PUBLIC HEARING - APPEAL OF DENIAL FOR DRY CLEANING ESTABLISHMENT AT 1199 BROADWAY City Planner reviewed her meno of July 8 in which she recommended council hold public hearing and take action. The applicant is requesting two special pernits to locate a dry cleaning service with on-siEe processing at 1199 Broadway. One pernit is needed for dry cleaning in the C-L zolae and the second is required for parking as part of the parking variance granted to this site. Mayor Martin opened the public hearing. He noted that he had spoken to a representative of this establishmenE. Rich Capizaro, attorney, reviewed his client knew nothing about the petition in opposition presented to council and could have presented one in favor; he is wj-l1ing to meet all city requirements; showed photos of sinilar establishment in San Mateo which is larger and on a busier corner and it has no parking problems; applicant feels they r.ri11 have little effect on parking; this is a quality operation; questioned differentiating between service and retail businesses. Bob Petrick, Fred Guerrero and Jerry Manzanares all spoke in favor. Mary Zencrici, 1141 Paloma, urged denial; parking and traffic vi11 be impacted; citizens were promised retail business at this site; thereare too many cleaners on Broadvay. Dorothy Chu, uhose family owns drycleaning business on Broadway, urged deniaL also. Mayor Martin closed the public hearing. Councilman Pagliaro noted he had nothing against dry cleaners, but there is a parking problen on Broadway which this business nould impact. He noved to uphold the Planning Comnission denial. Seconded by Councilwonan Barton. Mayor Martin stated this is the only store on Broadvay irith limitations on parking; he has a problem nith liniting any particular type of buslness; under our city code there 1s no distinction between service and retail. Motion carried 4-1 on roll-calL vote, Mayor Martin voting no. 73-85 - FIXING ASSESSMENTS FOR I{EED ANDPUBLIC HEARING - RESOLUTION RUBBISH ABATEMENT - JOB 514 Director of Public l{orks reviewed his recommended council hold public hearin accordance with requirements of 1aw' t meno of J,Jne 27 in whi-ch he and take action. Ine City Engineer has posted theh PLEDGE OF ALLEGIANCE TO THE FLAG Led by City Planner, Meg Monroe. ROLL CALL subject properties, has contracted for weed and rubbish renoval and has given the City Clerk the assessment report. The City Clerk has published the required notice as specified by Iau. Once adopted, the assessnents will be transnitted to the County Assessor for placenent on the tax ro1ls. In response to council questions, the Director reviewed that most property owners have paid for the weed cleanup; that Southern Pacific lands have been posted and cLeaned in some areas and SP has been bil1ed. 0wnership of sone property along Skyline has to be deternined before cleanup. Councilwonan Bartolt wondered if the old bowling a11ey building could be assessed for cJ.eanup. Mayor Martin opened the public hearlng. There being no comnents, the hearlng nas closed. Councilman Amstrup noved adoption of RES0LUTION 73-85. Seconded by Councilnan Pagliaro, carried unanimously by ro11 call vote. ACCEPTANCE OF CITIZENS ACCEPTABILITY OT PARKING STRUCTURE REPORT Council members all hard work. expressed their gratitude for this committeers Councilman Mangini moved to accept the Report. Seconded by Councilman Amstrup, carried unanirnously by voice vote. FUNDING FOR HIGH SCHOOL DISTRICT Mayor Martin revieved that council had received a letter from the Superintendent of the San Mateo Union High School District requesting funds for athl,etic prograns at Burlingame High School . City Manager noted a second letter fron Superintendent council questions raised at the past Study Meeting and letter from City of San Mateo uith restrictions on its district for use in San Mateo schools on1y. in response Eo a copy of donation to the Council members noted city has already spent funds on field repairs, intercom systexn and sr.rimning pool cover for Burlingane High School . Councilwoman Barton objected to funds going to sports nhen other prograns night also be cut, she wondered if school district rsould be back every year for donation and also why nobody was at the council meeting to represent the district. Council-man Amstrup stated he supports sport programs but did not uanE Eo set precedent with donation, he noted students in Burllngame attend Mi11s High School and other schools i.n the district, not just Burlingame; he wondered if Foster City and llillsborough would be donating even though they had no school in their cities. Counci-lman Mangini reviewed the sports uses proposed for these fundsl that schools should be receiving monies from State lottery next year so would not need to approach cities for funds. Councilnan Pagliaro supported a donation but dld not like to see linitations put on funds such as City of San Mateo has done. Mayor Martin reviewed the sale of a portion of Mi11s High School lands which will involve the developnent fees for that property being donated by City of Millbrae to Mi11s High School for swimming pool repai.r. He agreed students from Burlingame go to other schools and a donation should be for all students. City Engi.neer has given notice to eachproperty orner to a11ow then to perform the work in lieu of City; has performed the uork; has bi1led the property oh,ner tlrice; and has given the Assessnent Report to the City C1erk. Once adopted, the assessments r.ri11 be sent to the County Controller for placement on thetax ro11s. d. WARRANTS AND PAYROLL Finance Director recornrnended approval of Warrants 25990-26331,, duly audited, in the amount of $1,729,2L5.63 and Payroll Checks 59326- 60009 for the nonth of June 1985 in the amount of $605,541.78, Councilwoman Barton moved approval of the Consent Calendar r.rith exception of items "a and b.rr Seconded by Councilman Mangini, unanimously by Yoice vote. the carried a INTRODUCTION OF AND CHARGES ORDINANCE 1307 ESTABLISHING WASTE WATER RATES Director of Public llorks memo of July L0 recornrnended introductionof this ordinance establishing proposed rates for 85-86 beginning with water readings on or after September 1, 1985. The proposed rates anount to an increase of 8.3 percent for residential; comnercial rateswill increase from 9 ro 20 percent. In response to council questions, Director of Public Works reviewedsingle family rates; winter/summer rates; cityrs service for HilLsborough and the unincorporated area of Burlingame Hi11s. City Manager noted that Hillsborough wi1l, probably cone before council inthe next month for review. Councilwoman Barton acknowledged a letter received fron an elderlycltizen hoping rates rcould not increase. She hoped staff nould review for this senior the method ciLy uses for charges based on water useage which favors senior citizens who use less waLer than families. Mayor Martin and CounciLman lower rates for seniors. Pagliaro discussed the possibility of Councilman Mangini introduced ORDINANCE 1307 for its first reading. c. b. RESOLUTION 75-85 - AUTHORIZING EXECUTION OF AGREEMENT FOR EIR FOR SEQUOIAS PROJECT - I781 EL CAMINO REAL (PENINSULA HOSPITAL) City Planner's memo of July 8 recommended council approve this contract with Envi"ronmental Science Associates. Cost of thls EIR will be $54,700 and funds have been deposited with city by developer. Councilman Pagliaro expressed his concern thaE the impact onenvironment, the height of the project causing a uind tunnel effect and that the vind effect on adjacent properties should be addressed. He was also concerned that developer realize the significant concerns council might have about this project, they are spending a considerable amount of noney on this EIR and council has manyquestions about the concept. 't as City Planner reviewed her memo of July 15 in vhich she recommended council consider extending the Hyatt Regency traffic allocation based on their revised construction schedule. In November 1983, council granted Hyatt a traffic allocation for an 800 room hotel on the site of the Hyatt note1. 0riginally they were to subnit final plans in Septenber 1985, the nev schedule shows they will submit plans in March 1986 but occupany is sti11 scheduled for September 1987. CRIMINAL JUSTICE COUNCIL Councilman Mangini acknowledged a letter f roro the Crininal Justice Council requesting to nake a presentation to council. Council agreedto hear a presentation at the August 19 reguLar meeting. Due to council menber vacations, the August 7 Study Meeting rescheduled to August 14, 1985. Councilwoman Barton requested council- consider changing four-hour parking spaces in Parking Lot C to all day spaces at that neeting. She also nentioned the loading zones at the former Tate Auction siEe and rvondered if the city could use those. Director of Public Works will investigat.e. Airport 9 at 10 Noise a.m. FROM THE FLOOR - NEIGHBORHOOD WATCH Bud Harrisorr, 376 Lexington, noted there are several rrNeighborhood Watch'r areas in the city rrith streets signs identifying then. He hoped the entire clty could be identified as a "Neighborhood Watchrr city with si.gns aE the entrances to the city. He also noticed that the Ci-ty of San Mateo is using work-furlough prisoners to clean certain areas and thought that a good idea for our city too.
