Meeting was call-ed to order at 8:08 p.m. by Mavor Victor A. Mangini. PLEDGE OF ALLEGIANCE Led by Meg Monroe, City Planner. ROLL CALL COUNCIL MEMBERS PRESENT: AMSTRUP, BARTON, Councilman Martin arrived at aptrroximately MINUTES CROSBY, MANGINI Bz12 p.m. Minutes of the special meeting and the regular meeting of December 21, 1981 were anproved and adopted. AUCTION PERMIT APPLICATTON - ATLAS DIAMOND COMPANY, INC. Mr. Zeveka Sa1les, owner of Atlas Diamond Burlingame Avenue, applied for a permit to auctions of unclaimed items approximately Saturdays or Sundays. Company, Inc., l47L conduct on-sitesix times a year on police Services Bureau memorandum of December 22, 1981 identified Atlas Diamond Company, Inc. aS a properly licensed Second Hand Dealer, operating in Burlingame for several years and enjoying a qood reputation with the Police Department. The Department offered no objections to the requested permit. Councilman Amstrup moved to a1low At1as Diamond Companlz, Inc., two trial-period auctions, seconded by Councilman Crosby, carried unanirnouslv by members Present. CORRESPONDENCE - KINGWAY CORPORATION REGARDING PARKING ON CHAPIN Mayor lr4anqini ref erred to a letter from Kingsway Corporation, Xiirgsway Buildinq, dated December 28, 1981, regarding inequities in parking meter costs on Chapin Avenue. City Manager advised that meter man is in the process of coriecting this problem; Citv Manager will communicate this to Kingsway Corporation. STAF'F MEMORANDA SAN SAN FRANCISCO BAY AREA I{A.TER USERS ASSOCIATIONS I S FRANCISCO WATER DEPARTMENT LITIGATION WITH City Ensineer reviewed Director of Public la7ork's memorandum dated December 23, 1981 regarding the San Francisco Bay Area l,{ater Users Association's suit with San Francisco Water Department. If the suit proceeds, the citv will have considerablv more expense than was budgeted. As of this date, citlz has expended the full amount that wai budgeted and it is anticipated that the arnount could double. In three months budget for this account will be reviewed. BURLIN GAME AVENI.]E COMMERCIAL AREA REGULATIONS City Planner explained that a copy of the "Notice of Hearing Upon eroposed Revisions to Burlingame Avenue Commercial Area Regulations" to be held on January 18, L982 at B:00 o.m. in the city council chambers has been sent to all property owners in that area. City Attorney reported that he had received several from resj-dents concerning the notice. Chamber of Commerce,distributing door-to-door 8OO AIRPORT BOULEVARD, FOUR SEAS/LA BAIE BUILDTNG, OFFICE CONVERSION City Planner reported in her memorandum of December 23, that the developer is submitting a new proposal to the Commission and, therefore, this j-tem will come back tocouncil at a later date. 19 81 Planning the APPOINT}4ENT TO CIVIL SERVICE COMMISSION Mayor Mangini announced Mr. Lage Andersen as candidate for appointment to the Civil Service Commission. Council had noobjections and Mr. Andersen's appointment was confirmed. CONSENT CALENDAR I 2 Chamber of Commercefor January 1, 1982 Promotional Fund, quarterly allocation through March 3I, 1982, $3,750. Cl-aim: Frederica D. Denial recommended. Ay1or, $138, received December 23, 1981. 3 Ordinance Limiting Fireworks Sales to Non-Profit Organizations. ( Introduction) Councilrnan Amstrup moved approval of the consent calendar, secondedby Councilman Crosby, carried unanimously. Attorney communicate to theto removal of locaI control Iegis Ia- of UNFINISHED BUSINESS CONSOLIDATED ELECTIONS Mayor Mangini acknowledged letter from the Secretary of State'soffice concerning SB 230 "Consolidation of Elections. " This bill contaj-ns an urgency clause and the state Constitution prohibits an urgency clause to chanqe terms of office, therefore, theattorney general has been requested to render an opinion. City Attorney reported on Daly City's law suit against the Boardof Supervisors. The judge will have a decision later this week. City Attorney is to appear before the Board ofpresent Burlingamers position on January 5. Supervisors to Council discussed the need for a special meeting to review results of the court decision and the Board of Supervisors'decision. Councilman Martin suggested that council adjourn meeting to next Tuesday, January L2 to continue discussionconsolidation of elections. the this of Councilwoman Barton expressed concern about the status of candidates who want to file for an April election. It was suggested that candidates file during the regular filing period beginning January 14 no matter which way the court or Board decisions go. Councilman Martin moved that, if the court rules in favor of Daly City, the City Attorney be instructed to take Iega1 steps tobring the City of Burlingame in line with that decision, seconded by Councilman Crosby. The motion carried on ro11 call vote, Councilmen Crosby, Mangini and Martin voting aye, Amstrup and Barton voting no. Councilman /\mstrup requested City Attorney to make clear this is not a majority decision of the Council. r!'--ffi 3t7 I 2 NEW BUS INESS Mayor Mangini announced that an adjourned meeting of the City Council will be held on Tuesday, January 12, 1982, al 8:00 p.m. in the City HaII Council Chambers. Councilwoman Barton commented on SB 3l-4 (Di1Is) "eindingArbitration" which constitutes an attempt by public safety unions to authorize an election on compulsory and binding arbitration for settlement of labor disputes.
