Minutes of the regular meeting of October 17, 1983 were approved.
LORTONDENTAL OF AMUSEMENT PERMIT -BANYAN BAY RESTAURANT, 327
City Attorney reviewed his memorandum of November 2 in which he recom-
mended council suspend the amusement permit for a period of three months.He reviewed previous action on this restaurant which has had a historyof noj-se complaints, littering and parking problems. In October therestaurant was sold and the new owner, Robert price, applied for an
amusement permit. Mr. Price indicated a willingness to comply with re-quirements placed on the former owners, he also proposed moving thedance floor to a more enclosed area of the restaurant to ressen the noiseoutside and fencing off part of the parking 1ot to stop parking violations.
Police investigation of the new owner showed several incidents of assaults.Police report few complaints about the restaurant during the past monthuntil weekend of October 28; there have been three fights and two noi.sevj-olations. Police undercover officers have made four purchases of cocaineon the site, three from employees of the restaurant.
Staff was concerned about the ability of this operator to run a businessthat is not a nuisance or a source of Iaw violations.
Vice Mayor Amstrup asked representatives of the restaurant to speak.
Charles Light, attorney representing Banyan Bay, expressed his concernsthat Mr. Prj-ce's character is the issue; employees have been cleaningup litte4 onl-y two complaints about noisei employees selling drugs werefired.
Robert Price stated his concern about not being notified by police aboutdrug investigation; not being tol-d which employees were arrestedi assoon as he found out about arrests the employees \i7ere fired; music afterhours was to test the sound system; dance floor has been constructed inthe new area of restaurant (he showed pictures) ; his desire to have aplace for young people to congregate and have fun.
Council assured Mr. Price that his character is not in questioni councifis determined to have this establishment comply with requirementsiquestj-oned testing music system after hours, especially in J-ight of at-tempting to get amusement permit after a1l- the noise compfaintsi rest-aurant is in bad location for this type of entertainment.

Hyatt Hotef received a traffic allocation in February for Phase I of its
re con str uct ion project; it then paid the required fee and requested a
nine month extension to consider whether it would build in two phases or
in just one. Hyatt has decided to demolish the entire existing facility
and rebuild in one phase. this would be an 800 room highrise hotef with
coffee shop, restaurant and convention facilities, therefore, it needs
an alLocation for an additionaL lll rooms.

Efiport- eor:le-vard. This site could accommodate 559 rooms according to
the SAP designation of 65 rooms per acre. The applicant owns the
leasehofd for Fishermants Park, a county park, which the applicant woutrd
like to improve. Based on county willingness to consider help in im-
proving the park, the park area has been incl-uded for the purpose of
catculiting fand use. rf the park improvement j-s not undertaken, this
could affect the density of rooms allowed on the site.
Skateboard Park Hotel- is requesting an extension of nearly one year for
iEs aTfoc-atfd-Tor a 240 room hotel- at 520 Airport Boulevard. applicant
has not paid the Bayfront Development fee nor started environmental work.
City Planner noted that pl-ans have been received for the Ramada project;
should it be denied an additional 1.5 capaclty would be added to Broadway.
She reviewed the capacities available at the criticaf intersections and
the effect these requests would have on capacity. She noted that the
traffic analy,zer has an error factor of plus or minus 5 percent and thus
it would be possible to grant all the requests.
Council was concerned about allowing the Skateboard allocation to be ex-
tended for one year.
Council-man Mangini moved to revoke the a1l-ocation to Skateboard Park
Hote1 and grani the requests for Hyatt and Legaspi. Councilman Martin
seconded, noting the revocation is due to not meeting the requirements
of payment of Bayfront Development fees and environmental work. Motion
carried unanimously by ro11 call vote of members present.
