COUNCI LMEMBERS COUNCI LMEMBERS MINUTES PRESENT: ABSENT: AMSTRUP, BARTON, LEMBI, MANGINI, PAGLIARO NONE Minutes of the Regular Meeting of January 6, 1986 were approved. FOR SPEC]ALPUBLIC HEARING - PERMITS FOR DISH APPEAL OF PLANNING COMMISSION ACTION ANTENNA AT 1215 VANCOUVER AVENUE City Planner reviewed her memo of January 9 in rrhich she recommendedcouncil hold a public hearing and take action. This item came beforethe Planning Commission as a code enforcement item. The 95 squarefoot dish antenna was installed without a special permit or buildingpermit; it is clearly visible across rear yards. After the planning Commission actlon the antenna was taken down and the homeownerappealed the action to council to aLlow replacement of the antenna. Mayor Manginl opened the public hearing. Peggy Kane, 2lL2 Broadway, spokeof the antenna visible from her STRUCTURE TO BE USED A in opposition; she showed photographs home. She urged denial. Mayor Mangini closed the public hearing. Councllnan Lembi noted the 10t is very large and wondered if theantenna could not be moved to a less visible locatlon on the 1ot. Theapplicant just arrived at the meeting and came forward. Councllman Amstrup noved Seconded by Councilwoman to deny the appeal ulthout prejudice. Barton, carried unaniroously by voice vote. PUBLIC HEARING - REVIEW OF TWO A POOLS SPECIAL PERMITS TO ALLOW AN ACCESSORY HOUSE AT 824 FAIRFIELD ROAD city Planner reviewed her neno of January 9 in whi-ch she recommendedcouncil hold public hearing and take action. In Decernber planning commission approved two speci-a1 pernits to use an accessory structureas a pool house and Lo have a toilet in an accessory structure. Thestructure is now being used as a pool house, it contains a kitchen andtoilet. The garage r.'as converted by a previous owner who installed akiEchen and toilet without building perrit=. Councilnan Pagli.aro inquired of City Planner about penalties; City Planner noted property owner is required to pay double permit fees if he builds without a permit; applicant cannot get pernits until project is designed to be up to code. CounciLwoman Barton moved to adopt RESOLUTI0N 14-86 Approving Special Permits with conditions approved by Planning Commission and addj-tional condi.tion that walls be removed and that all permits be normal fee. Seconded by Council-man Lembl, carried unanimously by ro11 calI vote. PUBLIC HEARING - REVIEW OF SPECIAL PERMIT TO INSTALL A SATELLITE DISH ANTENNA AT 1723 TOLEDO AVENUE City Planner reviewed her nemo of January 9 in uhich she reconmended council hold publ-ic hearing and take action. Councilman Pagliaro ca1led this up for council review. A 38 square foot dish antenna uas installed and is partially visible from Trousdale Drive. The house is built in a I'Urr shape and the antenna is installed inside the "U" and will be visible to the neighbors at the rear also. The Planning Connission approved the special permit with conditions, noting that the neighbor at the rear signed a permission form. Mayor Mangini opened the publi.c hearing. Steve Navarro, Home Satellite Systems, representingpresent. He stated there was no other place to put the hill at the rear of the home. Councilman Pagliaro asked if the antenna could not it cannot be seen from the street. RENT CONTROL INITIATIVE City Clerkts memo of January 15 reviewed that proponents of the Rent Control Initiative had turned in petitions with oli.er 2,000 signatures on January 13, 1986. They are required to have at least 10 percent of the reglstered voters of the city or 1,600 signatures. The City Clerk now has 30 days in which to determine whether the petition qualifies for an election. Councilman Pagliaro inquired about the newspaper article referring to the proponents stating they would start gathering signatures over again because Lhey did not have the ordinance aEtached to them when petitions were being signed. He wondered if it was appropriate for City Attorney to investigate this issue. City Attorney stated he had read that article and that the proponents had s tated to the City C1e rk that the ordinance was attached to all Lhe petitions. Councilman Pagliaro said if the opponents have substantiating material they should present 1t to the City Attorney. he 1986. APPOINTMENT OF COMMISSIONERS Mayor Mangini noninated Ardith Erickson for Beautification. Councilnan Pagliaro nominated Douglas Holt for Civil Service. Councilman Lembi moved nominations be closed, seconded by Councilwoman Barton and carried unanimously. City Manager passed ballots to each council member. The City Clerk read the ballots of each council mernber. 0n the first ba11ot Dorothea Hughes was elected to Beautification, there being a tie between Carolyn Root and Ardith Erickson. Robert Clark and Donald Roberts uere elected to Park and Recreation. Mike El1is and Ray Harman were elected to Cj"vil Service. Tinothy Auran and Aldo Sinonettl uere ''DEEP POCKETSII LEGISLATION - RESOLUTION 15-86 Mayor Mangini reviewed the recommendations of the council interview committees; for Beautification, Dorothea Hughes and Carolyn Root; for Park and Recreation, Robert Clark and Donald Roberts; for Civil Service, Mike El1is and Ray Harnan; for Traffic, Safety and Parking, Timothy Auran and Aldo Simonetti. He asked for any further nominations frorn council. 344 elected to Traffic, Safety and Parking Commission. Councilman Pagliaro asked about the requirement for only a supplemental EIR for the offlce/ retail building proposed for 1800 E1 Camino Real , iten rrg.'r City Planner said the document will summarize all the conclusions in pertinent areas. Pagliaro noted he would scrutinize it carefulLy. Seconded Councilman Amstrup, carried unanimously by voice vote. with by c. d. 315 OLD BUSINESS Councilwoman Barton complimented the Fire Chief on his persistence regarding fireworks. He had sent council copies of articles and a map showing neighboring cities which banned fireworks. Council discussed briefly the difficulty of limiting fireworks to block parties. Mayor Mangini said next year coun.cil might consider Lhis again. COUNCIL OF MAYORS Mayor Mangini asked for direction from council on the upcoming vote at Council of Mayors; Councilman Pagliaro expressed interest in serving as delegate to ABAG; Mayor Mangini directed a letter be sent to other cities in support of Councilman Pagliaro as a delegate to ABAG. Mayor Mangini noted a letter from Peninsula Division asking for a council appointment to commitLee on ba1lot initiatives; council determined it would support it but not appoint a representative. SCHEDULE HEARINGS Mayor Mangini scheduled an appeal hearing for a fourth bedroom Bloomfield Road, and for the Ibis Hotel signage. City Planner her understanding was that Ibis would appeal but no letter was received. Hearing date was scheduled for February 3, 1986. at 46I noted COMMENDATI ON S Councilwoman Barton noted the two commendations to PoIice 0fficers who saved 1ives. She suggested these people be invited to the annual Commissioner Dinner to be recognized by city and thaL any employee who is recommended by Department Head be so recognized in the future.
