HomeMy WebLinkAboutOrd 1992ORDINANCE NO. 1992 AN ORDINANCE OF THE CITY OF BURLINGAME AMENDING CHAPTERS 13.36.040, 13,36,042, AND 13.36.043 OF THE BURLINGAME MUNICIPAL CODE TO ESTABLISH TWO.HOUR PARKING ALONG HOWARD AVENUE FROM EL CAMINO REAL TO CALIFORNIA DRIVE WHEREAS, in anticipation of the completion of the new parking garage at Lot N, the Traffic, Safety and Parking Commission (TSPC) held discussions regarding utilization of the new parking garage; and WHEREAS, the TSPC ultimately recommended the City Council to dedicate the entire parking garage to long-term parking and long-term EV charging spaces; and WHEREAS, as part of this option, the TSPC recommended converting the long- term parking along Howard Avenue between El Camino Real and California Drive to short- term parking; and WHEREAS, this option is consistent with the City's parking management strategy of providing shortterm parking in the Downtown core, while encouraging long-term and employee parking in outer-lying areas; and WHEREAS, the recommendation was also supported by feedback from an informal survey regarding the parking choices of Downtown employers and employees conducted from December 22, 2020 to January 11 , 2021 in collaboration with the Downtown Business lmprovement District (DBID): and WHEREAS, at the February 16,2021 City Council meeting, Council approved the TSPC's recommendations to establish long-term parking at the new parking garage on Highland Avenue, including the conversion ofthe on-street parking along Howard Avenue from long{erm to shortterm two-hour parking between El Camino Real and California Drive; and WHEREAS, in order to complete the parking restriction conversion, Chapters '13.36.040, 13.36.042, and 13.36.043 of the BMC need to be amended. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BURLINGAME DOES ORDAIN AS FOLLOWS: Section 1. The recitals set forth above are true and correct, and are hereby incorporated herein by this reference as if fully set forth in their entirety. Section 2. The proposed Ordinance is not a project within the meaning of section 1 5378 of the CEQA Guidelines because it has no potential for resulting in physical change in the environment, either directly or ultimately. ln the event that this Ordinance is found to be a project under CEQA, it is subject to the CEQA exemption contained in CEQA Guidelines section I 5061(bX3) because it can be seen with certainty to have no possibility of a significant effect on the environment. Section 4. lf any section, subsection, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portion or sections of the Ordinance. The City Council of the City of Burlingame hereby declares that it would have adopted the Ordinance and each section, subsection, sentence, clause or phrase thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared unconstitutional. Section 6. Section 13.36.042(e) of the Burlingame Municipal Code is deleted, as noted below. (e) "Heward AvenHei frem Primrese Read te Highland nvenue," Section 7. Section 13.36.043(6) of the Burlingame Municipal Code is deleted, as noted below. Section 9. The City Clerk is directed to publish this ordinance in a manner required by law.
