RESOLUTION NO. 010-2021
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME LIMITING
THE NUMBER OF FIXED LOCATION NON -STOREFRONT CANNABIS RETAIL
DELIVERY BUSINESS OPERATOR PERMITS THAT MAY BE ISSUED PURSUANT
TO CHAPTER 25.75 OF THE BURLINGAME MUNICIPAL CODE (ZONING)
WHEREAS, on February 1, 2021, the City Council of the City of Burlingame held a duly
noticed public hearing for an ordinance that proposed changes to the types of permissible
commercial cannabis activity in Burlingame; and
WHEREAS, the proposed ordinance expressly permits the City Council to limitthe number
of commercial cannabis operator permits granted for each State license type; and
WHEREAS, following the public hearing, the City Council voted unanimously to bring the
ordinance back for second reading and adoption but directed staff to draft a resolution limiting the
number of Fixed Location Non -Storefront Cannabis Retail Delivery Business Operator Permits
that the City may issue to four; and
WHEREAS, it is also necessary to establish interim rules of priority for the above permit
applicants, which would remain in effect until such time as the City Manager adopts administrative
procedures pursuant to Section 25.75.100.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BURLINGAME DOES
RESOLVE AS FOLLOWS:
SECTION 1. The total number of Fixed Location Non -Storefront Cannabis Retail Delivery
Business Operator Permits the City may issue is hereby limited to four.
SECTION 2. The order of priority for Fixed Location Non -Storefront Cannabis Retail
Delivery Business Operator Permit applicants is determined by the date the applicant submits an
application that complies with all requirements outlined in subsection D of Burlingame Municipal
Code Section 27.75.060 — Operator Permit Requirements. The City Manager may adopt
administrative rules that amend this process of determining priority, which will supersede this
section immediately upon their adoption.
