PUBLIC HEAR]NG REVIEW OF CARRUF HOTEL PROJECT 350 AIRPORT BLVD. City Planner reviewed her memorandum of November L4 in which she recommended council hold public hearing and take action. Councilman Pagliaro has ca11ed this project up for review at the last meeting. Tha Carruf Corporation is requesting three special permits to build a 559 room, 9B foot high hotel including two restaurants, 21,000 square feet of meet1ng/convention space and an indoor swimming poo1. The Planning Commi-ssion granted the three special permits with 18 conditions at its meeting of 0ctober 22. The three special permits are for height, floor area ratio and exceeding three of the Design Guidelines: front setback equal to height of building, front setback equal to half the width of the structure, and obstruction of more than 40 percent of street f rontage. Councilman Pagliaro reviewed his concerns. Did the original EIR address this current project; whether developer should be required to provide a maintenance bond for maintaining the Fisherments Park; Airport Boulevard improvements and the bridge improvements over Sanchez Creek channel; how is proportionaLe share for road improvements figured, DPW stated it is computed on traffic generation; when would road improvements go in, DPld stated when project is bui1t. Vice ivlayor Martin st.ated he also had concerns about maintenance of parks and roads, and had suggested an assessment district to recover costs and to provide that city mai-ntain those areas. Vice Mayor Martin opened the public hearing. Mark Hornberger, rePresenting the Carruf Project, showed a sli-de presentation of Ehe project. He reviewed the fire safety of project, the four main access points for fire trucks with ladders to reach roof area, the two exits from each f1oor. He also showed the improvements to Fishermen t s Park and the dedication of 1B parking spaces exclusively for the park, and the public access routes to the bay through the project. -1 Councilman Pagliaro reviewed with Hornberger that project with all fire requirements; reviewed number of elevators' of glass wa11s in atrium; unusual stairways and fire wa11s the stairways. 0ther council members commented favorably on the project. would comply fire safety protecting Coun c i lman CALL TO ORDER SOBRIETY ROAD CHECK 185 Mangini was particularly pleased that the right angle turn on Airport Boulevard would be reduced to a curve. Vice Mayor Martin closed the public hearing. Councilman Mangini moved to uphold the Planning Commission action to grant the three special permits with 1B conditions. Seconded by Councilwoman Barton. Councilman Pagliaro requested that the conditions on the report (Fire Chief memo of 0ctober 72, 1984) be lncluded conditions of approval. Council accepted thi s amendment. PUBLIC HEARING _ MITIGATED NEGATIVE DECLARATION FOR A USE DETERMINATION AND PARKING VARIANCE - 1 157 CALIFORNIA DRIVE City Planner reviewed her memorandum of November 14 in which she recommended council hold public hearing and take action. Approval of the Mitigated Negative Declaration does not constitute approval of theproject, nor does it prejudice in any way future action on the project. This project is for a daytime video studio and a nighttime restaurant/bar and disco in the old Encore Theater building. Council had a number of questions and concerns: would the project have a public hearing, CP replied yes; noise impact could be great, councj-1 has had previous experience with noisy discos in residential areas; building could be soundproofed, but would not eliminate noise of patrons outside. Vice Mayor Martin opened the public hearing. There being no comments, the hearing was closed. Councilman Pagliaro questioned whether the project would operate until 2 a.m. or unLil 4 a.m. CP replied that originally they had requested to operate until 4 a.m. but have revised the request to 2 a.m. Councilman Pagliaro could not find this document adequate, did not understand how they could differentiate between noi-se made between l2midnight and 1 a.m. and noj-se made between 1 and 2 a.m. City Planner Declaration. noted council can add any comments to Mitigated Negative Councilman Mangini moved to accept the Mitigated Negative Declaration as adequate with additional comment by Councilman Pagliaro. Seconded by Councilwoman Barton, carried unanimously by ro11 call vote of members present. CONTINUED CONSIDERATION OF FAIRF]ELD ROAD TRAFF]C PROBLEMS Director of Public hlorks reviewed his memorandum of November L4 in which he recommended council approve Alternate 1 of six alternates presented. Alternate 1 would install 25 mph speed limit signs on Fairfield and increase enforcement of speed limit on both blocks of Fairfield. It would respond to concerns of residents on Fairfield to the schoolrs and PTArs concerns about keeping street open. Some the other alternates were to increase the angle of a right turn off Camino, making street one-way southbound and installing ttrumble strips.tt He noted the State saw nothing wrong with increasing the angle of the right turn but reserved comments on making the street one-way. he and of E1 Councj-1 discussed briefly. essentially doing nothing, better than nothing. November 15 in which he calendar, suggest any changes Council had no comments and the calendar was approved. The cost is not to exceed $2,000 and AYS0 will commit $600 toward the project. Seconded by Councilman Mangini, carried unanimously by voice vote, Councilman Pagliaro abstaining f rom the vote on item ttf . tt b.HILLSIDE DRIVE SEI,{ER AND WATER REHAB]LITATION JOB 325 Director of Public Works reviewed his memorandum of November 15 in which he recommended council award two contracts, one for water line replacement to Homer J.01sen in the amount of $108,980 and the other for sewer rehabilitation and repairs to L.J. Duarte in the amount of $342,693. City had received a letter from Homer J. 01sen, Inc., 187 objecting to the method of bid award. 01sen was the 1ow bidder for the entire project, but if the water and sewer blds are split the city can save approximately $30,000. City had noted in specs that it might choose to split the bids. Gerald E. Clair of Homer J. 01sen, Inc., reviewed his objections to this method of awarding the bid. He noted that splitting the project would inconvenience the homeowners because one contractor would work on first project and move oD, then the next. contractor would tear up street again for the second project. Council reviewed the bidding process with Director and City Attorney. CONSTRUCTION 0F SEWER REPAIR AT 2740 SUMMIT DRIVE JoB 4t1 Director of Public lJorks reviewed history of this project. A sewer was accidently fi11ed with cement while a home was being bui1t. The contractorrs insurance company has agreed to pay for repairs after some negotiation, meanwhile a temporary above-ground sewer line is in use. Director of Public Works noted that city had received a letter from Attorney Hugh F. Conno11y, representing adjoining property owners at 2722 E1 Prado, objecting to city authorizing work on this hillside during rainy weather. The hill has had problems in past and client would hold city responsible for any damage if work is commenced atthis time. Director of Public Works stated contractor had said he would need atleast five days without rai-n before he would start on project. The only alternative is to wait until spring and go to bid again. Director will talk to contracLor. City Attorney noted that contractor would be responsible for damage if he determined to work at this time. Councilman Pagliaro requested that the agreement. for easement alsoinclude a paragraph that the owners will pay for repairs if his insurance company does not. City Attorney will add phrase and bothitems will come back at the next meeting. OLD BUSINESS - HILLSIDE SEWERS Councilwoman Barton questioned the letter from Mr. Dye regarding sewerproblems on Hil1side. Director of Public Works reviewed past historyof complai-nts, Dye lives in city but sewer flows to a county main;city and county have been working on this problem. rt has beensuggested that Dye install a one way valve in his sewer to eliminateoverflow problem, but he declines to do thls. City will communicatewith Dye and county again. ACLU SUIT REGARDING SOBRIETY ROAD CHECK City Attorney noted ci-ty and state are being sued by the ACLU. Letter from E. H. Dye, Jr . , regarding sewer problems on Hi11side. on March 1, 1985.Memo regarding Commissionerts Dinner Memo from Police Chief regarding Radar Enforcement on Carolan Avenue. Councilman Pagliaro was amazed that a judge dismissed a 57 mph citation on basis of the speed survey on Carolan where the mean speed is listed at 44 miles per hour. The judge staLed city can posL a lower than mean speed limit with a vari-ance of up to five miles per hour. In essence, we can post speed of 40 mph, not 35 mph. FROM THE FLOOR - SOBR]ETY ROAD CHECK Alan Horn, 7325 Paloma, objected strongly to the Police Departmentfs Sobriety Road Check for drunk drivers.
