City Attorney revlewed his meno of February 26 in which he recommended
council- hold a public hearing and take action. At a recent meeting
council heard public concerns about skateboards on city streets; there
uas particular concern about sEeep streets Yhere they have become
serious hazards to drivers, pedestrlans and themselves. This
ordinance will treat skateboards as vehiclesi not a1low riding at
nj.ght, traveling abreast on the street or riding in public parks or
playgrounds and parklng 1ots, and not a l1ow more than one person on a
skateboard or sitting or lying upon a skateboard.
Council-man Pagliaro asked for a definition of Ehe business district
referred to in the ordinance; City Attorney replied this is the C-I
zone around Broadway and Burli.ngame Avenues. Councilnan Amstrup read
a newsletter from the Burlingame Elenentary School District regarding
banning skateboards from schools.
Mayor Mangini opened the public hearing.

Council agreed to a change adding 'rcityrr to section (f) further
defining parking 1ots.
Councilwoman Barton moved to adopt ORDINANCE 1316 with addition of
word "city" to section (f). Seconded by Councilman Amstrup.
CounciLman Lembi noted he would vote yes, but he did not approve of
restricting skateboards from city parks, werre limiting too nuch.
CounciLman Pagliaro sald he wouLd vote no because he wouldnrt restrict
use in parks or parking lots and he would not prohibit ni.ght riding.

ORDINANCE 1315 ADOPTING 1985 I'IRE CODE HEARING POSTPONED
City Manager revj.ewed Fire Chiefts memo of February 6 in which herequested council hol,d public hearing and adopt the 1985 Uniforn Fire
Code. This would affect three high rj.se buildings; the Anfac Hotel,
Ehe Sheraton Hotel and the Westates Building (851 Burlvay).
Dan Fenton of the Anfac Hotel requested a two week extensi-on beforeconsideration so the hotel can better prepare for the public hearing.Council discussed at lengthl Councilwoman Barton and CouncilnanPagliaro saw no need for a de1ay, the oyners of these buildings have
been aware of tonightrs hearing for some time.
Mayor Mangini moved to grant an extension until the next meeting.
Seconded by Councilman Amstrup. Motion carried 3-2 on ro11 call vote,
Councilwonan Barton and Councilman Pagliaro voting no.
PUBLIC HEARING - APPEAL OF TWO SPECIAL PERMITS FOR DOMINO PIZZA AT
SAME224 CALIFORNIA DRIVE - RESOLUTION 30-86 APPROVING
Planner Willians reviewed the City Plannerts neno of March 3 in whichshe recommended council hold publi.c hearing and take action.Applicant is requesting two special permits to open a take-out anddelivery plzza food service in Sub-Area D of the Burlingane Avenue
Commercial Area. Use pernj-ts are required for take-out and deliveryfood service as well as for non auto related businesses in this area.
This business uould operate from 4 p.m. to nidnight Monday throughFriday, 11 a.n. to 1 a.m. on Saturday and 1L a.n. to midnight onSunday. There is no customer seating on the prenises and 95 percentof the business will be by delivery. They plan to have one deliveryvan at the present tine, other delivery people will deliver in their
own cars. There is no parking ava11ab1e on site.
Mayor Mangini opened the public hearing.
Frank Albers, applicant, stated since his busi-ness will not open until4 p.r. it would not impac! parking in that area. Kevin Kanady,realtor, stated he had been trying to find an auto related businessfor that site for a year but to date no one wants to rent the store.He felt this business would be best for the si-te because theirbusiness would be at night, while the other stores in building operateduring the day. He also stated one of the neighboring stores has
agreed to aLlow ALbers to park delivery vans in its parking spaceduring pizza parlor operating hours.

He felt this business would have the least impact on parki.ng. Heurged approval.
Speaking in opposition was Alan Horn who opposed any fast food
business in the business district.

Councilwoman Barton moved to reverse the Planning Commission and adopt
RESoLUTI0N 30-86 ApprovinS the two special permits uith conditions in
staff report. Seconded by Councilman Lembi who noted he had some
concern about the sna11 number of ernployees in the conditions; he
inquired of applicanE if there might be nore. After sone discussion,
council changed the number of employees from 3 to 5 delivery people on
Friday nights, their busiest night.
Councilman Pagliaro reviewed the personnel list uj-th Al,bers; he also
wondered where the employee cars would park. Parking around the site
was reviewed and Albers noted a neighboring business has agreed to 1et
him use their parking spoLs. Councilman Amstrup wondered how many
trucks would be left on the site, Albers said none. Council determined
number of employees on site and nunber of cars, one delivery van and
employee cars which will also be used for delivery; delivery van would
be kept at Albers hone and picked up by manager each day, not left on
site. CounciLnan Pagliaro said he r.rould like to see a condition that
privaLe parklng be provided for any delivery vehicles; Albers agreed.
Councilwonan Barton added two more conditions to her motion; that a
maximum of five delivery people be employed on Friday nlghts only; and
that private off site parking be provided for delivery vehicles.
The notion carried 3-2 ot ro11 call vole, Councilman Amstrup and Mayor
Mangini voting no.
PUBLIC HEARING - FINAL SUBDIVISION
SUBDIVISION AGREEMENT FOR MARIPOSA
MAP AND RESOLUTION 31-86 APPROVING
DRIVE SUBDIVISION
Director of Public Works reviened his meno of March 12 in rhich he
recomnended council hold public hearing and take action. In Septenber
1985, council approved the tentative subdivision nap for this division
of the old Episcopal Church site on Mariposa Drive into five lots.
This final map substantially conforms to the approved tentative nap;
vehicle access to the lots vil1 only be from the private street, Las
Piedras Court. Staff has revieved and recommends approval; also
presented for approval is a Subdivision Agreement for streets'
sidewalks, gutters and utilities.
Mayor Mangini opened the public hearing. There being no comments, the
hearing was closed.
Councilman Amstrup moved adoption of RESOLUTI0N 31-86 - Approving the
Subdivision Agreement and approval- of the maps. Seconded by
Councilwonan Barton, carried unanimously 5-0 by ro11 call vote.
RESOLUTION 32-86 ESTABLISHING PROCEDURES FOR COMMISSION APPOINTMENTS
City Attorneyts memo of March 7 presented a revised Resolution of
Procedures for Conmissioner Appointments as requested by council
its last study meetlng. The only change from present procedures
that a conmissioner uould have a one year hiatus after serving a
year tern before he could be appoi^nted to another commission.

Councilman Pagliaro said there are many qualified people in Burlingame
and the council needs the option to choose these people. Councilwoman
Barton noted she was t.he only present council member who voted for the
two term linit and reviewed reasoning behind that 1aw; many people
applied for comnissions but the same people were always reappointed.

Councilnan Pagliaro moved approval of RESOLUTI0N 32-86. Seconded by
Councilwoman Barton, carried 3-2 on roLl call vote, Councilman Amstrup
and Mayor Mangini voting no.
INTRODUCTION OF ORDINANCE 1317 LIMIT COUNCIL EXPENSE REIMBURSEMENT
City Attorney's memo of March 11 recommended council introduce this
ordinance as proposed by Council"man Pagliaro at the last study
meeting. This would limit Council expenses to those meeEings or other
activities specifically involving one or more governmental agencies.
Thus dinners such as Chamber of Conmerce and retirement dlnners would
be excluded fron reimbursenent. The amendment also elimi-nates any
mileage for any occasion which takes place within the city.
SELECTION OF AUDITOR FOR 1985-86

OLD BUSINESS - PERSHING SCHOOL SITE PARK
Councilman Pagliaro inquired about the progress on the Pershing School
site park design and improvements. City Manager stated the Park
Department had received some estimates on work at the site and the
council determined it would like this issue on the next study neeting
agenda.

Mayor Mangini scheduled a public hearing for an appeal for signage at
the Ibis Hotel for the April 7, 1986 meeting.

Councilman Lembi reported on the ALUC meeting discussion of the
Shearwater project proposed for South San Francisco shoreline. ALUC
is taking a stand in opposition to the project due to the possibility
of increased airport noise.
