The meeting was to order at 7234 p.m. by Mayor Gloria H. Barton. PLEDGE OF ALLEGIANCE TO THE FLAG Led by City Clerk, Judith A. Malfatti. ROLL CALL COUNCILMEMBERS PRESENT: COUNCIL},IEMBERS ABSENT : Mayor Barton introduced MINUTES Minutes of the Regular of April- 22, l9B7 were AMSTRUP, BARTON, LEMBI, MANGINI, PAGLIARO NONE the new editor of the Boutique & Villager. Meeting of ApriL 20, 1987 and Lhe Study Meeting approved. L PUBLIC TURNS HEARING SECOND READING ORDINANCE L342 PROHIBITING CERTAIN ]NTO PARKING SPACES City Attorney reviewed his memo of April 2 in which he recommended council hold public hearing and take action. This ordinance will prohibit persons from turning across traffic to park in a diagonal space on the opposite side of the street in Lhe business districts. At the present time, the district attorneyts office will not prosecute a ticket for u-turns because these turns into parking spaces are not conplete u-turns. Mayor Barton opened the public hearing. There being no comments' the hearing was closed. Councilman Amstrup moved adoption of ORDINANCE L342. Seconded by Councilman Mangini, carried unanimously 5-0 by ro11 call voLe. PUBLIC HEARING L987 WEED ABATEMENT PROGRAM, JOB 7LO - RESOLUTION 4L-87 ORDERING ABATEMENT Director of Public Works reviewed his memo of ApriL 28 in uhich he recommended council hold public hearing and take action. He presented a list of the properties which had been posted and notified of this hearing. After hearing any protests, council should order the abatemenL of weeds and rubbish. INTRODUCTION OF ORDINANCE L344 SMOKING City Attorney reviewed his memo of ApriL 27 in which he recommended council inLroduce this.ordinance for its first reading and set public hearing for May 18. Council has been studying the smoking control ordinance for several weeks. Under this ordinance smokj-ng in city facilit.ies is prohibited during public meetings, in waiting rooms, lobbies and public hallways of city buildings, and separate smoking areas can be designated. Smoking is also prohibited in other public places. In restaurants seating over 50 persons at least 50 percent of the seating must be nonsmoking. Every private place of employmenL must develop a smoking policy within 90 days, but violations rdi11 not be enforced by the city. Signs must indicate the location of Mayor Barton opened the public hearing. There being no public comments, the hearing was closed. Councilman Mangini moved adoption of RES0LUTI0N 4L-87, 0rdering Abatement of Weeds and Rubbish. Seconded by Councilman Lembi, carried unanimously. 4B nonsmoking areas. Councilman Mangini introduced ORDINANCE L344 for its first readi TRAFFIC ALLOCATIONS - MAY L987 City Planner reviewed her memo of ApriL 28 in which she recommen council review the request and take action. The Carruf Corporatreceived a BCDC permit to build a 559 room hotel on their nine asite at 350 Airport Boulevard on June 19, 1986. BCDC approval commenced the one year planning approval. Since the applicantsjust commencing preparaLion of p1ans, submittal of final plans bL9, L9B7 are unlikely. Therefore they need an extensi-on from co of their traffic allocation, and an extension from Planning Com of the Planning approval. Carruf plans to subnit plans by Augus L987. She reviewed the construction schedule. Councilman Pagliaro was concerned about the numerous extensions to this project. He questioned a representatj.ve of the applican Franz Boncodino, who reviewed t,he need for an extension for this multi-mi11ion do11ar project; in response to Pagliarofs question the stage in plans at this time, applicant noted they have start working drawings. Councilnan Mangini moved approval of the extension to the traffi allocation for Carruf. Seconded by Councilman Lembi, carried unani-mously by voice vote. AMUSEMENT PERMITS.AMF A C HOTEL GRANTED. MARRIOTT CONTINUED City Attorney reviewed his memos of April 9 and noted the Marrio requested a continuance to the next meeting in order for Steve Sharple, General Manager of Marriott, to be present. Council gr a continuance for Marriott and proceeded with the Amfac request,. Attorney noted Amfac does not have valet parking. Councilman Pagliaro moved to grant an amusement permit to Amfac the provision thaL they do not charge fees for any valet parking t,hey might institute. Seconded by Councilman Lembi, carried unanimously by voice vote. CHAMBER OF COMMERCE RE UESTS FOR UPCOMING EVENTS AND BROADWAY BA NER oo ed on re re June ncil ssion ]-Ven of d t has nte d City City Manager reviewed his memo of April 27 in which he recommend council review the request for (1) a semi-permanent banner at th Camino end of Broadway, he noted this would not comply with city code, (2) accept cancellation of ttI Love Burlingame D.ytt and con the Chamber idea of moving this celebration to the new bayfront at Embassy Suites Hotel, and (3) approve certain sidewalk sales sidewalk art sales. 1. Broadway Banner: Karen K"y, Director of Chamber of Commerc clarified that the Broadway merchants would like to place a bann over Broadway for special sales and holidays, that it would not there all the time. Mayor Barton had concerns about the banner; it would be commerci does not comply with city sign code; if council al1ows this, the Burlingame Avenue merchants may also want it. 0ther council members wanted to see a schedule for when the bann would be displayed. City Manager noted that banner permits are scheduled one year in advance so there may be conflicts. Ann Parsons, representing Broadway merchants, commented that the attempting to improve the street and have done quite a bit; they consider Broadway the gaLeway to Burlingame; they want people to welcome and come back to shop. They would like to put the banne one week prior to promotions and during holidays. "I Love Burlingame Dayrr: Councilman Amstrup noted the Chamber should get a ci.ty Amusenent Permit if they hold this event in aprivate State park; events like this could require extra police coverage; concern about other groups using the park. Staff noted Enbassy Suj-tes Hotel is in charge of this park; it is State 1and, leased by Embassy. Council wondered if the Embassy staff was ar*are of city concerns with the use of this park and suggested they be inforned. Councilman AEstrup moved to grant the eventa requested by the Chanber with provision that if rrI Love Burlingame Day'r is held in Wooley Park they be requi-red to get Amusement Pernit. Seconded by Councilman Mangini, carri-ed 4-0 with Councilnao Pagliaro abstaining because he was unclear on uhether city could requi-re a permit for activities in this park or who had juri.sdicti.on over it.. CONSENT CALENDAR CounciLman Pagliaro requested discussion of item ttb. Chamber Sublease of Train Station.rr He noted there is no provision for liability insurance in the attached contract. Staff said the cityrs agreement wiEh the State, which is incorporated by reference in thls contract before council tonight, does have adequate provisions for liability insurance in Lhe amount of $500,000. Pagliaro asked that this item be delayed to the next neeting in order for staff to bring back the ent.ire contract with State. Council agreed, INTRODUCTION OF ORDINANCE 1345 - MAKING CLERICAL AMENDMENTS TO THE WEED ABATEMENT PROCEDURES City Clerk's neno of April 27 recommended council adopt an ordinance to make clerical changes in the cityrs weed abatement lavs to reflect current practice. Staff will pl-ace on thenext regular agenda. Councilnan Pagliaro noted he attended the first meeting in Redwood City and felt a cou[ci1 member should attend all these meetings. Sldewalk Sales: Karen (ey noted the Broadway merchants have requested a July 18 and 19 sideualk sale during the same dates as the Burlingane Avenue sidewalk art sale on July 17, 18, and 19. Burlingame Avenue merchants also request a sidewalk sale on August 14 and 15. The community dinner is tentatively scheduled for october 10 and a business tour is scheduled for Novenber. PARKING Mayor Barton asked that the Traffic Commission look at installing diagonal parking on Park Road 1n the area between Howard andBayswater. Mayor Barton had also received complaints about residentsbeing ticketed for parking in front of their homes in tr+o hour zones. 50 Staff noted the residents ask for two hour parking to keep emplofrom parking on their streets, but fail to remember that Lrre p.tlimits would apply to everyone, even residents.
