PUBLIC HEARING - SECOND EXPANSION AND RELOCATION READING - ORDINANCE I321 OF FOOD ESTABLISHMENTS REGULATING City Attorney reviewed his memo of April 14 in whj.ch he recomnendedcouncll hold a public hearing and take action. At a recent studymeeting council diecussed our current ordinance limiting resEaurantsin the Burlingame Avenue and Broadway commercial areas. This o1dordinance does not control Ehe expansion of existing restaurants orthe relocation of existing restaurants into l-arger sites. Theproposed ordinance would require a special pernit for the expansion orrelocation of a food establishment. Mayor Mangini opened the public hearing. There being no corments, thehearing was closed. Councilwoman Ba rt on Councilman Anstrup, PUBLIC HEARING INSURANCE FUND - SECOND READING - ORDINANCE 1322 REQUIREMENTS moved adoption of ORDINANCE 1321. Seconded bycarried unanimously 5-0 by ro11 call- vote. AMENDING SPECIAL City Manager reviewed Finance Directorts memos of Aprit 11 and April30 in rchich he reconmended council hoLd publi.c hearing and takeactj-on. The April 30 nemo responds to questions raised at the lastmeeting about the i.ncreases recommended for the general liabilityclaims reserves, Staff recomnends increasing the reserves from $300,000 to $600,000. Staff also recomnends increasing the annualcontriburion for liability fron $350,000 ro $450,000. Councilman Pagliaro sti11 questioned the advisability of proceedingwith this issue now. He felt that once the speci.al fund isestablished the funds cannot be used for any other purpose. He alsoobjected to the potential of double coverage. Other council menbers saw no problens. Staff reviewed the claims adjuster's figures ontotal clains costs, the figures are an opini"on based upon experience. Mayor Mangi.ni opened the public hearing. There beinghearing was closed. no connents, the 389 Councilman amount of Anstrup reserves carried 4-1 on ORDINANCE 1323 ro11 call vote, Councilnan Pagliaro voting no. - AMENDING PARKING REGULATIONS ON CAROLAN AVENUE Director of Public Works reviewed his nemo of April 16 in r'rhich he recomnended council hold a public hearing and take action. This will conti.nue the "no parkingrr regulations on the west side of Carolan except in the nev parking area and will restrict parking at nighE. Councilman Lembi wondered how the hours for parking were deteroined. DPW replied after study of residents and auto rorkers in that area; he also reviewed the other parking provi.ded by the auto agencies and wiLl report back to council after this new parking 1s established on other private parking provisions of the auto agencies. Mayor Mangini opened the public hearing. There being no comments, the hearing was closed. Councilnan Lenbi. noved adoption of ORDINANCE 1323. Seconded by Councilman Anstrup, carried unanimously by ro11 call vote. PUBLIC HEARING - RESOLUTION JoB 615 49-86 - 1986 WEED AND RUBBISH ABATEMENT Director of Public Works reviewed nemo of April 26 in which staff recommended council hold public hearing and approve the resolution. Lands to be abated have blen posted, after the hearing council should order the destruction of veeds and renoval of rubbish. councilnan Pagliaro inquired if southern Pacific property had been posted, DPW replied yes. Staff reviewed the properties posted' bounciiman Amslrup wondered about the dirt and plywood debris aE the gas station site it Broadway and California. DPW reviewed they are iemoving leaking gas storage tank and the contaninated dirt. Mayor Mangini opened the public hearing' Dorothy Katz, 1J-10 Douglas, reviewed the 1ltter and rubbish around the apartnlnt house she lives in; the business okrner next door takes no responsibility for his property, 1s most negligent, and has no pride in the community. council noted it has heard complaints about this property beforel city Attorney will report back to council-. PUBLIC HEARING - TENTATIVE AND FINAL MAP FOR COMBINATION OF LOTS AT 1440 CHAPIN AVENUB City Planner reviewed her memo of April 29 in which she recomnended council hold public hearing and take actlon. This map would nerge three parcels which conpose the vacant land at 1440 Chapin so that single structure can be built on them. Seconded call vote.by Councilwoman Barton, carried unanimously RESOLUTION 50-86 LEASE AGREEMENT EOR HISTORICAL SOCIETY USE OFCARRIAGE HOU SE IN i,IASHINGTON P ARK City Manager reviewed his memo of April 30 in which he recommended council approve the six month lease for Ehe Historical Societyts use of the second floor of the Gunst Carriage House in Washington Park. The insurance requirements will cost the Society about $900 per year. City will expend approximately $16,300 in modifications to the building for code conpliance before it can be occupied. Councilman Anstrup moved adoption of RESOLUTI0N 50-86 and approval of funds for building rnod j.f ications. Seconded by Councilwoman Barton, carried unaninously by ro11 call vote. CONVERSION OF NINE PARK]NG SPACES TO TEN HOUR PARKING IN LOT C on 29 Lot Director of Public Works reviewed the City EngiDeerts Eemo of Aprilin which he recommended council- concur with Traffic, Safety and Parking Conmission and authorize this conversion of nine spaces in C from 2 hour to 10 hour parking to accommodate enployee parking inthat area. Councilman Pagliaro had concerns about commuter use of these spaces; he wondered what time the 10 hour parking starts, DPW noted police enforcenent of parking is from 8 a.m. to 6 p.n.; Pagliaro suggestedthe 1"0 hour period start later in the morning so that comnuters cannottake advantage of the parking, or that the period be for 8 hours which would preclude commuters t use. Other council agreed that conmuters couLd be a problem. Staff noted this parking would be nonitored and if there are any problems counciL can change itl merchants will be first to Let city know if conmuters are using lot C. Council-man Lembi moved to authorize conversion of nine spaces in Lot Cfrom 2 hour to 10 hour parking. Seconded by CounciJ-woman Barton,carried 4-1 on ro11 call vote, Councilnan Pagliaro voting no. REPORT ON STATUS OF BFI FRANCHISE RENEIJAL STUDY Council acknowledged City Managerts meno of April 30 which revienedthe progress of t.he franchise renewal study. An information meetingis recommended for City Council nenbers of all JPA cities on May 28. CONSENT CALENDAR Councilman Amstrup had a question on item rra. 0rdinance Anending Minor Modi-f lcations.rr He suggested removing section ttitt from that ordinance having to do with allowing staff review of garages up to 600 squarefeeE in size, he thought 500 square feet was an adequate size. Counci-lman Lembi wondered if council uas not being too conservati.rre,older homes have 1ittle storage and people need larger garages thesedays. CounciL decided further discussion should take place at thepublic hearing.
