The meeting wascalled to order at 8:00 p.m. by Mayor Gloria H. Barton. PLEDGE OF ALLEGIANCE Led by Margaret Monroe, City Planner. ROLL CA],L COI]NCILMEMBERS PRESENT : COT'NCTLMEMBERS ABSENT : MINUTES AMSTRUP, BARTON, CROSBY, MANGINI , MARTIN NONE Minutes of adopted. the regular meeting of June 21, L982 were approved and Council acknowledged receipt of letters requesting appeal hearings from Gilbert E. Davis for catering at 1450 Rollins Road which Planning Commission denied; and from Robert and Carol Cameron, 1200 Majilla for an overheight garaqe which Planning Commission denied. Mayor Barton set hearj.ng date of July 19 for both. Director of Public works reviewed his memorandum of June 29. Theproject provides for the interim repair of curb lanes and other areas of Bayshore Highway until the entire roadway may be rebuilt inthe next five years. It also provides for the repair of the curb fane of California Drive adjacent to the SP parking area from North Lane to oak Grove and the rebuilding of Carolan Avenue from just east of Parkto Larkspur Avenues, The original bids were rejected by Council on June 6 and new bids were opened on June 29. Six bids were received, 1ow bid by crade Way Construction of Fremont in the amount of $17s,949.16. Councj- 1man Amstrup moved adoptj-on offor resurfacing program to crade Way $175,949.16. The parcel- is now vacant and is adjacent to the Russian Church which is clearly visible across it for northbound traffic on E1 camino Rea1. The proposed projeet fronts on Fairfield; the El, Camino side will be fenced and the Fairfield side will be fenced in stairstep fashion. The project is before the Planning Commission because it requires a condominium permit and side yard setback variance for afive foot side yard. Staff put forward a negative declaration because the project does not exceed code height; the number of units is consistent with zoning; it is consistent \"rith the general plani traffic orientation is towardFairfield; and parking and design codes are met. The project is not expected to have an extraordinary effect on the adjacent church or school. REQUESTS FOR APPEAL HEARINGS RESOLUTION 46-82 AWARDING CONTRACT RESURFACING PROGRAM 198I-82 CITY PROJECT NO. O18 NEGATIVE DECLARATION ON FOUR-UNIT CONDOMTI{IUM REQUIRING A SIDE YARD SETBACK VARIANCE AT 701 FAIRFIELD ROAD 388 Councilman Martin moved to accept the negative declaration. Seconded by Councilman Mangini. Motion carried, Councilman Crosby abstaining for personal reasons. Gene Satrap, representing the Russian Church of A11 Saints, addressed council. The church believes the development will have a negative effect on the community, i.e., traffic, esthetics and incompatibility with the church and school. The church asks that a greater degree of study be done than the negative declaration. Mayor Barton explained that the Planning Commission will all those issues. Should the Planning Commission grant the decision can then be appealed to council. considerthe variance, INTRODUCTION IMPROVEMENTS OF ORDINANCE L22B - AMENDING DEVELOPMENT FEES FOR ROAD Director of Public Works reviewed his memorandum of June 30 in which he recommended introduction of an ordinance raising existing Bayfront Development Fees. He explained that council adopted an ordinance in 1979 which provided that developments contributing to traffic problems along the Bayfront would pay a fee for roadway improvements. Eees were based on peak hour trip generated in accordance with the Drachman Report and were to provide for 40 percent of the then estimated $2 million cost. Since that time, inflation and added improvements have raised the estim- ated cost to $4 miIlion. Additionally, council directed staff to revise the 40 percent developer amount to 60 percent at the June 2, l9B2 study meeting. This ordinance will raise the amount contributed by developers to 60 percent; will provide for annual updating of fees; and for payment of fees at the time of final framing inspection. Councilman Crosby inquired whether city will be able to collect more from developments that have already paid fees. Director of Pub1ic Works replied that this would take a special district and considerable work. Ordinance L228 - Amending Development CONSENT CALENDAR SPECIAL ENCROACHMENT PERMIT SIDEWALK ZLIL POPPY DRIVE FENCE AT BACK OF Public Works memorandum of June 18 recommended council approve a special encroachment permit for a four foot fence at the sidewalk line. Owner completed a portion before he realized he needed a special permit. Staff investigated the site and has no objections. 2. SfDEWALK ENCROACHMENT PERMIT - 1136 BROADWAY PLANTER BOXES public Works memorandum of June 28 recommended approval of a side- walk encroachment permit for planter boxes in front of a business at 1136 Broadway. City has a regular tree trimming program, although it may not be as often as some people would like or the way some people would like the trees trimmed. The city's priority is safety to the trees. Councj-I discussed at length its various feelings about tree trimming. Councilman Amstrup felt that city has an excellent Park Dj-rector and tree trimming should be left up to him. FROM THE FLOOR Angelo De11a Casa requested the city do something about tree roots liiting the sidewalks East of the railroad. He expressed fear of someone being hurt and suing the city and the property owner. Ir{ayor Barton informed Mr. De11a Casa that city will be repairing side- walks this summer. Councilman Martin requested city let property owners who complain about sidewalks know when an inspection has been made and whether repair will be considered.
