The meeting was caIled to order at 7:30p.m. by Vice Mayor Barton. PRESENT: COI,NCILMEMBERS AMSTRUP, BARTON, LEMBI , PAGLIARo ABSENT: MAYOR MANGINI STAFF PRESENT: ARGYRES, COLEMAN, KIRKUP, BECKER, BERGSING Vice Mayor Barton opened the adj ourned Regular Meeting. EXTENSION OF MORATORIUM ON SATELLIT E ANTENNAS ORDINAI,ICE REGULATING ANTENNAS PROPOSED 1985-87 BUDGET OVERV IEW ORDINANCE LIMITING COI'NCI L EXPENSE REII/IBURSEMENTS The City Attorney reviewed his staff report concerning the recent ECCregulations limiting local ordinances and tvro possible approaches toamend our current ordj-nance to comply $rith the fCC regulilions. Oneexample would prohj_bit all antennas except those on a roof and notexceeding five feet above any roof surface, and a second wouldprohibit antennas within setback side yards, rear yards, but allowsatellite antennas in back yards under certain resirictions includinga six foot height timit from ground Iever. The council discussed thepros and the cons of both approaches. The general feeling was thatcouncil would aLlow satellite antennas so rong as they cannot be seenfrom the first floor of adjacent neighbors or the public street. Theyreqgested the City Attorney expand the language on example B toinclude visual- screening of satellite antennai. The CiLy Attorneyarso asked council direction concerning ham radio antennas. counEilfelt these should be regulated by a special permit on number andheight. Staff will revise the proposed ordinance and return it tocouncil for a Regular Meeting. The city Attorney reviewed his staff report requesting an extension ofthe current moratorium on satellite antennas which wai due to expireMay 22nd. He indicated the council would be considering variousalternatives for regulating satellite antennas later at the StudyMeeting, but that it would take approximately GO days to finaliz;whatever the direction the council wishes. Vice Mayor Barton openedthe public hearing on the ordinance extending the moratorium onsatellite antennas. No one from the public wished to speak for oragainst the proposed ordinance so the public hearing was closed.Councilman Amstrup moved for adoption of Ordinance 1325 extending amoratorium on satellite antennas for 50 days. Councilman pagliaio seconded the motion and it was carried unanimously by those memberspresent. Vice Mayor Barton then closed the adjourned Regular Meetingat 7:35 p.m. and opened the Study Meeting. Budget chairman Amstrup passed out his brief comments concerning theproposed budget. council agreed that the budget study session wouldbe June 11, 1985 and they would drop the reguiarly scheduled. June lgthmeeting. Councilman pagliaro asked the City Manager to brieflyexplail the proposed bond issue suggested in the budget. City Managerrelayed that under current proposed legislation in Congress iL isenvisioned that any such bond issue woul"d be tax exempt. Since.Mayor Mangini was not at this meeting, council agreed to derayany final consideration on this matter until another sf.udy date.Councilman pagliaro indicated that he did suggest a changE in the 1 398 proposed ordinance so that the Mayor or Mayor pro tem would be exemptfor certain expenditures. councilman Amstrup indicated that he feltthat one councilmember should not be held responsible by other councilmembers for expenditures, but that his primary responsibility was to the public. He indicated that it might be possible to revise our procedures for rrrarrants to receive council approval before actual pa!'ment to councj.Imembers. Vice Mayor Barton stated that she had asked the City Manager for a breakdown of expenses for the past twoyears and that this clearly showed that no abuse was occurring. Shealso stated that she felt that Burlingame needed to be represented atvarious league meetings and that the ordinance as proposed discouraged ^, this. Councilman Pagliaro indicated that he felt it was not askingtoo much to have the individual councilmembers receive approval fromthe majority of the council prior to incurring expenditures over acertain limit. Council agreed to continue this discussion at another Study Meeting. PARKING USER CHARGES/POSSIBLE SITES ADDITIONAL PARK]NG The City Manager reviewed the possible alternatives for raising userfees and a brief history of the current situation. CouncilmanPagliaro indicated that he feLt it t"rould be acceptable to increase standard citation fees from $5 to $7. The council agreed with thissuggestion. Vice Mayor Barton indicated that she felt that it waspsychologically good to keep free parking on Burlingame Avenue andBroadway. Councilman Lembi inquired as to the cost of additionalparking enforcement enforcement. Councipossibility of some enforcement. He felt that the parking users should helpsupply the parking. Councilman Pagliaro agreed that this was aproblem that needed to be Iooked into. Councilman Lembi felt that we needed to be cautious about increasing costs to downtown business because business is currently leaving the area due to lack of parking. Councilman Lembi felt that the current 25 cents al-L day parking shouldbe increased to $1 for all day except in the Southern Pacific Iotalong California. The council concurred with this approach. He feltthat he would be in favor of L0 cents per hour meters on all sidestreets. Vice Mayor Barton agreed that psychologically it wasimportant to have Burlingame Avenue and Broadway free, but that meterson the side streets would improve enforcement. Council asked for the Chamber of Comnerce opinion on this approach and they concurred thatit seemed appropriate. Councilman Pagliaro also requested that \"re needed to look at the parking problem along Broadway and asked thatthe staff bring back the map of possible additional parking spaces inthat area. He stated that he felt the property at 1237 Bellevue wasclearly the best potential acquisition for the City since it increasedparking by 82 spaces and provided for possible future structure. Council reviewed the past reluctance of the property owner to sell itto the City. Councilman Lembi and Vice Mayor Barton agreed to approach the owner to discuss this matter. STATUS DUNCAN LIBRARY TRUST The City Attorney reviewed his report on this matter and the conditions of the will which established a trust for the benefit ofthe City Library to be administered by the Peninsula CommunityFoundation. Bill Nagle, Chairman of the Library Board, reviewed thehistory of the negotiations with the Peninsula community Foundation and the compromised proposal which the Library Board has endorsed. This proposal caIIs for the Library to have free use of the secondstory of the Duncan property at the expiration of the current lease and provides that in ten years the City would have the option ofpurchasing the property or leasing the first floor for Librarypurposes. Council concurred with this approach and directed that we f inalj-ze the proposed agreement between the PeninsuLa corununity Foundation and the City. PRIVATE SEWER LATERAL REPAIR The PubLic Works Director reviewed his report on the proposed ordinance which would try and correct the current infiltration problem from private sewer latera1s. The proposed ordinance provided for a procedure of notice and hearing if a leaking lateral is found and requiring the owner to make repairs or for the City to repair theIateral and provide for extended palment for up to 5 years for senior citizens on fixed incomes. The ordinance also required the testing and repair of laterals on sale of buildings over 25 years old. Based on a question from Councilman Lembi the Public works Director stated that the average cost of repairs should be approximately $L,000 although this depends greatly on the location of the sewer lateral and other factors. Council concurred with the approach of the proposed ordinance and directed staff to prepare the matter for public hearing. LEASE SOUTHERN PORTION BURLINGAIIIE AVENUE TRAIN STATION The city Manager indicated that Caltrans has indicated that the southern portion of the train station would be availabl-e for lease by the City for $380 per month plus approximately $10,000 in relocationcosts. The council indicated that it felt this property should be used for some civic use and directed staff to explore this matterfurther. councilman Pagliaro asked that we obtain information on the length of the proposed lease and also inquire of caltrans if the State would consider selling the station to the city. CLARIFICATION ''TAKE OUTIT USES The city Attorney reviewed the question of interpretation concernj-ng delicatessens under our take out service regulation. Question was whether council intended for delicatessens to be considered as take out establishments and thereby requiring a special use permit. The council indicated that they felt that they did need control of this matter and Councilman Pagliaro felt that there were two issuesinvolved. one being the take out use and the other as to whether delicatessens might be considered as restaurants. After considerable discussion the council felt that a special use permit would be neededfor delicatessens as take out service and that the city needs to re- define our restaurant limitations on Burlingame Avenue and Broadway to address this type of situation. City Attorney wi1J. review the matter with staff and make suggestions to the council. OTHER city Manager asked if any councilmember was available to attend a meeting of the joint powers authority on garbage collection on May 28th at San CarLos city HalI. No member of the council was availableto attend and they directed that staff attend in their p1ace. The city Manager advised council that city Treasurer, Herb Sonuner, has 3 400 submitted a letter indicating his intent to resignof Treasurer. Based on a discussion with the City agreed to continue until June 30th of this year ornecessary. The City Attorney has prepared a brief concerning the council options of appointment of acalling for a special election. from the position Ireasurer, he has longer if memorandum new Treasurbr or Councilman Pagliaro brought up one other item concerning the Banyon Bay property. He asked the City Attorney as to whether or not theproperty is non-conforming since it has been vacant for six months. The City Attorney indicated that he felt that the six month period commenced at the end of the bankruptcy proceedings, and because theproperty had been leased within that time, the property was not non-conforming. After some discussion, Councilman Pagliaro asked the CityAttorney to give him a legal opinion or some case citation to supportthis interpretation of the code concerning non-conforming uses.
