PUBLIC HEARING - REVIEW OF PLANNING COMMISSION ACTION ON THREE SPECIAL PERMITS AND TWO VARIANCES TO LEGALIZE A SPA ROOI'{ AND DETACHED GARAGE AT 1255 BERNAL - RESOLUTION 110-86 - APPROVING TWO VARIANCES City Planner reviewed her memo of october 6 in which she reconmended council hold public hearing and take action. The appli.cant, Kay Bradley, 1s requesting three special pernits and two variances to reEai.n a spa room and detached garage built by the preyious ownerwithout zoning or building permits. The property has a cottage at the rear which is nonconforming but predates the current prohibition of second dwelling units in the R-1 zone. Tno variances are needed to retain the additlons, one for rear yard setback and one for si-de yard setback. Three special permiEs are also required, tuo for failure toprovide a four foot clearance betrreen the cottage and the new garage and beUween the garage the main house; the third permit is for an oversize accessory structure. The Planning Connission approved the two variances and denied the three special permits, requiring the renoval of the rear ten feet of the garage thus reducing the size of the structure and complying uith the required four foot eeparations. Vice Mayor Barton opened t.he public hearing. Kay Bradley, applicant, noted she had not bought the property "as isrl as staEed in the staff report if that inplied that she accepted any problems uith the property. She had been unavare of any problems. Councilmaa Amstrup noted she had a professional appraisal and that 1treported no problens with the property, he questioned the capabilityof this appralser. Bradley stated the appraiser had told her to quest j.on the forner orrrner about building pernits and the former ownerhad stated he merely closed in a carport and dj-dnrt need permits. Vj.ce Mayor Barton cl,osed the public hearing. Councj.lman Pagliaro said he had visited the eitc and was concernedabout fire safety with buildings built so close together. He hopedthere was some way to help this property owner because thesevi.olations uere not her f aul,t. He wondered if she could leave the slabfloor if the garage wal1 was moved as suggested by Planning. CityPlanner replied yes. Councilman Amstrup wished there owner for these violations. He concerns for fire safety. was had some way to called this penalize the former up because of his Councilman Lembj- stated he would like to see costs kept to a minimumfor the neu owner and would support the Planning Commission action. Councilman Lernbi. moved to uphold the Planning Commission action adoption of RES0LUII0N 110-86. Seconded by Councilnan AEstrup, carried unanimously 4-0 on ro11 call vote, Mayor Mangini being by absent. REMOVAL OE ELM TREES AT NEW AUTO DEALERSHIP ANITA ROAD City Manager reviewed the Park Directorts memo of October 1in nhich he reconmended council hold public hearing and take action. In July the City Attorney recej"ved a request to remove 9 elm trees on Anita Road in front of a new auto dealership. The request nas referred to the BeautificaEion Commission. The Commission agreed to the removal of two trees provided the applicant bear the expense of pruning the remaining trees to city specifications. The Park Director and the applicant uere presenE. Vice Mayor Barton opened the publj.c hearing. Richard Corso, representing Putnam, revi-ewed the odd size of the loti auto nanufacturerts requirenents for certain amount of space for an auto dealership are net by having second floor parking; location of ramp a11ows most parking sPaces; concern about hazards of sidewalks raised by trees; willing to replace trees with another species. Councilman Pagliaro asked the architect George Avanessian if he was aware of the irees when plans were drawn, if plans showed location of trees; Park Director Quadri noted city uas not avare that they vanted to remor,e all trees; Director of Public Works said they vere notified they vould have to appear before Beauti.fication Comnission tor lemoval of tree at ramp; then they asked for removal of all trees. Council' noted that the building proiect uas apProved four months ago by staff since it did not require any sPecj-aI pernits. Vlce Mayor Barton closed the Public hearing. Councilnan Anstrup moved to uphoJ'd the Beautification Comnission approval for removal of two trees uith condition that applicant pay foi prun:.ng the remaining trees. Seconded by Councilman Lembi uho noted the trees provide a buffer zone betveen the commercial and residential areas. Councilman Pagliaro stated the proiect should have been designed around the trees; he could apProve one tree renoval but not tvo. Motion carried 3-1 on rol"l call vote, Councilnan Pagliaro Yoting no. REVIEW OF CITIZEN COMPLA]NTS ABOUT LOUDSPEAKER USE BY AUTO DEALERS city Attorney reviewed his nemo of october 1in which he recomnended council review complaints of loudspeaker use uith Putnam auto representative. Councilnan Pagliaro noted he had asked that this be reiiewert as people are complai-ning about loudspeaker use after 10 p.n. Richard Corso reviewed Putnanrs policy of no speaker use This policy has been reviened with employees; he dj-d not conpliints nere for his dealership. REAPPOINTMENTS TO BEAUTIFICATION AND PARK AND RECREATION COMMISSIONS City Managerrs meno of Septenber 19 lnforned council that Ehree positi.ons on both the Beautification Commission and the Park and Recreation Commission expire 0ctober 7, 1986. Jeanni.e Ha11 Gilmore and Nancy Lindstron are conpleting their f j-rst terms and can bereappointed. The other persons nay continue to serve until they arereplaced. Council wilL be discussing commission appointments at thenext study meeting. Councilman Lenbi moved to reappoint Jeannj-e Ha11 Gilmore toBeautification and Nancy Lindstron to Park and Recreation. by Councilman Amstrup, carried unaninously by voice vote. Seconded COUNCIL AUDIT COMMITTEE REPRESENTATIVES City Managerrs memo of September 23 recommended council appoint tuo nembers to staE ement s Councilnan meet with the auditors to review the draft financiaL and management letter. Last year Mayor Mangini and Amstrup were the representatives. CONSENT CALENDAR Councilnan Lembi inquired about the plans for the Washington Park grandstand, Park Director replied the item on the agenda is just for State grant funds, plans are not complete yet. CounciLman Amstrup noted the award of bid for Pershing School park and cityrs comnitment to open space; Park Director said construction should begin in three weeks. Councilman Pagliaro questioned the necessity of sending tHo people on these trips. Fire Chief noted one person was needed to review chassis design and one was for mechanical revj-ew and instruction. j APPROVAL OF NEW LIBRARY TELEPHONE SYSTEM City Librarian's memo of September 30 recomnended council approve replacenent of the library telephone system uith an AT&T system in the amount of $14,938. Councilman Pagliaro questioned the necessity of replacing a system that is only four years o1d. City Llbrarian revieved the library needs for an electronic system with more capabilities such as automatically sending an unanslrered call to another phone station and vith public address capabilitiesi the past j-mprovement was to change from dial to touch-tone, but paging, number of 1i-nes and call transfer capability of the systen remained the same. h. 1 m. 453 City Manager stated Lhe cost is comparable to the city hall system that was installed a year ago. Staff will research the answer. OLD BUSINESS 911 Councilman Amstrup not.ed a call he had received from a person who experienced a delay after an emergency call to 911. City Manager and Police Chief responded that there had been a problem with AT&T computer and that it would be resolved shortly. S U N DAY CONSTRUCTION WORK Vice Mayor Barton noted a complaint she received from a resident on Donnelly who was disturbed by construction work early Sunday morning. The construction crew said they had a special permit to work at that time. Staff noted the hours for construction on Sunday are 10 a.m. to 6 p.m. Barton asked that this issue be on a sLudy meeting agenda, perhaps ciLy should consider prohibiting consLruction on Sunday. PARKING ON LAWNS Councilnan Pagliaro commented on a letter City Attorney had sent to a resident about parking on lawn area. He asked that the prohibition of parking on unpaved area of property be put on a future sLudy meeting agenda. AGENDA ORDER Councilman Lembi asked wheLher council could consider putting thettFrom the Floorrr portion of the agenda at the beginning of the agenda so that people dontt have to wait through an entire meeting to make a sLatement to the council. 0ther council members worried about the delays this might cause during a lengthy or controversial meeting. FRAGRANCE GARDEN SIGN Vice Mayor Barton wondered what happened to Garden. Park Director replied that it will REVIEW HEARING the sign ln be replaced the Fragrance shortly.
