The meeting was cal1ed to order at B p.m. by Mayor R. David Martin. PLEDGE OF ALLEGIANCE TO THE FLAG Led by Boy Scout Troop 70. ROLL CALL COUNCILMEMBERS PRESENT :AMSTRUP, BARTON, MANG]N], MARTIN PAGLIARO (1ate due to being sworn i-nto a county office in Redwood City, arrived at B:53 p.m.) COUNCILMEMBERS ABSENT: NONE M]NUTES Minutes of the Regular Meetlng of STATEMENT BY MAYOR REGARDING CITY L9B4 were approved.December 3, EMPLOYEES Mayor Martin noted he had attended a function at the Burlingame Recreation Center on December L4 and upon leaving he saw the Police Chief and City Manager chasing what turned out to be a robbery suspect. Several police cars responded and the suspect was apprehended. He commended their courage but jokingly questioned what the City Manager would have done if he had caught the suspect. City Manager replied he hadn't thought about that possibility. POSTPONE PUBLIC HEAR]NG ON REZONING OF ROLLINS ROAD Mayor Martin noted city had received a request from a property owners requesting a postponement in order to public hearing. Hearing was set for January 27, 1985 group of prepare meeting. for this PUBLIC HEARING _ APPEAL OF DEN]AL OF A SPECIAL PERMIT FOR PIZZA RESTAURANT AT 1199 BROADWAY City Planner reviewed her memo of December 79 in which she recommended council hold public hearing and take action on the appeal. The applicant, Richard Monasteri, has applied for a special use permit to operate a pizza restaurant in a new commercial building. The use permit is required because of the parking variance granted in February 7984. A condition required all uses to have a use permit. Mayor Martin opened the public hearing. Richard Monasteri-, applicant, reviewed conducted in the area. He felt there parking. the parki-ng count s he had would be no problems with Albert Kapkin, 110 Park Road, spo-ke in favor. Juan Santero, new owner of the Village Host, was concerned aboutparking. A large restaurant would impact the parking on Broadway. Larry Speckman, 843 Crossway, had major concerns about parking. It takes him 20 minutes to find a place to park on Broadway. The accessto and from the freeway impacts the street. She sympathized with the owner but noted he was aware of the problems before he bui1t. She moved to uphold thePlanning Commission's denial. Seconded by Councilman Amstrup. Motion carried absent. unanimously on ro11 call vote, Councilrnan Pagliaro PUBL]C HEARING LICENSE FEES SECOND READING ORDINANCE 1292 TNCREASING DOG City Attorney briefly reviewed his memo of November 26 requesting council adopt ordinance as part of cityts contract. with County foranimal control services. Dog licenses will increase from $12 to $fOfor an unaltered dog, from $6 to $B for an altered dog, and from $2 to $S for a duplicate tag. Mayor Martin opened hearing was closed. Councilman Amstrup moved adoption of 0RDINANCE Councilman Mangini, carried unanimously on ro11Pagliaro absent. PUBLIC HEARING - INTRODUCTION OF AND ZON]NG I,IAPS BY RECLASSIFYING FROM R 3 (THIRD RESIDENT]AL) TO C t292. ca1 1 Seconded by vote, Counc j-1man ORDINANCE 1293 AMENDING THE CODE CERTAIN PARCELS ON SAN MATEO AVENUE2 (SERVICE BUSINESS) City Planner reviewed her memo of December L7 , l9B4 in which she recommended council hold public hearing and introduce the ordinance.In 0ctober L984 council acted on an amendment to the General Plan which changed the lanri use designation for three parcels on San Mateo Avenue from medium high density residential to servi-ce and special sales commercial. These parcels are currently developed 1n commercial USES. Mayor Martin opened the public hearing. There being no comments, thehearing was closed. City Planner noted tirat all property owners within 500 feet of theparcels were noticed of the public hearing. Councilman Amstrup introduced ORDINANCE 1293 for its first reading. ROLLINS ROAD Mayor Martin noted the presence of former councilmember Bud Harrlsonin the audience. Mr. Harrison had an interest 1n the rezoning ofRollins Road area and asked if property owners would be noticed aboutthe postponment of the hearing. Mayor Martin stated they would not be since most property owners appeared to have been present at this meeting and so are aware of the postponement and that the press would also make people aware. Council discussed with staff, city did have a fairly regular sweeping at one time when it had two street sweepers. Now city only has one sweeper and if a person is i11 or sweeper is down a schedule would be difficult to keep. City now concentrates on areas with most leaves. Council concensus was to leave sweeping the way it is at present. BEAUT]FICATION/PENT AND RECREATION COMMISS]ONS PURCHASE PERSHING SCHOOL SITE RECOMMENDATION TO Mayor Martin noted council would Study Meeting. COUNC]LMAN PAGLIARO PRESENT Councilman Pagliaro arrived at 8:53 p. m. RESIDENTS CONCERNS ABOUT FUTURE USE OF 325 CHAPIN LANE City Planner revi-ewed her memo of January 3,1985 requested council review letters from residents and take action. Residents were concerned that this large 1ot would be divided into four 1ots. The owner recently died and left the property to Stanford University. Les Gunther,333 Chapin, told council he did not object to 1ot being divided into two 1ots, but would object Lo dividing into four. This is an o1d neighborhood with large houses and 1ots. After some discussion, Councilman Pagliaro suggested council refer to Planning Commission for a recommendation. Council concurred. STREET VENDORS REFER TO NEXT MEETlNG City Attorney revj.ewed his memo of January 2,1985 in which he reviewed a hot dog cart business in the Plaza area. Since city has another street vendor operaEing in Burlingame Avenue area, he has requested applications from both vendors and suggested council hear requests at its next meeting. FOR EIR I S City Attorneyts memo of December 18 reviewed his investigation into errors and ommissi-ons insurance for consultants preparing EIRs. He recommended counci-1 not require this insurance due to high costs. Councilman Pagliaro was of a dj-fferent opinion, he noted doctors andlawyers are required to have this type of insurance and he felt it necessary for a firm doing EIRs. Council discussed this would limit number of firms city could deal with for EIRs as only very large firms carry this insurance. Drive would be resurfaced Public Works reviewed undergrounding project is end of 1985 or early NEW BUSINESS URGENCY ORDINANCE T294 MORATORIUM ON RESTAURANTS Councllman Amstrup noted City Attorney had prepared an Urgency 0rdinance Imposing a Moratorium on Restaurants at hls request. City Attorney reviewed the ordinance and noted that it was only effective for 45 days due to new legj-slation but it may be extended beyond that period for up to one year after notice and a public hearing. It would require four-fifths voLe to be adopted. Council discussed at length: noting many requests to stop the many restaurants coming 1n; areas needing protection were Burlingame Avenue area and Broadway Avenue area; need for further study or study by Planning Commission; need to take action immediately, can schedule public hearing and extension after. Councilman Pagli-aro could not find this issue a cause for an urgency ordinance, what have restaurants to do with the public peace, safety and welfare. City Attorney noted that the parking impact of restaurants was the cause for urgency ordinance. Councilwoman Barton moved adoption of URGENCY ORDINANCE L294 adding wording to define areas covered as the Burlingame Avenue Commercial Sub-Area A and the Broadway Commercial Area, including lots fronting California Drive between Rhinette and Carmelita. Seconded by Councilman Amstrup. Motion carrj-ed on ro11 call vote, Councilman Pagliaro voting no.
