CP Yost reviewed his staff report dated 2/5/80. proposed
operation: approximately 16 emplolzees with service hours from7:30 A.M. to 5:30 P.M. Monday through Friday; 1_easing and carrental to operate 9:00 A.M. 9:00 P.M. seven days per week witha further five emproyees; customer dropoff and vehicle pickup
would be at the California Drive location; on-site parking, 22-24spaces; an additional 13 spaces reserved within the buildings;
30+ spaces available at Do11ar Rent-A-Car storage 1ot adjacent tothis property. Staff believed the proposed use could be authorizedsubject to review in one year and recornmended eight conditions ofapproval. tir. Yost noted Commission concern had been that the pro-posal would represent a major change in the policy relating to usein this area, and the apprication had been denied on a 5-1 vote.
Mayor Amstrup opened the hearing to the fIoor, asking first for
comments from the appellant. Cyrus J. McMillan, attorney repre-senting the appellant introduced Gilbert Alcala of Alca1a Chevrolet,Paul J. Gumbinger, architect for the project and Rick Hughes,acoustical engineer. Attorney McMillanrs comments: there rvouldbe no customers com.ing to the site; the application was notprimarily a car rental application; vehicles to be serviced wouldbe oropped off and picked up at California Drive; the parking plan
was consistent with the zoning in the area; the leasing businesswould be long term with one employee at the site; that another use,such as a freight company, would generate more traffic; and that theacoustical engineer had reported noise inside the building would notbe heard unless a door were oper:ed. He advised that his clientwould accept the eight conditions suggested by the CP, that all con-struction woul-d be in accordance with the building inspector's re-quj-rements and that the building would be fu1ly sprinklered. Hughes confirmed to Council that insulation would not be necessaryfor controlling noise outside and that the smaIl amount of noise thatmight escape would be masked by the noise of the surounding area.
Mayor Amstrup then asked for comments in opposition. William Cason,
141 Newton Drive, Burlingame, owner of the property at 1849 Bayshore
Highway stated he was opposed to the body shop, and particularly acar rental agency in that location. His concerns: traffic aenerated,parking problems, the past practice of vehicles driving over hisproperty, and the possibility of more businesses of this type in thearea. Cowan Road urged the Council to uphold the Planning Cornnission denj-al.His comments: this area is a model of good planniig on the Peninsula;airport related uses and high quality development should be encouraged;land economics would not support this type of use; complaints had

been received from his own tenants about the proposal; and a con-
cern about traffic and noise generated. He stated that it is only
when Airport Runway 01 is used that the noise is excessive at present.
(Councilman Martin pointed out that Runway 01 has 70% of the de-partures from the airport.) Eric de Reynier, owner of 819-845 Cowan
Road objected to the proposed use in this office area.
In rebuttal, Mr. McMillan reiterated that car rental was a minor part
of this application, that it was essentially to rent cars to Alcala
customers whose cars were being repaired; and confirmed to Councilthe rental business would not expand. He also noted that the areais zoned M-1, light industrial; that the two buildings on the sitewould, in any case, be used for some purpose which would create acertain amount of traffic; that Mr. Alcala would use the best and
most modern equipment; and that the applicant has a five year lease,
with right to extend for five years and first right of refusal.
Council discussion during the hearing determined that the L2 parking
spaces along the entrance driveway were technically off-site and not
a part of the 30+ spaces to be leased from Do1lar Rent-A-Car. It
was felt a body and paint shop could be kept neat in appearance andquiet; that review in one year would give the City protection; and
two further conditions were suggested: (1) that a barricade be
erected between this property and 1849 Bayshore Highway and (2) that
a landscaping requirement be included. Mr. McMillan informed the
Council that the applicant would agree to the additional conditions.
There were no further comments and the public hearing was declaredclosed. Mayor Amstrup welcomed members of the Planning Commissionin the audience. There was Council consensus the proposed use was a
compatible one for the site and would not represent an adverse change
to the area.
Councj-lwoman Barton moved to sustain the appeal by Gilbert Alca1a
and approve the special permit to operate an auto service center with
body shop and related auto rental and leasing at 824-826 Cowan Roadvrith the followj-ng conditions: (1) that the permit be approved to
A1ca1a Chevrolet, and be nontransferablei (2) that the auto service
center andauto leasing/rental office be operated in a manner consistentwith the January 18, 1980 letter from Mr. Alcala filed with the ap-plication; (3) that on-si-te employment be limited to 20 employees;(4) that Alcala Chevrolet encourage its Cowan Road employees to park
on-site, rather than on-street; (5) that on-site parking (including
13 spaces within the existing buildings) be consistent with the siteplan (revised L/LB/801 filed with this application; (6) that 4 on-site parking spaces be marked for guest parking (one of which should
be to handicapped dj-mensj-ons); (7) that all alteraLions to thisproperty be done with a building permit, and be conistent with the
requirements identified in the January L7, 1980 memo from the Chief
Fj-re Inspector and the January 14, 1980 memo from the Chief BuildingInspector; (8) that the special permit be subject to revj-ew and
possible amendment in one year; (9) that a barricade be erected
between this property and the property at L849 Bayshore Highway; and(10) that a landscaping and irrigation plan be submitted for the
City's review and approval. Second Councilman Crosby; motion approved
on a 5-0 ro11 call vote.
