David l{artin convened a Studv }4eeting of the Burlingame Citv Council in Conference Room B of the Burlingame City HalI at 8:10 p.m. on t^trednesday, November L2 , 19 80 , following an executive session of the Council on labor neqotiations. Page, CATV consultant, reviewed for Council his November3, 1980, analysis of six CATV proposals and responses which con-tained his revised rankings. Any of the six pror:osals would, inhis opinion, result in a good system. The chosen proposal may notinclude all the elements desired by the City, but an effort rvi1l be made to negotiate into the franchise agreement the best terms ofall submissions. He emphasized that a statement of caoacity in aproposal does not indicate an intention to ooerate at that capacity immediately, but rather a potential to which it can be expanded. His recommended orocedure is for Council to begin rvith considerationof the oroposal ranked highest, if there is an overwhelming reasonfor rejectj-on, the next ranking oroposal should be considered on down to the proposal that most closely meets Council's decision ofthe scor:e of franchise that will best serve the City. A11 of the cornoanies have good ratings as CATV operators. It is his inentionthat the franchise document will contai-n oenaltv clauses so thatit will be difficult for an operator not to oerform rveIl. Council guestioned the effect of the rumored merger of Telepromoter, which submitted the highest ranked oroposal, with hTestinghouse. Thetiming of the possible merger is a crucial consideration; i.e., whether a merger miqht be underway during the period of installationor implemented after the system's installation is completed. There was discussion of whether, after a merger, h7estinghouse ivould divestitself of its cable systems or its television stations. Councildirected staff to get all inforrnation available relating to the pro- posed merger. In the d.iscussion of benefits availabl-e to the City from the franchiser, Mr. Page pointed out that there is no formula for setting rates tocustomers. Council and staff expressed the importance of as many services to the community as are Dossible, esoeciallv a requirement of a minimum of 36 to 40 channels, some of which will be available for use by emergency services, the City, the Board of Education and other communitv groups. In response to Council concern , !4r. Page suggesteda condition in the franchi-se agreement requiring!' aoproval of an:/ ex- tension of the service to Hillsboroucrh or unincorr:orated Countv areas. The next step in the process of awarding a franchise is a public hearing, tentatively set for Wednesdaly, Decernber 10, 1980, con-tingent upon Councilmembersr schedules. hlhen the date is confirmed the City Manager was directed to notice the meetj.nq and arrange forpublicitly. At the public hearing no apoaratus demonstratior. will be permitted, the time of franchise applicants will be limited to 10 minutes each, and participation by members of the public will be limited to five minutes. 2. PARKING FINE COLLECTION BY CITY Finance Director Argyres reported the request of the Clerk Municipal Court that cities initiate orocessing of oarking of the cit-ations, 135 retain 1003 of collections and forward to the Court only delinquentcitations. The City would receive 1002 of d.elinquent citation finescollected, and the Court would retain the entire amount of delinquentpenalties. Presently the City receives 3B? of collections afterprocessing by the Court. An Advantage of the chanclei 1;rocedure wouldbe a speedy receipt of citation bail which is presentl), delalzed be- cause of the backlog in court processing. Mr. Argyres said he believesroutine collections can be handled preliminarilv by the T4ater Depart- ment personnel. It is Chief Palmer's opinion that the City willbenefit from this change in processing parking citations. Council was generally in agreement with the Court's proposaldirected Mr. Argyres to respond that final decision would beafter considering the report of the committee of the Council Mayors which is investigating the matter. but madeof 3 RECREATTON DEPARTI4ENT DISCOT]NT EOR SENIOR CITIZENS Brock Riddle of the Recreation Department reported on attendance bysenior citizens at Recreation Department activities following in-itiation of the 252 discount. It i-s Recreation Director Ray Wagner's recommendation that a 502 discount be granted to Burlingame seniorcitizens in the future. The recommendation will reguire that $1r500be added to the 801-210K senior citizen account as detailed in Mr. Wagner's memorandum of October l, 1980. Council approved the recom- mended senior citizen discount. 4 CHANGING DATE FOR VETERANS DAY HOLIDAY Council and staff discussed the problems arising from City Ha11 being closed on the fourth Monday of October in celebration of Veterans Day. It was recommended that employee groups be requestedto agree to the resumption of the holiday on November llth in con- formance with general oractice. Mr. Argyres said at Council request he had investigated the cost of an answerinq service or instrument to answer telephone calls when the City Ha1I is closed. He reported that the Telephone Company will answer three lines at a charge of $850 a year. An instrument pur- chased from the retail market will answer only one incoming 1ine, which would seem inadequate at a time like a holiday. Council directed Mr. Argyres to look into other sources for pro- viding the service or necessary instrument. PERSONNEL SERVICES PENDING CHANGES IN ORGANTZATIONAL SET-UP Mr. Schwalm requested authorization to hire interim help to assistin the work performed by Ruth Dunmire oending determination of theorganizational set-up for personnel services. Proposals for thepersonnel services survey will be received by November 21st. Council authorized hiring of interim he1p. 6. OTHER Council was reminded of the meeting with the Library Board scheduled for Saturday, November 15th. B. Police Station: Mr. Schwalm recommended reactivation of the ffiommitteeforrecommendationSondesign,hiring of an engineer, or determining the next step looking to con- struction of a police station. There was no Council object to reactivation of the committee. C. Anza Area: Councilman Amstrup directed attention to two largedirt troughs visible from Bayshore Hiqhway close to the Eucalyptus Grove in the Anza Area. Mr. Kirkup was directed to investigate the cause of the dirt and particularly whether the State Highway Depart- ment was responsible. 5 A r36 D. Er Annexation: I{r. Schwalm reported an inquiry from LAFCo con- cernlng 'me advisability of the City annexing a cluster of homes in the unincorporated County area which is surrounded on three si<les by the City; LAFCo receives many inquiries and considers it would be more convenient if Lhe entire area were annexed simultaneously. Staff was asked to check whether the water service is adequate, the Fire Department's reaction to undertaking service of the area, and the effect upon the sanitarv sewer system. City Manager Schwalm reported that ltllr. Kirkuo and Mr. Coleman have arranged for the Petrini Market and Longs Drug Store problem to be handled on an encroachment permit basis which will give better control of the situation objected to by CTA. Councilwoman Barton called attention to the need to check sidewalk sale racks such as those which have been placed out- side the Black Sheep and LeGear.
