OF REQUEST TO REMOVE STREET TREE AMSTRUP, BARTON, MANGINI ( excused PUBLIC HEARING 2709 HALE Park Director revj-ewed his memorandum of August 15, 7984 in which he recommended counci-1 hold public hearing and then uphold the Park, Recreation and Beautification Commissionrs denial of Lhis request to remove a liquidambar tree in the planting strip in front of 2109 Ha1e. In January the applicant, Richard Norton, requested permission to remove this tree. After staff inspection, j-t was recommended that the PRB Commission deny this request which it did at its meeting in Ju1y. Mayor Amstrup opened the public hearing. Richard Norton addressed council. He noted that he and Park Director had agreed that sidewalk repai-rs would not be made until after this appeal hearing, but the sidewalk had been replaced that day. He saidthe tree is o1d and needs to be replaced with a new tree. It has lifted the sidewalk several inches and has cracked and lifted his driveway. It will cost $2,000 to replace the driveway. People have fa11en because of this lifting. Tree roots are invading his garden. He requested permission to remove the tree and replace it with lessdestructi-ve tree. Mayor Amstrup closed the public hearing. Park Director acknowledged that he and City Engineer had agreed thatno work would commence on sidewalk until after the hearing. Henoted that the damage has already been done to Nortonts driveway andwould require replacement of the driveway, but that tree roots couldbe trimmed under the driveway to stop the lifting and crackJ-ng. Norton mentioned his concern that trimming roots may cause tree to f all. Councj-lwoman Barton was concerned that street trees cause damage toprivate property. Repair of driveway is large expense. Councilman Pagliaro noted his strong support of sidewalk repairs. Heinquired why contractor had proceeded with repair when told not to. There was discussion about contractor working with private ciLizen torepair driveways while they are working in that area. TRAFFIC ALLOCATIONS AUGUST 1984 City Planner reviewed her memorandum of August 14 in which she recommended council review requests and direct staff. Councll had four requests for schedule extensions from (1) Ramada, (2) Legaspi,(3) CIF 0ffice, and (4) Owen 0ffice Park, and one request for traffic allocation from David Keyston for a 20,000 square foot office building at 777 and 73L Airport. She recommended council withhold action on the request for allocation to Keyston until after the General Plan Amendment hearing. Councll discussed briefly and agreed to take no action on the Keyston request. It noted the other requests for extensions were mi-nor, all projects being behind schedule. Councilman Martin moved to grant Seconded by Councilwoman Barton, the four extensions as carried unanimously by requested. voice vote. RESOLUT]ON 6I_84 RELATED PROCEDURES F]XING AND ESTABL]SH]NG WATER RATES, CHARGES AND Director of Public Works revlewed his memorandum of August 15 i-n which he recommended councj-1 adopt this resolution. Water rates would not be changed but there rvould be an increase in charge for turning on or restoring service during nonworklng hours, and an increase in service installation fees. Counci-lman Councl lman Martln moved adoption of RESOLUTION 6l-84. Seconded by Pagliaro, carrled unanimously by voice vote. CONS IDERAT ION PERMIT OF II{CREASING PENALTY FOR WORKING WITHOUT A BUILDING Director of Public Works reviewed his memorandum of August 16 in which he requested councj-1 direct staff. A survey of other cities and counties on Peninsula showed that most use the double-fee penalty for workj-ng without a permit. San Francisco and San Mateo County both use ten-times fee. If council decides to increase fee it could be added to the ordinance being introduced for adoption of building codes. Council discussed concern about homeowner who does his own work and is unaware of need for permit; in case like that Lhere could be an appeal procedure; suggesL a ce11lng of $3,000 on penalty. Seconded OLD BUSINESS - HIGHWAY 101 CORRIDOR Mayor Amstrup requested a special meeting of council to consi-der thetrHighway 101 Corridortt plan currently being discussed in newspapers. Councilman Martin reviewed several of the 14 options being revi-ewed such as a BART station in Lomita Park area, a BART station at Millbrae Avenue, and a light rail system which would run adjacent to the SP tracks but with a frequency whlch would effectively block auto traffic at crossings.
