Thewas called to order at 8 p.*. by Mayor Irving S. Amstrup. PLEDGE OF ALLEGIANCE TO THE FLAG Led by Chief of Police, COUNCILMEMBERS PRESENT : COUNC]LMEMBERS ABSENT: MINUTES PUBLIC HEAR]NG SPECIAL PERMIT DEN]AL OF REQUEST FOR REZON]NG FROM FOR HEIGHT AT 3155 FRONTERA WAY was meeting Fred Palmer. R0LL CALL AMSTRUP, BARTON, MANGINI, MARTIN, PAGLIARO NONE appro ved. R-1 TO R-3 AND Minutes of the Regular Meeting of March 79, L9B4 were City Planner reviewed her memorandum of March 27 in which she recommended council either approve or deny request for rezoning. InJanuary L984, Douglas Pringle submitted a request to rezone hisproperty from R-1 to R-3 in order Lo add a fourth floor apartment tothe 717 unit apartment building. This apartment project was granteduse variance in 7967, but such variances are no longer allowed bystate 1aw. This fourth floor area was partially built and all butfour feet removed at the time of original construction. Removal wasat the request of city council. a At its meeting of March 72, theresolution recommending council Commission adopted a request for rezoning. Planning deny the Mayor Amstrup opened the public hearing. Douglas Pri-ng1e, applicant, reviewed efforts he had made inlandscaping the land around apartment. He stated the project existsand it should be zoned R-3. Councilman Pagliaro noted that applicant had purchased adjacentproperty and inquired what plans applicant had for that property. Pringle stated he had no plans for more units and did not care if thisproperty were not included in rezoning. councilwoman Barton was also curious about this property. Pringle replied it was purchased cheaply from state for access to hisgolf course on the site. Speaking in opposition to the project and rezoning was: Ruth Agne11o,Paul Vlahos, Eileen Mauss and Raymond Mauss, all iesidents of HuntDrive. They reviewed the noise and traffic problems caused by theapartment house; that this is a residential area and zoned R-1;apartment house obscures sun from homes; applj-cant never cleaned uparea until after the Planning Commission meeting. Y?{gr Amstrup noted he was familiar wirh project from its1967 when whole Mi11s Estate area and all improvement groto 1t. He noted the apartment dwellers would not be affeleaving the property zoned R-1 and he would vote to leave beglnning in ups obj ected cted by ir R-1. Councilnan Pagliaro moved to deny the request for rezoning and thespecial permit for height. Seconded by Councilwoman Bart6n, carriedunanimously by ro11 call vote. INTRODUCTION OF OR DINANCE 727I PRECLUD]NG SECOND UN]TS IN R-1 City Planner t s memorandum of March 28 recommended council reviewfindings and documentaLion prepared by staff for prohibition of secondunits in R-1 zote and lntroduce ordinance or refer to study. *J 106 Councilwoman Barton i-ntroduced 0rdinance I27l for its first reading. ]NTRODUCT ]ON IN STI TUT] ON S BROADWAY OF ORDINANCE I272 PROHIBITING BANKS ON BROADWAY, OGDEN AND MARCO POLO AND AND OTHER FINANCIAL LIMITING OFFlCES ON City Planner noted that this ordinance would limit offices on the first floor on Broadway on1y, but would prohibit banks and financi-a1 instituti-ons on Broadway, 0gden and Marco Polo. Councilman Mangini inquired if questions raised by leLters objecting to limiting offices were answered. City Manager replied he had written to those people and clarified that offices were only limited on Broadway. Councilman Mangini introduced INTRODUCTION OF CANOPY SIGNS ORDINANCE I273 0rdinance 1212 for i-ts AMENDING PROVISIONS first reading. FOR AIdNINGS AND City Planner t s memorandum of March 28 recommended council proposed amendment to sign code and introduce ordinance or s tudy . Counc ilwoman review refer to APPROVAL OF Barton introduced 0rdinance 7273 for iEs first reading. NEGOTIATION SETTLEMENT W]TH POLICE OFFICERS ASSOCIATION City Manager reviewed his memorandum of March 2L in recommended council approve this agreement with the Association. which he Police 0fficers - ESTABLlSHING Th/O-HOUR PARKING ON AND CALIFORNIA Councilman Pagliaro inquired about thettreopener clausett 1n the agreement. City Manager stated this is an agreement to sit down and discuss salary 1f there is an increase of 6 percent or more in the CPI. Councilman Pagliaro stated he felt strongly that a contract 1s a contract and he would not vote to either increase or decrease salaries while a contract was in effect. He would vote to approve this contract because city has a very fine Police Department. Councilwoman Barton moved approval of thettMemorandum of Understanding" with the Police 0fficers Association. Seconded by Councilman Martin, carried unanimously by ro11 call vote. CONSENT CALENDAR Councilman Mangini inquired if Ehe Weed Abatement program was for cit.y property. Director of Public Works stated thls is for private property only and that city would hire students to clean city property. 1 ]NTRODUCTION OF H]GHLAND AVENUE ORDINANCE L274 BETWEEN HOWARD Traffi-c/ Civil Engineerts memorandum of March 2l recommended council introduce this ordinance. After one-month trial of day parking on Highland, staff recommended establishment of hour parking zone. all two- 2 RESOLUTION 2I_84 RUBBlSH A NUISANCE DECLARING NOXIOUS AND DANGEROUS I4IEEDS AND IN ACCORDANCE hIITH MUNICIPAL CODE CHAPTER 3 11 08 City Engineer t s memorandum of March 19 recommended council approve the resolution setting a public hearing May 7, 1984. RESOLUTlON 22_84 AUTHOR]ZING EXECUTION OF AGREEMENT FOR CTTY / COUNTY HIGHWAY FUNDS FOR AIRPORT BOULEVARD/BAYSHORE HIGHWAY TRAFFIC SIGNAL PROJECT NO. 915 Director of Public Works memorandum of March 23 recommended councj-1 adopt resolution authori-zj-ng the Mayor to execute the agreement with the County for Highway funds in the amount of $50,407 for the installation of this project. L07 \- 4. DENIAL OF CLAIM: BARBARA THOMAS City Attorneyts memorandum of March 28 recommended denial. Councilwoman Bart,on moved approval of the Consent Calendar. Seconded by Councilman Mangini, carried unani-mously by voice vote. OLD BUSINESS - HOTEL FIRE Councilman Pagliaro stated it had occurred to him during the Burlingame Hotel fire that city should consider a law requiring sprinklers in restaurant kitchens where residences or offices are located over them, particularly in the Broadway/Brtrlingame Avenue areas. Council agreed to consider the matter. City Manager meeting. stated a report could be ready for r:eview at an early May NEW BUSINESS - STREET REPATRS Councj-lwoman Barton stated she had noticed some pitting of the new street surf aces. Director of Public Works revi-ewed the ttremi-xtt procedure and that t.hose streets would be ttslurry sealedrr soon. This is the cityts first experience with this type of street repair and it is considerably cheaper than other procedures and we are sti11 evaluating the work, but he would have preferred the pitting had not occurred. APPEAL HEAR]NG FOR OLYMP]C CAR RENTAL Mayor Amstrup scheduled REV]EW OF 1457 BELLEVUE Councilman Pagliaro requested council Commission approval of canopy for 1457 Hearing was scheduled for April L6.
