PERMTT, 792 WTLLBOROUGH PLACE
City Planner reviewed his memo of 9/77/79 which detailed this applicationfor a special permit to have a rumpus room or hobby room in detached,unused garage, now landlocked by a new parcel map, and excessively largestorage. Garage will be remodeled for this purpose, including plumbingbut with no cooking facilities. Planning Commission had reie6tla on thebasis that this would allow future owner to convert into a mother-in-Iawapartment. City Planner reported concerns of neighborhood disturbancewere minor, and noted possibilities of future rental could be averted byrecorded resolution prohibiting such use. He recommended three con-ditions if permit should be approved: 1. that the proposed improvementsbe similar to those shown on the plans for an "activity room" fitea withthis appl-ication and date stamped August 6, 1979t 2. that the use ofthis accessory building be consistent with the August 5, LgTg letterfrom John M. ttrard; and 3. that a resolution which identifies thelimited permitted uses of this building be prepared for adoption by theCity and recording by the County Recorder
Mayor Amstrup opened public hearing.
John inlard told eouncil the resolution would prevent future rentals;there would be self-poricing in these smarr neighborhood lots; actionof Planning Commission was arbitrary in denying use of a structure unusablefor-garage, and such actions encourage bootleg apartments rather than honestapplications.
Richard McFarland, 1117 Palm Drive, approved of the permit, and stated hisconcern with the attitude of denying property owners 1ega1 requests becauseof some future possibility.

Councilman Barton suggested Planning Commission could be at timesoverzealous. She considered safeguards adequate in this instance,
and that property owner should be aided in improving his property.
Councilman Martin stated he could not accept forbidding a propertyowner the 1ega1 use of his property on the offchance he might putin an ilIegal unit. He moved the denial of the planning Commilsionbe overruLed and the special permit be granted subject to the threeconditions specified by the City planner. Mayor Amstrup noted the receipt of report from the planning conunissionon possible height limitations on the Bayfront. council discussed and-agreed to have a special meeting on September 26, 1979 at 7:30 p.M.for consi.deration of this one item.

This organization's letter of August 29, 1979 requested a meetingwith Council to review shortage of parking in the Burlingame Avenuebusiness district. With concurrence of Council, Mayor Amstrup
announced this review would be held at Lhe 10/3/79 study meeting.
PURCHASE OF AERIAL LIFT TRUCK PARK DEPARTMENT
Memo of September 12, 1979 from park Director reported bid opening
and bids on this equipment as follows: Pac power, Dixon, California-
$45,183.96, Aspl-undh Equipment Sales & Service, E1 Monte, California-$48,654.00. He noted fiscal year approved budget contains $46,000avai.Iable for this purchase. He recommended accaptance of low bidfrom Pac Power.
Council concurred that Park Director be given authorization to pur-
chase this equipment from the low bidder.

summary on this project and recommended rejection of low bidder,Arthur H. Smith, because he did not submit a bid bond; and recom-
mended that an award be made to the second or third low bidder aftera determination of second 1ow bidderrs, w. R.. Thomason, compliancewith Minority Business Enterprise requirements.
There was no objection from Council to this request except Councilcaution of surveillance on contractors who list no subcontractorsor suppliers.
3. CITY MANAGER: PURCHASE OF PERSHING SCHOOL LOTS FOR PLAYGROUND
PURPOSE
Letter of 9/7/79 from Burlingame School District j-nformed the Citythat "A.t the regular Board Meeting September 6, 1979, the Board
approved acceptance of the City Council's offer to purchase two lotson the Pershing School site for recreational purposes." By endorse-
ment of 9/L3/79 City Manager reconrmended purchase be made.
City Manager then told Council that in addition there will be a$5r000 7r000 expenditure necessary for fencing, equipment, land-scaping, and paving patch as detailed in inspection report of 9/17/79from Park Director.
Council discussed the self-defeating aspects of one taxing bodybuying property from another taxing body, and questioned whether ornot the School Board would be receptive to a lease arrangement.
Councilwoman Barton reported, hortrever, that both of these area-s had
been explored with the Schoo1 Board and had been firmly refused.
she was willing to pay the $140,000. city Attorney requested con-firmation of exact conditions of sale: that the two lots will bepurchased for $f40,000 and used by the City solely for recreationalpurposes; should such use cease, the School District would have theoption to repurchase for $140,000. He questj-oned an option in theCity's offer letter which would give the School District the op-portunity of repurchasing at any time they should need the propertyfor school purposes.
Council discussed this last opti-on. Councilman Martin strongly
opposed giving the School Board this leeway, and stated it should bethe sole option of the City to se1I at any time the City did not
need the oroperty. Balance of Counci-1 members did not disagree.
Council briefllz discussed repairs necessary to the two lots, butdecided to defer action until after purchase of tots. CouncilmanMangini commented he felt the taxpayers had to pay twice for the
same property but moved that the City go ahead with this purchasefor the rea.son there is no open space for ptayground in the area.
Councilwoman Barton seconded the motion and i-t carried on unanimousro11 call vote of members present.
City Attorney stated he would draft the deed and get in touch withthe School Board and the District Attorney's office.
4. CITY MANAGER: RED CURB PAINTING PERMITS.
Memo of 9/ll/79 from Director of Public Works reconrmended thaL re-quests for red curb painting be reviewed by the Traffic Engineer
and the Police Department as at present, but the tenant or ownerwould take out a permit from the Engineering Department at a fee of$i0, would paint the curb, and the City would inspect. Council-discussed briefly but referred to Traffic, Safety and Parking Com-mission for recommendation.

pose of the ordinance and the rate increases involved. He then
opened the public hearing. There were no cornrnents from the
floor and the public hearing was declared closed.

Mayor Amstrup suggested that San Mateo Union High School
be approached on soccer teams' use of the football field

Councilman Mangini stated he had no objection, but as a representative
of Burlingame High School noted t-here are more than twenty football
games a year; it is a public facility; and soccer groups had offered
to maintain another public facility recently if they were given its
use .
Council concurred in a decision to have Recreation Director an-
vestigate this use.

Mayor Amstrup stated he had received 15 fetters from residents in
this neighborhood objecting to this use, and. suggested effective
investigation. City Attorney reported. that many of these com-
plaints have now been eliminated and he would have a report from
the Police Department and the Traff.ic, Safety and Parking Commissj-on
by the next Council meeting.
In connection with traffic problems, Councilman Martin suggested that

Mayor Amstrup stated he would get in iouchwith the phone company, and Councilman Martin suggested contactwith the P. U. C.
CITY SELECTION COMMITTEE
Mayor Amstrup announced he woul_d attend the September 28, 1979meeting of this coNnittee at which two appointments would bemade: appointment to CETA Advisory Council and appointment toCriminal Justice Council. He asked that Council advise him oftheir candidate preferences.
