PUBLIC HEARING - RESOLUTION 50_87 ADOPTING THE 1987-88 BUDGET ND

City Manager reviewed his memo of June 11 in which he recommende
council hold a public hearing on the 1987-88 budget and then ado
budgeL and appropriation limit by resolutions. The council revi
the budget at the June 10 study meeting and made amendments to t
proposed budget to include $11,800 in funding to community group
(including $6,000 in Federal Revenue Sharing funds), rebudget of
truck for the Park Department at a cost of $11,677 and $1,064 fo
reclassification of the city electriclan. The revised budget to

PERMIT AMENDMENT TO ALLOW TA 0 F00 S AT 34 0 ON AV
City Planner reviewed her memo of June B in which she recommende
council hold public hearing and take action. In February L987,
applicant, Parham Esfandiari, received a special permit for a
specialty grocery store with a kitchen on site to be used to pre
foods to be sold from the site in sealed containers (jars). In
Esfandiari made a nehr application Lo add take out food service t
business. He proposed take out sales from 7 a.m. to 11 p.m. sev
days a week. The number of employees would remain the same at o
one half. The Planning Commission denied this request on a 5-1
at the May 11 meeting; commissioners noted applicant had not yet
complied with original conditions for the grocery store; there h
been some misunderstandings regarding code compliance.
Mayor Barton opened the public hearing.
Parham Esfandiari, applicant, spoke; he plans for walk in custom
parking is problem in Burlingame but his customers will not driv

Councilman Lembi inquired what type of containers Esfandlari proposed
to use for the take out servj.ce. Esfandiari had not planned Ehat yet.

Speaki-ng in opposition uas Tevis Martin, represent ing Don Sabatini the
ovner of two adjacent properties. He was concerned about parki.ng
problems in the area; tenanEs in adjacent bui-ldings are opposed to
take out service; not compatible with service businesses in these
buildings; coRcern about fire hazards; bathroom facilities not easily
accessible, must go outside and upstairs, and are for tenants in
buildings who would not appreciate use by take out customers.
Council questions: how long a lease does applicant have, five years
plus renewal options; is cooking being done on site or off site now,
no cooking being done.
Mayor Barton closed the publi-c hear j-ng.
Councilman Amstrup noted applican! would be intensi.fying the use, he

VARIANCE TO ALLOW RESTAURANT AT 723 CALITORNIA
52_87 APPROVING SAME
APPROVAL FOR A PARKING
DRIVE - RESOLUTION
City Planner revi-ewed her meno of June 8 in which she recomnended
council hold a public hearing and take action. Ko ji-ro and Sandra
Okada are requesting a two space parking variance for a restaurant
catering business at 723 California Drive. The restaurant would be
open 5 p.m. to midnight, Monday through Saturday, and the kitchen
would be used for catering when the restaurant is closed. There would
be four employees on site. There would be one delivery van associat.ed
with the catering activity. The applicants have expressed an i-nterest
in take out food service, but they would have to make separate
application for that service. The Planning Commission appro\/ed this
request by 4-3 vote at its May 26 n-eeting. An appeal was received
from Max Haberstich of San Mateo Avenue (catering business would exit
onto San Mateo Avenue at rear of 723 California Drive). Haberstich
uas concerned about parking impact and trash or garbage already
impacting San Mateo Avenue.
Council questioned Planner: are other businesses assigned parking;
landlord has indicated applicant can use five spaces after 5 p.m.i are
any other businesses 1n that block open after 5 p.n.; what are other
uses on block; can red zone be i.nsf alled on San Mateo; saw several
open parking spaces in the area.

Max Haberstich, 1210 Oak Grove, spoke in opposition. H1s garage exits
onto San Mateo Avenue, parking 1s very bad on that street, lots of
double parking, particularly at night; already have two food service
businesses, donrt need another restaurant; health problem due to
garbage left in open by other two restaurants.

RESOLUTION 53-87 APPROVING SAME92LA VISTA
City Planner reviewed her meno of June 5 in which she recommende
council hold public hearing and take action. Richard Garban j.s
requesting a special permit to build a L7 foot three inch detach
garage in the rear 30 percent of his lot at 926 Chula Vista. Th
plans shor+ a deck and spa in the rear yard built without a build
permiu. The applicant is aware Lhat he will have to meet all co
requirements for these structures. The present garage on the 1o
part of the residential structure and will be used in the future
storage. Applicant wishes Lo retain the driveway to park cars s
Lhe new garage is set back only seven and one half feet. The P1
Commission required removal of t.he existing driveway in the
conditions of approval.

Richard Garban, applicant, reviewed that he meets or exceeds all
requirements; fill will be removed so the garage will be lower;
for old garage for storage, would like to store one car in there
council questioned number of cars Garban has; where does he park
in driveway. Garban objected to requirement for removal of exis
curb cut and driveway, and 15 foot setback.

City Planner reviewed her memo of June B in rchich she recommende
council hold public hearing and take action. Gerald and Joan Wo
are requesting two variances to add a 1 r 080 square foot second f
bedroorn addition to their single family home. They need one var
for lot coverage (40 percent permitted, 42.2 existing and 42.9
proposed). The second vari.ance is for parking because a fourth
bedroom is being added without providing a second parking space
site. The original garage was 18 feet by 22 feet (two car), but
to the Woods purchasing the house the kitchen wal1 was extended
the garage, reducing it to a one car garage.

Mayor Barton opened the public hearing.
Jerry Woods, applicant, reviewed the need to add one bedroom/study
addition upstairs, leaving two bedrooms for children dovnstairs; both
he and his wife work at. home and need study area; they can park two
cars in driveway; desire to stay in Burlingame to raise children; this
will be a three bedroom home, not four bedroomi currently he and his
wife use the fami-ly roon for a bedroon downstairs.
Council questioned why kitchen cantt be done over correctly; Woods
responded due to pitch of roof the entire kitchen uould have to be
rebuilt, would be too expensive; storaSe area at rear of garage was
reviewed as Eo size and use; if approved would garage be used forparking; garage is too small for tuo cars; Woods was aware that he
would have !o bring kitchen up to code and pay double building pernit
fees for fine.

Councilman Amstrup commented that this i11ega1 kitchen and additj-ona1
bedroom nay have a ripple effect on Ehe neighborhood; has concern
about parking. Mayor Barton stated her concerns about parking in this
nej-ghborhood, she would not vote against this project but she wanted
it understood that council would not always grant these requests.
Councilnan Pagliaro commented these people are not responsible for the
illegal kitchen.

FOR STREET FAIR ON BROADWAYCHAMBER OF COMMERCE REQUEST
City Manager reviewed his memo of June 8 to which he attached a
request from the Chanber of Commerce and t.he Broadway Merchants
Association for a sLreet fair involviog closure of Broadway on Augustl and 2, and for a banner at west end of Broadway. Staff is concerned
about traffic problems with the street closure and access for
emergency vehicles, and there may be parking problems in adjacentresidential areas. He noted Karen Key, Director of Chamber, has
requested postponing the banner request until merchants get pernission
from the owners of property on which the banner will be hung.
Karen Key and two Broadway merchants reviewed plans for the streetfair, noting that a similar fair was held in the 1976 and was very
successful. They are attempting to raise funds to help restore the
Broadway arch sign.
Council members recalled the previous street fair and noted there did
not appear to be any traffic problems then. Insurance coverage was
discussed and proof of insurance was received by staff; booEhs will be
removed from sEreet during the night and reEurned the next day; the
center half of the street will be kept open for emergency vehicles;
merchants will clean up streetsl nearby residents will be given an
invitation to f ai-r and free treat 1f they attend.
Councilman Lembi moved to grant the request for stleet

City Attorney revi-ewed his memo of June 10 in which he recommend
council grant an amendment to Amusement Permit with conditions.

OLD BUSINESS - COUNTY TRANSPORTATION COMMITTEE
Councilnan Pagliaro suggested that council take an advisory stand inopposition to the SMCTAC report for the MTC hearings, notinS that
council- would take an official vote on t.he issue after MTC has held
its hearing. He felt MTC should be made aware of the faiLure toprovide public input. He supported two ba11ot issues. He noted threeletters received from the League of Women Voters, Malcoln Dudley the
Atherton representative on the SMCTAC con0nittee, and Bob Payne of
Pescadero, opposing the issue.
