The session adjourned to theregular meeting at 7:40 p.m. CALL TO ORDER A duly noticed regular meeting of the Burlingame City Council- washeld on the above date in the City HalI Council Chambers. The meeting was called to order at 7:45 p.m. by Mayor Frank Pagliaro. COUNCILMEMBERS PRESENT : PAGLfARO COUNCILMEMBERS ABSENT: MINUTES AMSTRUP, BARTON, LEMBI , MANGINI , f November 16, 1987 were approvede that Mayor Pagliarors mother NONE Minutes of the Regular Meetinwith a change on page one to was present. go not DENfAL OF APPEAL FOR A FENCE EXCEPTION FOR 412 BAYSWATER AVENUE City Planner reviewed her memo of November 30 in which she recommended council hold a public hearing and take action. Robert clynn is requesting a fence exception in order to build a seven to eight feet high fence (six feet allowed) along the sideproperty lines at 412 Bayswater. The proposed wooden plank fencewith one foot of lattice on top on the side property lines. It would not ext extended alonproperty line Commission on which it did end ig theis aani not . nto the required front setback nor would it berear property 1ine. The fence on the east Iready in place and came to the Planningnquiry as to whether the fence had a permit, Mayor Pagliaro opened the public hearing. Robert Glynn, applicant, stated he needs the higher fence forprivacy and security. The house is built higher than grade. Ifcouncil cannot grant seven to eight feet, he would like to have asix to seven foot high fence. Rosemary wiIIiams, 408 Bayswater, whose house is on the existingillegal fence side, said she is very unhappy with such a high fence and saw no need for it. There being no other co[unents, the hearing was c]-osed. Council members could find no unusual circumstances on thisproperty to warrant a higher fence. The applicant can build asix foot high fence within code. Councilman Mangini moved to sustain the Planning Commissiondenial. Seconded by Councilman Lembi, carried unanimously byroII caII vote. RESOLUTfON T26-87 - APPROVING THE DRAFT NEGATIVE DECLARATION FOR DEMOLIT]ON OF BUfLDfNG AND CONSTRUCTION OF PARKING LOT AT 1320- 1350 HOWARD AVENUE t41 BURLINGAME, CALIFORNIA December 7, 1987 PLEDGE OF ALLEG]ANCE TO THE FLAG Led by City Attorney Jerry Coleman. ROLL CALL Council revj-ewed with city Planner concerns about light and glare from the proposed parking lot and the effect of the proposed lot on other parking facilities. Mayor Pagliaro opened the public hearing. There being no comments, the hearing was closed. Councilman Amstrup moved adoption of RESOLUTION 726-8'l , Approvingthe Negative Declaration. Seconded by Councilwoman Barton,carried unanimously on roll call vote. BEAUTIF] CATION COMMI SSf ON LETTER REGARDING NEWSPAPER RACKS Mayor Pagl-iaro acknowledged a letter from the Beautification Cornmission requesting to make a presentation to council regarding news racks. Council noted that this issue has been studied extensively bycouncil. Council requested that the chairman of the commission beinvited to attend the next study meeting. TRAFFIC COMMISS]ON RECOMMENDATION FOR ADDITIONAL ADETINE STOP SI GNS Director of Publj-c Works reviewed the traffic engineer's memo of December 1 which stated the Traffic Commission's reco[unendationfor installation of four way stop signs at the intersection of Adeline and Balboa. Staff recomnended against the four way stopsigns since the intersection does not meet the vJarrantsestablished by the city. Staff was concerned that stop signs atthat intersection would increase use of BaLboa as an alternate toEl Camino. Residents of the area attended the Traffic Commission meeting and expressed concerns that children use Balboa for access to school and the park, and that Balboa is used for accessto the hospital and the shopping area at Burlingame Plaza. Council discussed with staff; an ordinance introduced at the nextregular meeting would not go into effeet until mid February;residents who live in the area know the needs of their area best; would Like to see the signs installed earlier, staff noted citycould not ticket violators until 30 days after the ordinance isadopted; staff reviewed ho$, traffic warrants are applied toestablish need for stop signs; if there are too many complaintsthe stop signs can be removed. Councilman Mangini moved to accept the Traffic Commission's recommendation and requested staff prepare legislation. Secondedby Councilwoman Barton, carried unanimously by voice vote. WITHDRAW FROM AGENDA - MILLBRAE FIRE MUTUAL AID Mayor Pagliaro noted that Millbrae had requested this agenda item be withdrawn. INTRODUCTION OF ORDINANCE 13 57 FOR TAXICABS - AMENDING INSURANCE REQUIREMENTS City Manager reviewed his memo of November 25 in which he recommended council introduce this ordinance to amend city requirements for insurance for taxicabs and require filing withthe city of an annual safety check by an independent auto servicefor each taxicab. The city partially deregulated taxicabs in t45 City Planner reviewed her memo of November 30 in which she recommended council hold a public hearing and approve the negative declaration. Under terms of the California Environmental Quality Act (CEQA) the demolition of the bowlingalley and replacement of the structure with a parking lot is aproject and requires an environmental assessment. Staff review determined 10 of a possible 55 potential environmental effects which warranted further study. Those 10 items along withmitigations are documented in Exhibit A attached to theresolution. 146 1984 whife trying to insure their safe maintenance and operation. We added insurance requirements of $1 million and safetyinspections. Taxi companies indicate that this leveI of insurance is prohibitively expensive and exceeds the requirementsof neighboring cities. Mayor Pagliaro inquired about existing requirements for safety checks and effect of violations. Staff responded city has no wayof knowing whether the safety check requirement is being met. The proposed law would require filing an annual safety checkcertificate \^rith the city each year with the insurancecertificate, any violations could result in revocation of thetaxicab permit. Council introduced ORDINANCE L357 for its first reading. DECK AND RETAINING WALLS, 2843ENCROACHMENT PERMIT - LANDSCAPING, ARGUEttO Director of Public Works revie\red the City Engineer's memo of December 2 in which he recolunended council approve the requestfor an encroachment permit for landscaping and a stairway on cityproperty in MiIIs Canyon and deny the request for woodenretaining vralls and a deck on City property. The property owner,William Armanino, buil-t a redwood deck which partly extends overcity property, there is no record of a building permit. Other work was done without permj-ts, including steps, drainage,landscaping and retaining walls. Landscaping is encouraged toprovide for a fire break. There has been a small slide at therear of 2843 Arguello on city land. Staff feels the removal ofthe retaining walls and deck may relieve the load on the soils onthe slope and reduce possibility of more slides. Staff also recommends a review by a soils engineer to aI1ow the deck on the ownerrs property. WiLliam Armanino said the slide was caused by improper drainage;several years ago there was a break in a drain 1ine, the slj-de occurred shortly after the break. He admitted he made a mistakein building onto city land; a soils engineer would cost too much money and most are not interested the job because of liability; he will remove the portion of the deck over city property. Theproperty is for sale. He had two letters from engineers vrho considered the slide stabilized and that the retaining walls and deck over city property would not contribute to land slide hazards. In response to council, Director said the applicant would have toget a permit, the deck should have an engineering reporti drainage from the yard must go to street, may need a sump pump.If entire deck were removed, it would not need soil report. He agreed that soils engineers are expensive because they have highIiability exposure. Council noted the city must be protected. Councilwoman Barton moved to support staff recommendation to denythe encroachment permit for the deck and retaining wal-ls, andallow the encroachment permit for landscaping and stairs with conditions in staff report. Seconded by Councilman Arnstrup. Councilman Mangini and Lembi questioned possibility of postponing action, asked opinion of engineer letters; City Attorney notedthe letters are not from soils engineers, if the applicant got apermit for a new deck a soils report would be required, he was concerned about city liability. The motion carried unanimously by ro11 call vote. ENCROACHMENT PERMIT FOR WALL FENCE AI,ID SIDEWALK AT 160 PEPPER Director of Public Works reviewed the City Engineerts memo of December I in which he recommended council deny this request for a briek waII and wrought iron fence three feet from the curb and an exposed aggregate walk. These structures were installed !'rithout permits. This fence and waII wilI restrict any future installation of public sidewalks. Two other homes on the block 147 have installed fences without permits a similar distance into thepublic right of way. Ronal-d Rockwood, applicant, reviewed that there are not sidewalks on this street and there is very little traffic and fewpedestrians on the street, other neighbors have built fences such as his. He requested approval. Council noted the city has the right to require removal of thestructures at the property owner's expense if the right of way isneeded. It had no problem approving. Councilman Amstrup hoped the people are becoming aware of the need for permits, if a permit were acquired he would have known where to build. Councilwoman Barton suggested notes in $rater bills to inform people that they need building permits. Director said notice has been published in the recreation bulletins. Councilman Mangini moved approval of the encroachment permit. Seconded by Councilman Lembi, carried unanimously by voice vote. CONSENT CALENDAR Councilman Amstrup reviewed the need for an amended agreement(item c) with the Peninsula water Agency to include Alameda and Santa Clara counties which also use Hetch Hetchyrs lvater from SanFrancisco. He also suggested a complimentary letter be sent tothe Tennis CIub for its contribution to repaving the schooltennis courts (item f ). Mayor Pagliaro requested discussion of the parcel map for 1628 Forest view (item h). Some neighbors of the area had complainedto him about the removal of trees from the site. tte would liketo have council review this subdivision at the next meeting. Councilwoman Barton noted the Planning Commission recommendedallowing removal of two smal-I trees but keeping the t\no large oaktrees. city Planner revie$red the hearing process before the Planning Commission. John Ward, representing the property owners, noted that there !./as a pubLic hearing on this item before the Planning Commission, all neighbors were noticed, and a compromise was agreed to by allparties. The sale of the property will be held up if this is delayed until next month for a council public hearing. Staff noted to council that the map is before council at thistime, council can approve, continue or set a public hearing. Council-woman Barton moved to sustain the Planning Comnission approval of the map, noting there had been a hearing and everyone was noticed and heard. Seconded by Councilman Lembi, who agreedthat all concerns had been mitigated at the Planning Commission hearing. There was discussion of council right to call up items for revi-e\^,. BUDGET AMENDMENT FOR COMPUTER SYSTEM SPECIALIST PAY EOR POL]CE AND FINANCE DEPARTMENTS City Manager's memo of November 25 recommended councilauthorize a budget amendment to the Police and Finance budgets to provide for two specialist pay assignments at $I50 per month for existing positions to compensate foradditional duties as computer system administrators. Seconded by Councilman Amstrup, carried unanimously by voice vote . OLD BUSINESS - AIRPORT NOISE ABATEMENT Councilman Lembi noted he would meet with the Airport Land Use Commission to discuss new noise abatement regulations and askedfor council comments. Councilwoman Barton stated the Airport Roundtable had just discussed this issue and recommended its comments on these revised noise abatement regulations to the council. COI'NTY TRANSPORTATION COMMITTEE - CALL SPECIAL MEETfNG Mayor Pagliaro reviewed with council the list of projects suggested by the committee. Councilman Amstrup expressed his concern that these projects have not been reviewed by council.After further discussion, Mayor Pagliaro scheduled a Special Meeting for December 16 at 5 p.m. in City HaII to consider theIist of proj ects . STREET SWEEPING CounciLwoman Barton acknowledged a letter from Dorothy Dirr requesting that city streets be posted for street sweeping. Barton felt most people would be willing to move their cars forstreet cleaning if they knew when the sweeper was coming. Staff had responded to Dirr that streets are cleaned as needed and thecity Iacks staff and equipment for regular schedules, also the need for sweeping various parts of town changes seasonally. Councilman Lembi had mentioned earlier this year about cleaningstreets in business districts; discussion centered on a smallerstreet sweeper that could clean around planters. Staff isinvestigating this type sweeper; two city crew will be freed fromtrash pickup in the business area when BFI starts trash can emptying later this month. The regular meeting of December 21 was canceled.
