The meeting was ca11ed to order at 8:03 p.m. by Mayor frving S. Amstrup. PLEDGE OF ALLEG]ANCE TO THE FLAG Led by City Attorney, Jerome F. Coleman. ROLL CALL -'1 COUNCILMEMBERS PRESENT : COUNCILMEMBERS ABSENT : MINUTES Minutes of the regular APPEAL OF DENIAL OF BROADWAY CONTlNUED AMSTRUP, BARTON, MANGINI, MARTIN, PAGLIARO NONE meeting of January 16, L9B4 were SPECIAL PERMIT FOR SAV]NGS AND appro ved. LOAN AT 1L74 Lee 0sborne, Mayor Amstrup 27, 1984. representing applicant, requested continued the public hearing to a continuance. the meeting of February PUBLIC HEARING REQUEST FOR CERTIFICATE OF PUBLIC CONVENlENCE AND NECESS]TY FOR TAXICABS City Attorney reviewed his memorandum of February 2 in which he recommended council take action on this request. Police had checked the driving records of the applicants for a new taxi company and found no problems. Council had also received requests from established taxicab companies for rate increase and additional taxi permits. Councilman Mangini questioned if city had cab stands, or limited number of Eaxis in city. City Attorney replled city has no cab stands as far as he knew, but it does limit number of taxis by issuing permits for each tax1. Councilman Pagliaro clarified that fees are also set by city. He questioned how staff knows the applicants are financially responsible and had appropriate experience. City Attorney replied 1f applicants can provide j-nsurance required city would consider them financially responsible. Their experience has been driving airport buses and working 1n hotels in the area. Applicants were present and could answer any council questions. Council expressed its desire to consider this new taxicab application along with other requests for established taxi companies at the next study meeting. Mayor Amstrup stated this meeting would be adjourned meeting in order to take action on the Certificate of Conven j-ence and Necessity. s tudy APPEAL OF DENIAL FOR TWO VARIANCES FOR DECK ADD]TION AT 2837 LAS P]EDRAS City Planner reviewed her memorandum of January 30 1n which she recommended council take action to either make findings and grant the variances, deny the variances, or deny without prejudice. fn 0ctober, appllcant began a 153 square foot addition to deck at rear of her house. The house is built on a hill and was surrounded by a deck which extended 10 feet from the rear and 8 feet from the side of the second story of the house. The additlon to the deck extends another 7 feet into the required rear yard. Based on a complaint from a neighbor, the building inspector notified appli-cant that she was requlred to get building permit. She submitted plans for addition in November and a site inspection in January prior to Planning Commisslon consideration showed deck had been completed. to the Pu b 11c Planning Commission denied request for variances by 5-1 vote. Speaking in favor was Richard Persing, 2833 Las Piedras, and Theresa Papa, applicant. She was not aware she needed a permit until she had completed deck; she found her orlginal deck was not large enough and while having it repaired decided to extend iE further; there is no privacy for ar,y of the properties in neighbor so she did not think she was invading privacy of neighbor; she maintains part of her neighbors property. Mayor Amstrup closed the public hearing. Council confirmed that the deck met building codes in that it was structurally sound. Council was concerned about intruding on neighbors. Mr. Mourton, who had originally complained abouL the deck, was not present. City Planner confirmed that she had visited the Mourton property and the deck was very visible from their yard. Councilman Pagliaro moved Eo uphold Planning Commission denial. Seconded by Councilman Mangini. Councilwoman Barton expressed concern about voting without hearing from Mr. Mourton. She would like to visit the site and see for herself. City Attorney stated council could continue this matter to the next meeting in order to have time to visit the site. APPEAL OF DEN]AL OF SPECIAL 333 LORTON item PERMI T AND T\4r0 VARIANCES FOR ADDITI0N AT Mayor Amstrup continued this to the meetlng of February 21. City Planner reviewed her memorandum of January 30 in which she recommended council take action after public hearing to either approve use permit and two variances, deny themr or deny without prejudice with specific instruction to applicant. Applicant John Kowalski is requesting special permit to add a second floor residential use above his exi-sting commercial establishment. He is also requesting a variance to parking 1ot standards and a variance for side yard setback. The side yard setback is required because resj-dential uses in C districts must conform to R district requirements. The residential unit is being added as a security measure. Councilman Mangini inquired of City Planner whether Kowalskirs assertion that permit was denied because he would not repair sidewalk had any merit. City Planner replied this was discussed by Planning Commission but she did not know if that was an overriding concern. Mayor Amstrup opened the pub11c hearing. John Kowalski, applicant, reviewed problems 1n parking 1ot, drinking and drug dealing. Councilman Pagliaro inquired about poor condition of driveway. Kowalski stated driveway would be repaired within 30 days, along with sidewalk. Rear yard would also be concreted with bumpers to keep cars from hitting fence which neighbor complained about. Mrs. Co1we11, property owner at L209 Be11evue, stated she was not against application but would like assurances that her fence would not be damaged as it had been in past by patrons of laundromat. She was also concerned about increasing parking in the sma11 1ot. Mayor Amstrup closed the public heari-ng. Councilwoman Barton moved to uphold the Planning Commission denial. Seconded by Councilman Pagliaro. APPOINTMENT OF COMMISSIONERS PLANN ING TRAFFIC SAFETY PARK ING Councilman Pagliaro stated he and Councilwoman Barton had interviewedapplicants for Planning Commissj-on who were all excellant and wellqualified. They dj-d feel it would be helpful to have someone withexperience on the commission. He moved appointment of Ruth Jacobs tothe Planning Commissj-on. Seconded by Councilwoman Barton, carriedunanimously by voice vote. RESOLUTION 7_84 - ACCEPTING COMPLETION OF CITY PROJECT 23I PAINTING OF WATER TANKS AT ALCAZAR AND RlVERA Councilman Pagliaro stated he represents a joint venture of one ofthese firms and would abstain from voting on the Bellevue contract. He noted he would like to see added to contracts such as these a requi-rement that they purchase liability insurance for specific limitsand the city be named as co-insured and the policy specifically statethls is primary to any and all other coverage. Councilman Mangini moved adoption of Resolutions 10-84 and 11-84 withthe addition suggested by Councilman Pagliaro. Seconded by CouncilmanMartin. Motion carried unanimously by voice vote, with CouncilmanPagliaro abstaining on Resolution 10-84. OLD BUSINESS Council noted that the 50-50 Muffler Shop is coming up for review andrequested staff check into the condition of the property. NEW BUSINESS _ REQUEST FOR FUNDS FROM CONCERNED SENIORS Council discussed request for funds for production of booklet ondiscounts available to senior citizens and agreed to allocate $375from Contingency Reserve Fund. Letter from A11an Ro11ins, Redwood City, inviting city to play slow pitch softba1l. Council referred this request to Recreation Department. 8. Resolution of City of South San Francisco authori-zing termination of Joint Exerclse of Powers Agreement for Airport Compatability. 9. Letter of congratulati-ons on city being named Tree City USA from the National Arbor Day Foundation. COMPLA]NT ON PLACEMENT OF F]RE HYDRANT Councllman Mangini acknowledged a letter from the Vielbaums, 1516 La Mesa, regarding the placement of a fire hydrant in front of their home which eliminates a parking space and creates a hazard. They requested a public hearing. Council directed staff to communlcate the hydrant and its placement in that to the Vlelbaums the need for particular area.
