the agenda of the August 27 study meeting. 6. DUMP USE A cornmunication dated August 1, L974, from the City Manager concerned an inquiry from the City of Millbrae on the possibility of its residents using the Burlingame dump for disposal of inorganic refuse only during the scavenger strike. The City Council approved the City l{anagerrs recommendation that Millbrae be asked to use the transfer staLion at Oyster Point because there may be a tendency, under the circumstances, to include garbage with other refuse. 7. 29 VICTORIA ROAD A communication from the City Manager, July 3I, L974, reported that all of the procedures required under the Dangerous Building Code have been followed with respect to this property, and it is proposed to expend $600.00 to fu1fi11 the Building Officialrs order for certain repairs to secure the building, a lien to be placed on the property for said amount. A rnotion by Councilman Cusick, second by Councilman Mangini and unani- mously carried authorized the City Manager to proceed. B. AhINUAL SIDEWALK SALE Under date of August 1, 197 4, the City Manager advised that Douglas Beet.lestone of Levy Bros. , has requested permission for the annual merchants sidewalk sale on Saturday, August 24, L974. There were no objections from the City Council. RESOLUTIONS 1. The draft of the animal control ordinance may fs available for study after the Council of Mayors August rneeting. i{ayor Pro Tempore Amstrup reported he was present at the Council of i'layors meeting in JuIy when the above items were presented. The animal control ordinance was not voted on because the council felt it was a bad recommendationr rlo one had had the opportunity of review, nor had tire mayors received voting instructions from their councils. Ats 2O1O REGIONAL GOVERNMENTAL AGENCY I,layor Pro Tempore Amstrup reported that he voted against tl-re biI1,in accordance with the declared position of this City Council, when it was presented to the Council of [.{ayors. The newspaper account inclicatedotherwise. He sugqested that a total vote of 11, 9 for and 2 against, sirould not be publicized as the majority position of the mayors' council. LOT COV}]RAGE RBGULATIONS i4ayor Pro Tempore Amstrup related an incident in connection with a cover built over a swimming pool, which, apparently, caused some concern atstaff level relative to ambiguity in "Lot Coverages and Yards" section 230 of the zoning code, which the MILLS ESTATE MEDICAL CENTER, Planning Commission intends to pursue. 1828 EL CAMINO REAL The City Planner reported there have been two changes during the course of construction from the plans that were viewed by the Council on February 20, L973, when the Environmental Impact Report on the project was acceptecl.
