The meeting was called to order at 8 p.m. by Mayor R. David Martin. PLEDGE OF ALLEGIANCE TO THE FLAG Led by Boy Scout Troop 70. ROLL CALL COUNC I LMEMB ERS COUNCI LMEMBERS MINUTES I,linutes of the SCHEDULE APPEAL PRESENT: ABS ENT : AMSTRUP, BARTON, MANGINI, MARTIN, PAGLIARO NONE Regular Meeting of March 18, 1985 were approved. HEARING RESIDENTIAL USE AT 333 LORTON Mayor Martj-n noted a letter requesting an appeal hearlng of the Planning Commissionfs denial for special permit to a11ow residential use at 333 Lorton. Hearing was scheduled for April 15 meeting. PUBLIC HEARING - SECOND READING ORDINANCE ROLLINS ROAD MULTIPLE FAMILY SUBZONE }30O -ESTABLISHING City Planner reviewed her memorandum of March 25 in which she recommended councj-1 hold public hearlng and take action. She reviewed previous council action and Planning Commission action; recommendations of the Planning Commission to create an overlay R*3 zone; the request of several resi.dents to close the pedestrian walk between Rollins and Lexington aL the end of Channing trrlay. This ordinance does not address the closing of the walkway, that would take separate action. Councilman Mangini questioned the provision requiring no more than 50 percent of front setback be paved. City Planner replied that a front entrance walkway and a driveway can cover no more than half the front setback area, the remainder of the front. yard must be in soft landscaping. I"layor Martin opened the public hearing. Edward Marcinak, 325 Clarendon and owner of a 1ot in that area, inquired if council could also include his 1ot in the rezoning. He owns APN 029-185-050 which is a landlocked parcel without street access. He is j-n the process of trying to buy property on Rollins in order to gain access to his 1and. If he does so he would like to develop it in a mul-tip1e dwe11ing. He does not want to buy Rollins property if his parcel will noL be rezoned. When he bought it it was zoned R-4, while he was in the servj-ce the zoning was changed to R-1. City Planner and City Attorney reviewed in response to council questions that Marcinakrs land is R-1 and there are several other lots like his; that this property was not included in the noticing of adjacent property owners for change and inclusi-on in the overlay area so could not be acted upon tonighE. Mayor Martln told Marcinak that he could come back to city with request for rezoning when he acquires access to his parcel; that Marcinak might buy more property on the contingency that his 1ot would be rezoned. Bud Harrison, 376 Lexington, spoke in favor of the ordinance. Mayor Martin closed the public hearing. Councilman Amstrup moved adoption of 0RDINANCE 1300 with the condition 233 that council conslder the closing of the walkway from Rollins to Lexington. Seconded by Councilman Pagliaro, carried unanimously by ro11 call vote. City Attorney noted that the walkway belongs to have to notice the adjacent property owners and before closing. the city. Councilman of closure. a public hearing on the closure of would like more facts on the subject to hold Amstrup PUBLIC HEARING - SECOND READING ORDINANCE 1301 STANDARDS AND REQUIREMENTS FOR-HqME OCCUPAT]ONS ESTABL ] SH]NG City Planner reviewed her memo of March 25 in which she recommended council hold public hearing and take action. She reviewed previous council and Planning Commission action and study; this ordinance adds a chapter to the zoning code to replace the present provisions addressing home occupations in residential districts. Councilman Pagliaro had a concern about the parking provisions for home occupations; the provision mentioned in the staff report that home occupations using an attached or detached garage require a use permit addresses the providing of parking for the home. He noted that the ordinance does not appear to address parking need for employees or people attending a c1ass. He wondered if some provision could be made in the use permit application to address these requirements for parking. He was concerned that someone teaching a class with a number of people in it could rea11y congest a neighborhood. Councilman Amstrup wondered if people who currently have a home occupation and use their garage would have to get a use permit. City Planner replied that there is a grandfather clause in the ordinance to exempt current licensees. Mayor Martin opened the public hearing. There being no comments, the hearing was closed. Councilman Mangini moved adoption of 0RDINANCE 1301. Councilwoman Barton, carried unanimously by ro11 call Seconded by vote. RESOLUT ION TASK FORCE 3O-85 _ AUTHORIZING JOINT POWERS AGREEMENT FOR NARCOTICS City Manager reviewed his memo of March 25 in which he recommended council approve a joint pohrers agreement to form a county narcotics task force. 0ur Police Chief proposes to assign a Burlingame officer to the task force in lieu of our $32,400 annual contribution. He noLed the county Board of Supervisors approved the agreement last week. Councj-lman Pagliaro had some concerns about the i-nsurance clauses in the agreement. It appeared that an injured officer could claim workerts compensation through his city and also sue the joint powers agency. If so, the city would be paying twice. Mayor Martin agreed this was a concern and should be clarified. Councilman Pagliaro suggested staff relay this concern to the agency. Councilman Manglni moved adoption of RESOLUTI0N 30-85. Seconded by Councilwoman Barton. Mayor Martin requested staff inquire into the insurance provisi-ons. Motion carried unanimously by ro11 call vote. CHAi"IBER OF BURL INGAME COI'IMERCE AVEN UE REQUEST FOR YEAR-AROUND LIGHTS ON TREES ON City Manager reviewed his memo of March 25 in which he recommended council review the Chamberts proposal to have permanent lights on the trees on Burlingame Avenue. 0riginally the Chamber wanted to install lights on all the trees as had been proposed for the Christmas season but city determined if this is done on a permanent basis the wiring would have to be installed in the trees with underground conduit. The Chamber could not afford to do this so they are proposing to use just the trees at each end of the business district where permanent wiring is available. The Chamber will pay the cost of installation, malntenance and removal of lights for tree trimming. 234 Council discussed with Chamber director, Karen the proposal. REVIEW AND ACCEPTANCE OF C]VIL SERVICE OF A POLICE DISPATCHER FIND]NGS ON ONE-DAY SUSPENSION City Attorney reviewed the memo of March 20 which recommended council review the findings and affirm, reverse of modify the decision of the Civil Service Commission. Sharon Co11ett, a police dispatcher, received a one-day suspension for violating department ru1es. She appealed the suspension which the Civl1 Service Commission upheld after an appeal hearing, finding repeated offensive conduct toward a fe11ow employee which is a violation of Civil Service Rul-e IIB-2. Chief of Police reviewed the case for council. Mayor Martin questioned why two disciplinary same day. He also stated the city needs to procedures very strictly. CONSENT CALENDAR Councilman Mangini questioned if the item on trrleed and Rubbish Abatement included city property. Director of Public l,ilorks replied the city would clear its own property. Councilman Pagliaro wondered if Southern Pacific property would be posted for weed removal as the private property was posted. Director of Public Works replied it had not been posted in previous years but it could be done. Mayor Martin wondered if highway property could be cleared, state should be noti-fied about the weeds on Rollins Road. PUBL]C EORUM ON LEACHATE BERM OFF A]RPORT BLVD Council-man Pagliaro requested City Planner review this public forum. City Planner stated that Planning Commission review of the Notice of Preparation is standard procedure for a major city project being reviewed for an EIR. Councilman Pagliaro would like to have some issues addressed that were not mentioned by Planning Commission.
