PRESENTATION OF OLD POLICE STATION KEYS TO NEW OI/iNERS
Vice Mayor l\mstrup presented the keys to the o1d police station to the
new owners .
APPEAL OF DENIAL OF FOUR UNIT CONDOMINIUM AT 11f4 PALOMA AVENUE
City Pfanner reviewed her memorandum of September 13 in which she recom-
mended council hold public hearing and take action to either uphold
the Planning Conunission's d.enial , reverse the Planning Commission'sdenial, or grant part of the applj-cantsr request.
Vice Mayor Amstrup opened the public hearing.
David Carr, attorney for applicants, stated applicants are willing to
meet all city conditions; are only exceeding height limits by 8 inches
and that is necessary because of drainage and architectural style,
variance for 1ot coverage is due to an overhang over the garage area and
is not on the ground; Iot coverage was not exceeded in the originalplans, but due to revisions for the new fire escape laws, it is now
sliqhtly over the allowed coverage; the parking space which requires
five manuevers to enter j-s more easily entered by a compact car and most
people have compact cars these days. Parking is already a problem on
the street due to proximity to Broadway shopping area; there are many
apartments in this area which contribute to parking problems. This
project could be changed to apartment units and then it would not have
to provide as much parking. Burlingame needs homeowners and these are
affordable units. To reduce the nunber of units would be an econom.ic
hardship.
Speaking in opposition to the project was Bob Bustamante, 1120 Paloma.
He stated that a parking sta1l which requires five maneuvers to enter
would just not be used; parking on street is very bad; family in house
on site at the present time has three cars and all are parked on street.
He presented a petition opposing the project signed by 35 families on
street .
Vice Mayor Amstrup ctosed the pubfic hearing.
Council discussed its concerns about the parking space requirementsi
the difficulty of parking on that street; the impact on residents; not
everyone has a small car and most families have two carsi there is no
guest parking.

Danny Parodi, l2l1 Burlingame Avenue, one of the applicants, stated they
have been in business for five years but just recently put up new sign
on awning; need to make public aware of what type of business this is
since Personal Touch could mean many things. They were not aware that
a permit was need.ed.
There being no other comments, the hearing was closed.
Council discussed again its concerns about businesses which are not
aware of cityrs sign code. Chamber of Commerce is sentling list ofrules to all businesses and city is now providing all new business
applicants with the same l-ist. Ignorance of the law is no excuse.

Councilwoman Barton wondered if sign companies are aware of city codes.
Councilman Martin inquired of City Pfanner if the ribbon design were
removed from sign would square footage be within code; City Planner
replied no. Councilman Martin stated the sign code is a "horror; " if
sign were on building it could be approved, but since it is on awning
it is ilIegal.
Councilman Mangini moved to deny sign without prejudice. Seconded by
councilwoman Barton. Motion carried on roll call vote, Councilman
Martin voting no.

TO SPECIAL PERMIT TO ALLOW OUTDOOR SEATING
ROAD
City Planner reviewed her memorandum of September 26 i-n which she recom-
mended council hold public hearing and take action. She reviewed the
history of this special permit; it was originally granted in 1982 and
reviewed early 1983 when it was found that tables had been placed in
front and the yard area had been asphal-ted over. Code requires f0 per-
cent landscaping in this area. Planning Commission denied this amendmentfor seating in front setback because this would extend the use into thefront setback and would eliminate the landscaping.

Dr. Siegel-, the new owner, presented landscaping pl-ans to council-. He
stated the insj-de space is sma11 and seating is needed outside, the
former owner was not aware of need for permits; he is rewriting the leaseto include the outside area so that he can better control usei he showedpicture of neighborj-ng businesses that he felt were very unattractive,with l-ittle or no fandscaping; he reviewed the petitj-on presented to
P]anning Commission and signed by 153 persons in favor of the outdoor
seating.
There being no further comments, the hearing was closed.

city Manager reviewed his memorandum of september 28 j-n which he recom-
mended council approve the agreement for traffic management for the
project aE 477 eiiport Boulevard. The purpose of the agreement is to
eliminate traffic impact on Broadv/ay interchange; requj-re developer to
prod.uce a workable program; develop a reporting system to city; provide
ior penalties for non-performance; and provide that the term of agree-
ment be indefinite, to be recorded, and be bj-nding on successors and a
condition of all lease or rental agreements.
Councilman Martin pointed out a need to provide for compliance if ovrner-
ship or lease should change during year. city Attorney agreed and would
add a sentence to provj-de for such with approval of Owen Bay Plaza'
councilman Mangini moved adoptj-on of Resolution 86-83. Seconded by

AND AMENDING AGREEMENT WITH
city Manager reviewed his memorandum of septemlcer 21-which recommended
couicil .[p.o.r" a ]-3 percent increase in garbage cotlection rates
effective'bctober 1, 1983. This j-ncrease is 85 percent attributable
to projected costs of the new transfer station.

City Manager announced that the Rent Control Petition had failed to
garner enough signatures to qualify for an election.

Councilwoman Barton expressed dismay that the signal installation wastaking such a long time. Director of Public Works reviewed the pro-
blems with delay of delivery of materials.

LANDS PROJECT ON AIRPORT BOULEVARD
Vice Mayor Amstrup acknowledged receipt of a letter from David Keystonrequesting council set appeal- hearing on October 17 to review the
above project. The request is unusual in that the project has not yet

City Attorney stated he did not feel comfortable in setting a hearingin this manner.
Vice Mayor Amstrup mentioned that there may only be three council memberspresent at that meeting. Mr. Keyston had no problem with that. -
