Meetj-ng was calledto order at B:02 p.m. by Mayor Victor A. Mangini PLEDGE OF ALLEGIANCE Led by Jerome F. Col-eman, City Attorney. ROLL CALL COUNCIL MEMBERS COUNCIL MEMBERS MINUTES PRESENT: ABSENT: AMSTRUP, BARTON, CROSBY, MANGINI, MARTIN NONE Minutes of the study meeting of February 3, L9B2 and the regular meetJ-ng of February 16, L982 were approved and adopted. HEARING SCHEDULED Council received a request to appeal the Planning Commission decisionof February 22 concerning the property at 1145 Oxford Road from AnnaAlexander and Margaret Lake. Mayor Mangini scheduled hearing for March 15, 1982. HEARING - ENVIRONMENTAL IMPACT REPORT CONDOMINIUM PROJECT AT 1BOO Et CAMINO FOR PROPOSED 44 UNIT RESIDENTIAL REAL I I! r City Planner's memorandum of 2/L8/82 explained that Claymore Investment Co. has proposed a 44 unit residentj-al condominium at 1800 EI CaminoReal. Because a general plan amendment is required before this pro-ject application can be approved, the project applicant has requestedprocessing of the EIR independent of the project. Planning Cornmj-ssion recommends certification of the EIR. Council is required to conducta public hearlng on the final EIR. A resolution certifying the EIR was presented for review and adoption. Mayor Mangini opened the public hearing. There were no comments and Mayor Mangini closed the public hearing. Councilman Martin questioned the need for requesting comments from ALPA, since it is a labor union and not a recognized review agency. He pointed out an error in asking level of CNEL since it is an average measure and aircraft is a noise point source; and questioned thefigures on height of airplanes over the city. He commented that thesequestions should be cleared up, that once these items are in the EIRthey are cast in stone. RESOLUTION 12-82 I'A RESOLUTION CERTIFYING ENVIRONMENTAL IMPACT REPORT AND MAKING FINDINGS WITH RESPECT TO A PROPOSED 44 UN]T APARTMENT BUILDING LOCATED AT 1BOO EL CAMINO REAL'' Councilman Councilman APPEAL - 1272 oAK Martin moved approval of Resolution L2-82, Crosby, carried unanimously on a ro11 call FENCE EXCEPTION TO ALLOW 6'6" FENCE GROVE JESS A PITTORE seconded by vote. IN FRONT SETBACK AT City Planner's memorandum, 2/L9/82, explained that Planning Commission had found no exceptional circumstances, nor hardship, upon Mr. Pittore and denied his application for a fence exception. Mr. Pittore has appealed this decisi-on. City Planner explained that Mr. Pittore had built a 6'6" fence in the front yard setback, from the driveway to the side yard's 3' fence. A petition from nelghbors and a letter from Mr. Coppoli-Ilo were re- ceived in support of the fence. and Fire Marshal had no comments. to 5r. City Engineer, Building InspectorBuilding Code limits fence height Mayor Mangini opened the public hearing. Mr. Pittore explained to Counci] that he had the fence built while a deck was being built in his back yard. The fence was an after- thought and therefore had no permit, but there was a permit for thedeck. The fence was built for the purpose of cutting the sightline from the street into his house, which is all windows facing the street. He has been burglarized several times and has had problems withlittering from passersby. \- There were no further comrnents from the floor. Mayor Mangini closed the public hearing. Councilman Martin deny the variance, on rofl cafl vote. moved to sustain the Planning Commission decision to seconded by Councilman Crosby, carried unanimousfy Mr. Pittore vnas advised that him in regard to changing theBuilding Code. City Attorney woufd be corresponding withheight of his fence to comply with the RESOLUTION 13-82 ''APPROVING CIVIL SERVICE RULE AMENDMENTS '' Councilman Crosby moved adoption of Resolution L3-82, Council-woman Barton, carried unanimously on ro11 call seconded by vote. INTRODUCTION OF ORDINANCE 122L RULES AND REGULATIONS'I IIAN ORDINANCE A14ENDI}IG CIVIL SERVICE City Attorney explained that in the Municipal Code to tie this ordinance wil-1 change the languagein with the new rules and regulations. f STAFF MEMORANDA City Plannerrs memorandum, 2/18/82, recommended council determine whether it is appropriate to make a p.m. peak hour traffic a1- location to only a phase of a projecti then decide on traffic aI- Iocations among the three projects currently requesting allocations: the Lo Hote1, the warehouse Restaurant and the Anza Office Park. City Planner reported that for the three proj ects. there is sufficient traffic capacity now At the previous study meeting, councilpoints in making traffic aflocation to had identified critical phases of a project. a b c The project plan submitted and city approval should be for the entire project even when traffic allocation is for only a phase or portion of the project. Building permits and roadway j-mprovement fees should be coflected for onl-y the phase or portion of the project which has traffic allocation. 341 i l I 1 I I I I { City Manager explained that 18 months ago Hughes-Heiss Associates reviewed cityrs personnef system and Civil Service rufes. One part of that contract was to update and revise the rules and regulationspertaining to selection of new employees. The changes recommended were reviewed by department heads and Civil- Service Commission, and sent toall empfoyee groups for co[unents. The only conunents received were fromthe Fire Fighters' Union. City has responded to those comments. City is now ready to adopt those ru1es. ALLOCATION OF' P.M. PEAK HOUR TRAT'FIC IN THE ANZA AREA - CITY PLANNER Request for traffic allocation for subsequent phases of approved projects will be treated the same as projects which have not had previous traffic allocations made to them. Councilwoman Barton moved approval of traffic al,location by phases with the three condj-tions above, seconded by Councilman Martin, carried unanimously on ro11 call vote. 342 Councilwoman Barton movedto three projects: the Lo and phase one of the Anza Crosby. approval of traffic allocationsHotel, the Warehouse Restaurant, Office Park, seconded by Council-man Council-man Martin observed that all three phases of the Marriott Hotel had been approved and, therefore, the second and third phase al-l-ocations of that project shoufd be deleted. City Pfanner suggested the addition of an amendment motion, deletinq aflocations to phase two and three Marriott Hote1. to theof the Motj-on was so amended and carried unanimously on roll call vote . Mr. David Keyston, Anza Shareholders Trust, addressed council. He thanked council for its action on the three projects. He stated the EIR for Marriott was based on presumptions that all traffic from that hotel wou]d travel through the Broadway interchange. This is not a realistic view, as part of the traffic will travel through the Millbraeinterchange. He said a new study has been done which will give more traffic capacity to the Broadway interchange. The study will be pre- sented to counci- L in the near future. 2. SCHEDULE HEARING - 1510 NEWLANDS City Attorney's memorandwm, 2/22/ 82, stated city had recieved a request for hearing on modification of the 1976 judgment re- garding property at 1510 Newlands Avenue. Mayor Mangini scheduled hearing for the meeting of March 15, L982. REVIEW AND ACTION CITY PLANNER ON ABAG HOUSING ATLOCATION METHODOLOGY3 City Plannerrsresolution for memorandum, 2/23/82, recommended adjustment of ABAG housing needs council adopt determination. City Planner expfained that Government Code now requires housing elements to include a description of the city's appropriate share of regional need for housing. Our housing element addresses Burlingame's share, but not the regional share. The Code requires ABAG to provide regional and 1ocal share numbers; but does not require 1oca1 government to adopt ABAG I s numbers . Staff j-s satisfied that ABAGTs numbers do not penalize the city, but would recommend use of the vacancy rate figure used by the State rather than the figure taken from ABAGTs Projection '79. rt should be recognized that these figures are sIoEE term as the numbers will be reworked when the l-980 census figures become avai1able. RESOLUTION f4- E2 DETERMINAT ION " .'LOCAL GOVERNMENT REVISION OF HOUSING NEEDS Councilman Martin moved adoption of Resolution 74-82, seconded by Council-man Crosby, carrj-ed unanimously on ro11 call vote. CONSENT CALENDAR At Councilman Martin's request, the proposed ordinance "Amending Building Code Providing for Permit Expiration Times and Correcting C-1 Firewall Requirements" was removed from the Consent Calendar. RESOLUTION 15-82 "RESOLUTION ACCEPTING 1980 IMPROVEMENTS ON AIRPORT BLVD. '' WATER SYSTEM1 Department of Publj-c Works' memorandum, 2/24/82, recommended approval of a resolution accepting the satisfactorily compl-eted Water System fmprovements by Manuel C. Jardim, Inc., and transfer of funds to cover final payments. RESOLUTION NO. 16- 82 HIGHWAY 92 AND URGING WITHIN THE COUNTY TO - I'IN SUPPORT OF IMPROVEMENT OF STATE THE COUNTY OF SAN MATEO AND ALL CITIES TAKE A SIMILAR POSITION'' 3 343 ENTERTAINMENT PERMIT RENEWALS: SHERATON CHARLEY BROWNTS; ROUTE 66. INN; THE EGGPLANT; Chief of PoIice memorandum, 2/24/82, reported no incidentsduring the past twelve months at the sheraton rnn, the Eggprantand Charley Brownrs and recommended a one year renewal for each.Route 66 is under new management and has had no reported incidentssince the new management took over, he reconrmended a six monthrenewal. 4 "ORDf NANCE CONTROLLING city Attorney's memorandum, 2/22/82, stated city had receivedcomplaints about construction noise. After reviewing ordinancesof other cities, he recommended introduction of this ordinancecontrollj-ng construction hours. rt is a general ordinance,not just controlling noiser so that haulj-ng and other activitiesare also controlled. Councilman Amstrup moved approval of consent calendar, seconded by Councilman Martin, carried unanimously on ro11 call vote. Councilman Martin expressed concern about the sevelle penalties whichcould be assessed agai-nst a major construction project by the proposedordinance amending the Building Code. The purpose of this ordinance isto force action on projects for which building permits have been ob-tained by forcing the applicant to reapply for a permit if a certainpercentage of work has not been accomplished by a certain time. But some major construction projects have variances which would also haveto be reapplied for, thereby creatj-ng a hardshlp. Council discussed at some length and agreed to take this ordinanceback to the next study session for review. PROCLAMATION ARBOR DAY MARCH 7, 1982 Mayor Mangini proclaimed March '7 , OLD BUSINESS POLfCE STATION 7982 as Arbor Day in Burlingame. Councilman Amstrup reviewed a letter he wrote to council regardinghis reason for casting the dissenting vote against "outward on1y"expansion of the new police station. He expressed his strong feelingthat city should have the option of adding a second story. At thepresent time city only has one option, to keep all the lot and buildoutward. This would eliminate dual use of the building if citygovernment needs to expand, and eliminate possibility of selling partsof lot. Councilman Amstrup moved to reconsider the option of a second storyto the new police station. City Attorney stated that the person whocast the lone dissenting vote cannot move to reconsider that vote. Councilwoman Barton stated she would like to hear this item discussed more thoroughly and moved that councj-1 reconsider adding a secondstory to the police station, seconded by Councilman Amstrup. Mayor Manglni appealed to council not to reconsj-der, stating that thisbuilding is built for expansion outward and/or upward and that all theland is needed for parking. Motion failing on ro11 call vote: AYES: AMSTRUP, BARTON NAYES: CROSBY, MANGINT, MARTIN NEW BUSINESS - VIDEO MACHINES Councilman Amstrup expressed concern about the proliferation ofvideo machines in the city. He felt city needed an ordinancelimiting or controlling the number of machines in an establishment. City Attorney stated that a number of cities have ordinances that re-quire permits over a certain number of machines in an establishment. YOUTH IN GOVERNMENT DAY ABAG BUDGET Councilman Martin requested council members submit comments to him regarding the ABAG budget by the next meeting.
