The meeting nas ca1led to order at 7:30 p.m. by Mayor R. David Martin. PLEDGE OF ALLEGIANCE TO THE FIAG Led by City Manager, DennJ.s Argyres. ROLI CALL COUNCILMEMBERS COUNCILMEMBERS MINUTES PRESENT: ABSENT: AMSTRUP, BARTON, MANGINI, MARTIN, PAGLIARO NONE Minutes of the Regular Meeting of June 17, 1985 were approved. PUBLIC HEARING - APPEAL OF PLANNING COMMISSION SEATING AT FERIALIS DELI - 840 STANTON ROAD - DENIAL TOR OUTDOOR RESOLUTION 66-85 Ci-ty Planner reviewed her memo of June 25 in which she reconmendedcouncil hold public hearing and take action. The appJ.icants arerequesting an amendnent to Ehe use permit for Ferialrs Del-i to a11owtwo tabl"es and six chairs to be taken from inside to the paved areathe front setback between 10 a.rn. and 4 p.m. during good ueather.These tables would be temporary and would not be adding to the totaltables and chairs approved for this site in the original use pernit.At the June 10 Planning Commission meeting, the vote was 3-3 to denythe request. By rules of the Planning Commission, a tie vote isconsidered a denial. IN Mayor Martin opened the public hearing. of property, reviewed the request and askedDr. Ernest Siegel, ownerfor council approval. Councilman Mangini inquired how the food was served. Siegel repJ-iedon paper plates. Councilman Mangini asked if the outside area wouldbe kept clean if the pernit is granted. Siegel replied yes. Mayor Martin closed the public hearing. Council discussion: this is different than the previous request forpermanent stationary seating in front; the applicants have made thelandscaping improvements; customers would not be allowed to renovemore seating from inside. Councilnan Anstrup suggested requiring acontainer for trash outside and review in six months. CounciLman Amstrup moved to reverse the Planning Conmission action anda1low the amendnent to the speci.al use permit with conditionssuggested by staff and council. Seconded'by Councilwoman Barton,carried unanimously on ro11 call voEe. PUBLIC HEARING - APPEAL OP PLANN]NG COMMISSION DENIAL OF USE PERMIT FOR EXERCISE CLASSES AT 1208 DONNELLY - RESOLUTION 67-85 City Planner reviewed her nemo of June 25 in which she recommendedcounciL hqld public hearing and take action. Applicant is requestinga special use permj.t for woments exercise classes in C-2 zote, Burl.lngane Avenue Commerical Area, Sub-Area B. This is a women's gymnasium equipped with Nautilus equipment, sauna, and retail outletfor sale of exercise clothing. They plan to be open from 6:30 a.n. to8 p.m. veekdays and 9 a.m. to 1p.m. on Saturday and Sunday. At theJune 10 Planning Conmission meeting, a 3-3 vote was cast for denial ,tie votes are a denial. Councilman Pagliaro inquired about the fire wa11 protection in the building. Assistant Fire Chief reviewed that any requirexoents for additional Director of Public Works and public assembly use nould 273 require a four hour fire wa11 because there is an auto repair businessnext door. Mayor Martin opened the public hearing. Mithoo Benner, applicant, revleved the concept of REACH exercise classes; roodeled after REACH in Palo Alto; high quality operation open seven days a week; heaviest use would be early morning and late day, when working women get off work; parking should not be problem; she had an objection to conditions requiring that classes be lixoited to no more than five people betrreen 8:30 a.m. and 5:30 p.m. and that thepermit be reviewed in one year, she noted she would be putting a lot of noney into this operation and woul-d not Like it denied after only one year . Council had a lengthy discussion with Mrs. Bennerg Benner noted she coul-d live with the condition of one-year review but that liniting classes to five would not be profitable; location of the fire wall- discussed, cost of installing fire wa11; City Planner noted Benner using a list of conditions from Planning Commission report dated 6/10/85 and that condition 2 in that report was not included in conditions to be considered in the council report of June 25, this condition should be added as conditlon 7. uas 1S Also speaking in support of the cLasses vas, Melissa Parsons, Palo Alto REACH; Judy Brasesco, owner of current business at 1208 Donnelly; Joan Taylor; Virginia Graham, resident; and Dr. Norton Benner; they reviewed the need for this type business; felt it would not j.npact the parking nore than her business; Brasesco discussed recent taLks with Fire officials about sprinklering the adjacent building and adding another layer of sheetrock on both sides of the wal1 to meet requirements. Mayor Martin closed the public hearing. Council discussion; fire wa11 nust meet Uniforn Building Code requirenents; parking is probl-em in this area, but this business should no! impact any more than a retail store would; this is large site and could be divided into snaller stores which could impact parking Itrore; average class size determined to be 12; should be limitation to size of class during the lunch period when parking is at iLs worstl reviewed that classes would be by mernberships' with one first time only walkin allowed; discussed that there should be tine a1l-owed between classes so there is no overlap; child care vould be only during time parent is on site. Councilman Amstrup moved to reverse the Planning Commission denial and a1low the special use pernit rrith conditions of City P1-anner's staff report dated June 25, L985 and the additional condition to linit class size to 12 women between 11 a.m. and 2 p.m. and there be a 15 minute break between classes so there is no overlap in parking. Motion seconded by Councilvoman Barton and carried unaninously by ro11 call vote. RECESS Mayor Martin declared a 9 p.m. with all members recess at 8:50 present. p.m. The meeting reconvened at PUBLIC HEARING - DEVELOPMENT FEES SECOND READING ORDINANCE I305 REVISING BAYFRONT City Manager reviewed his nemo of June 11 in which he recommended council hold a hearing and take actlon. At the June 5 Study Meeting, council reviewed staffis proposal to increase Bayfront Development fees 50 percent to pay for roadway imProvenents outlined in the Capital Improvement Progran. City Attorney has stated the revised fees apply to those projects which have been approved' but have not yet obtained a building pernit. The new fees will provide an additional $400,000 to $500'000. Mayor Martin opened the pub1lc hearing. There belng no comnents, the hearing nas closed. Councilnan Mangini moved adoption of ORDINANCE 1305. Seconded by Councilman Amstrup, carri-ed unanimously by roJ-1 call vote. 274 RESOLUTION 68-85 - CALLING AND TO BE HELD ON NOVEMBER 5, 1985 SPECIFIC SERVICES ORDERING A GENERAL MUNICIPAL ELECTION AND REQUESTING COUNTY CLERK TO RENDER Mayor Martin reviewed Clty recommended council adopt council seaEs, as well as fi11ed at this election. Clerkrs meno of June 7 in which she this resolution. He reviewed that threethe City Clerk and City Treasurer, would be Councilman Mangini moved adoption of RES0LUTI0N 68-85. Seconded by Councilnan Anstrup, carried unaninously by voice vote. DETERMINING LENGTH OF CANDIDATE STATEMENTS Mayor Martin reviewed City Clerkts meno of June 6ln which she recommended council deternine whether to continue 1ts previous policyof l"iEiting candidate statenents to 200 words and requiring candidatesto pay costs of handling and printing statements. Council also hasthe choice of increasing length to 400 words and requiring city pay costs. Councilnan Pagli.aro wondered ifregarding financial disclosure lras up for reelection. confl,ict of interestof a council candidate who there was a requirements City Attorney stated he found no conflict of interest. Mayor Martin stated it is to the electoratets advantage to have acandidate statenent and he fel-t the electorate should pay for it. Other counci-1 nembers yanted the 200 word linit and candidate payment. Councilwonan Barton noted she woul"d not want a council member who needed 400 words for a candidate statement, he night talk too much. Councilman Mangini moved to continue council policy of limitingcandidate statements to 200 words and requiring candidates to pay thecost of printing and handllng. Seconded by Councilwoman Barton,carried 4-1 on ro11 call vote, Mayor Martin voting no. CONSENT CALENDAR a. PERSIIING SCHOOL SITE City Managerts nemo of June 25 informed council that city is due to take title to Pershing School on July 3. He has asked the Park Director to be responsible for denolition of the building and design of the new park. He suggests that council ask the Park and Recreation Commission to hold a public hearing concerning what shoul-d be included in the park. Councilman Amstrup hoped something uould be salvagable from the o1d bul1ding. City Manager said the Police and Fire Departments would be helping with the salvage and demolition. Mayor Martin referred the ratter of Pershing School site to the Park and Recreation Connission for a public hearing. City Manager replied Beautification is sti11 studying this, and that occidental is due for trimning this fa11. Mayor Martin suggested Director of Publ-ic Works look into the tremendous traffic congestion caused by both city contractors and PG&E when traffic lanes are blocked for street work, Specifically Last Friday on California Drive two lanes were closed from Oak Grove to Lorton and only four men were working; there were no traffic lights. He suggested that someone be there to direct traffic and that a careful decision be made about how much area needs to be blocked off. He was concerned because Fire Station One would not have been able toget out through all that traffic.
