HomeMy WebLinkAboutReso - CC - 110-2021RESOLUTION NO. 110-2021 RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A MEMORANDUM OF UNDERSTANDING (MOU) BETWEEN THE CITY OF BURLINGAME AND THE CALIFORNIA STATE LANDS COMMISSION REGARDING ENVIRONMENTAL REVIEW OF THE 410 AIRPORT BOULEVARD PROJECT WHEREAS, on October 24, 2019, the California State Lands Commission (SLC) authorized a short-term three-year lease to the SPHERE Institute for a shoreside park at 410 Airport Boulevard in Burlingame; and WHEREAS, 410 Airport Boulevard is within the jurisdiction of the City of Burlingame but is situated on state-owned lands managed by SLC; and WHEREAS, the SPHERE Institute has submitted applications to the City of Burlingame and SLC to develop the property into the proposed park; and WHEREAS, before the City and SLC may grant approvals for the project, the project must be analyzed pursuant to the California Environmental Quality Act (CEQA); and WHEREAS, under CEQA (Public Resources Code § 21067 and CEQA Guidelines § 15050), the "Lead Agency" has the principal responsibility for carrying out or approving a project; and WHEREAS, pursuant to CEQA Guidelines § 15381, "Responsible Agencies" are agencies, other than the lead agency, that have some discretionary authority for carrying out or approving a project; and WHEREAS, pursuant to CEQA Guidelines section 15051(d), when two or more public agencies have a "substantial claim" to serve as lead agency for a project, the agencies may designate one agency as lead agency by agreement; WHEREAS, through discussions between City and SLC staff, there has been agreement that the City of Burlingame will serve as Lead Agency, and SLC will serve as Responsible Agency; and WHEREAS, the MOU describes the roles and responsibilities of the City and SLC leading up to adoption or certification of a final CEQA document. NOW, THEREFORE, BE IT RESOLVED AND ORDERED: 1 RESOLUTION NO. 110-2021 1. The City Manager is authorized to execute a Memorandum of Understanding (MOU), in substantially the form attached hereto, between the City of Burlingame and the California State Lands Commission regarding environmental review of the 410 Airport Boulevard Project. 2. The City Clerk is directed to attest to the signature of the City Manager upon execution of the Memorandum of Understanding.
