HEARING 1. APPEAL OF AZKANAZ E. MACKITARIAN FROM PLANNING COMMISSION DENIAL OF FENCE HEIGHT EXCEPTION AT lO49 EL CAMINO REAL City Planner reviewed his report of February 4, 1980 whichdetailed application for variance for 6' fence in front setbackconstructed without building permit, and Planning Commissionaction in denying. Their findings were that it did not meet thelegal requirements for a variance and further, that 6' fence atthis location is inconsistent with City policy of public open space on residential streets and there is no measurabJe reducLion in traffic noise between 5' fence and 6' fence. Mayor Amstrup opened hearing to the f1oor. Mr. Lage Andersen, 2L6 Park Road, attorney representing Itlr.Mackitarian, addressed Council-. His arguments for variance were that Mr. Mackitarian has been improving property for tenyears and thought he had a building permit for such worki Mr. Mackitarian did not know of 5' limitation; his client doesbelieve the I'di-fference in height does cut down traffic noise;Mr. Mackitarian wishes to keep his dog at this address and dog can leap 5' fence; height of fence does not cons:titute asafety hazard as to sight distance on EI Camino Real; andcutting the fence down 1' would destroy its attractiveness. Hereported two owners of neighboring property had asked him to expresstheir approval of the 6' fence. There were no further comments and declared closed. BELL ELECTRICAL SIGNS, fNC., AGENT FOR DAVID JAMES ARATA, REQUESTING APPEAL HEARING BEFORE CITY COUNCIL ON PLANNING COI4IVIISSION DENIAL OF SIGN EXCEPTION AT 1016 CAROLAN AVENUE Mayor Amstrup set this hearing for the regular meeting of February L9, 1980. FROM STAFF 1. CITY MANAGER AND DIRECTOR OF PUBLIC WORKS: APPLICATION OF ALLEN AND MARGARET ROE, 1751 ESCALANTE WAY, FOR ENCROACHMENT PERI4IT Director of Pub1ic Works again reviewed this request for encroachment permit for a fence, to which staff had no objection. However, neighbors had a concern that Mr. Roe was intending to park a boat in his front yard because plans showing fence had also shown "concrete or brick pad" there. He noted Mr. and Mrs. Roe were present at meeting and he displayed pictures of the property, noting the pad is not subject to the encroachment permit. Council- discussed utilities in the area of the encroachment and asked Mr. Roe how he intended to use the pad. He replied it would be used as access to the backyard so he could put the boat back there behind the fence and out of sight. City Attorney stated it was legal to park a boat in the backyard. In response to Council questions Director of Public Works pointed out that driving across a sidewalk is prohibited by the code in any location because sidewalks are not as heavy as driveways and could crack. At this point, Mr. Roe stated he would change his plans: not put the pad in but use a 3/4" plywood platform over curb and lawn to get boat to back yard. Sanford Tandowski, L745 Escalante, addressed Council, stating concern of nelghborhood was where boat would be parked. He said there would be no problem if parking would be in back. He also discussed utilities, especially the removal of fire alarm boxes, and was concerned with flooding if blocks or ramp were left in gutter. Mr. Roe told Council- he would use only the plywood platform in moving his boat and would be responsible for damage or breakageof concrete. He noted he did not yet have a boatr so fire alarm boxes, to be phased out in the future, would not have to be moved now. Councilman Mangini moved encroachment permit be granted subjectto the following conditions: I.Boat will be parked in backyard. 2. Owner will use temporary platform to get boat to back yard. 3. Boat will be parked behind fence. Second by Councilwoman Barton, carried on unanimous vote. 3 2. SELECT MEMBERS FOR UTILITY UNDERGROUND COMMITTEE As agreed at Council meeting of January 2L, 1980, for this committee, Dewey Be11 and Annette Giomi, by draw by Councilmembers Crosby and Barton. two members were selected REI{T MEDIATION Couircilwoman Barton, stating she had a number of complaints from renters who had increases of $50 $f00 a month, suggested a definite action on the Rental Grievance Board. She stated she had received volunteers to work on the board, and suggested it should represent all- sides of the issue renters, home owners, landl-ords. liayor Amstrup stated he had intended to consider the subject at the next study meeting. City Attorney suggested that he first be allowed to formulate a resolution establishing the pararneters of the boaro so there would be no misunderstanding. Council agreed.
