CLOSED SESS]ON
A closed session regarding the Howard vs city litigation was held on
the above date in conference Room A of city HaII at 7:00 p.m. and
adjourned to the regular meeting at 7:30 p.m. All council members
were present.
CALL TO ORDER
A duly noticed regular meeting of the Burlingame City Council was
held on the above date j-n the City HaII Council Chambers and was
caIIed to order at ?:35 p.m. by Mayor Frank J. Pagliaro, Jr.

Minutes of the Regular Meeting of November 7, 1988 were approved.
Mayor Pagliaro reviewed his year as Mayor, noted that there were
mainly unanimous votes on important issues that came before council
this past year and thanked council for its support during his term
as Mayor, particularly their support on the county Transportation
corunittee. He then presented each council member with a tile plaque
such as now given to commissioners upon retirement from commissions,
he noted that aII council members had served on commissions but in
times past these plaques were not presented. Council- members were
surprised and pleased.
Vj-ce Mayor Amstrup presented Mayor Pagliaro with a plaque honoring
his year of service as Mayor, and commented that Mayor Pagliaro had
brought 21 agencies together to a unanimous consensus on the County
Transportation committee.
ROTATION OF COUNCIL OFFICERS
Mayor Pagliaro opened the floor to nominations for Mayor.
Councilwoman Barton nominated Vice Mayor Amstrup, noting that he has
well represented the city in the past as Mayor and she knew he would
do so again. Councilman Mangini moved that nominations be closed.
The motion was seconded and carried unanimouslY.
Councilman Pagliaro asked for nominations for Vice Mayor. Mayor
Amstrup nominated Councilman Lembi. councilman Mangini moved that
nominations be closed. Seconded and carried unanimously.
Mayor Amstrup stated he was very proud to be Mayor, he noted that
half his family was in the audience as well as many good friends.
He introduced his family and ca1led a recess at 7:45 p.m. to
celebrate the occasion with cake and champagne in the lobby. The
meeting reconvened at 8:1"2 p.m. with aII council members present.
ORDINANCE 1381 - EXTENDING INTERIM ORDINANCE 13?5 . REGULATING
SECOND STORY ADDfTIONS IN 7,OO 0 IND 10,OOO SF M]NIMUM SIZE LOTS
City Attorney reviewed his memo of November 8 in which he requested
councif hold public hearing and take action. on October 17 council
adopted an interim ordinance to provide for review of second storY
additions in hillside areas. The ordinance would expire December 1
and this new ordinance wiII extend the interim ordinance until April
20, 1989, and it could be extended further if needed. This wil-I

Councilman Lembi moved adoption of ORDINANCE 1381. Seconded by
Councilwoman Barton, carried unanimously by ro11 call vote.
ORDINANCE T382 - EXEENDING INTERIM ORDINANCE ].376 - PROHIBITING
CREEKSIDE DEVELOPMENT AND SUBDIVISION
city Attorney reviewed his memo of November 8 which recommended
council hold a public hearing and take action. on october 17
council adopted an interim ordinance to prohibit subdivision or
development of creekside lots. The interim ordinance expires on
December l and this new ordinance wiII extend the interim ordinanceuntil November 20, 1989. Staff expects it will take a year to
complete the proposed creek study. This ordinance could be extended
one more time if needed.
Mayor Amstrup opened the public hearing. There being no comments,
the hear j-nqr was closed.
Councilwoman Barton moved adoption of ORDINANCE 1382. Seconded by
Councilman Mangini, carried unanimously by voice vote.
SECOND READING - ORDINANCE ].380 - REGULATING VOLLEYBALL AND AMENDING
OTHER REGULATIONS OF PARK USE
city Attorney's memo of october 25 recommended council introducethis ordinance to control the number of volleyball nets placed in apark at one time to two, and other technical changes. He
recommended adoption after a public hearing.
Mayor Amstrup opened the public hearing. There being no comments,
the hearing was c Iosed.
Councilman Mangini moved adoption of ORDINANCE L380. Seconded by
council-man Lembi, carried unanimously by roll caII vote.
APPROVAL OF SPECIAL EVENT - BfCYCLE RACE ON MAY 21 1989
City Manager reviewed his memo of November 15 in which he
recommended council consider a request to hold a bicycle race j-n
do\"rntown Burlingame on sunday, May 2l , l-989 f rom 7 a.m. to 2 p.m.
The course would be posted "no parkinqrr but no towing would be
authorized unless the course is physically blocked. Traf f j-c would
be a1lowed to circulate except when a specific race or heat was inprogress. The applicant, Gene condon of Burlingame Cyclery, has
received approval from 38 businesses or residents along the course.
The applicant $rou1d be required to submit a $1 million insuranceliability policy acceptable to city Attorney prior to the event.
Council had no problems with approval of this request. Councilman
Mangini moved approval , seconded by Councilman Lembi, carried
unanimously by voice vote.
CITY HALL SPACE PLANNfNG PROPOSAL
city Manager reviewed his memo of November 15 which recommendedcouncil direct staff to contract for additional architectural
services to finalize the preliminary plan for reducing overcrowdingin city haLl and for preparation of contract documents for bidding
next year. This proposal would move the City Attorney and ParkDirector to the City Manager/water office area, as well as the CityClerk. The Building Department would be moved to the Park/Attorneyarea. The water office would move to the Finance area. The
esti.mated cost for architectural services and bid documents is
$12,500 which is available from existing funds.
Councilman Mangini commented this plan would provide for moreefficient offices, he approved of it.

Councilman Pagliaro mentioned that his firm represents the architectfirm but he does not believe they have any pending cases.
Council approved proceeding with the City Managerts recommendation.
1989 C]TY COUNCIL CALENDAR
city Manager reviewed his memo of october 24 which presented the
proposed city council meeting calendar for 1989. Council approved
of setting meetings following Monday holidays for wednesday instead
of Tuesday; the only remaining question was the Saturday rrcoal
Serssj-onrr which was tentatively scheduled for January 21; council
agreed to change that date to January 14, 1989. The calendar was
r:n.irr:i mously approved.
]NTRODUCTION OF ORDINANCE 1383
M-1 AND C-4 DfSTRICTS
LIMITING CAR RENTAL AGENCIES IN THE
City Planner's memorandum of November L6 recommended council
introduce this ordinance to regulate car rental agencies j-n the M-1
and C-4 districts. The Planning Commission reviewed thj-s issue at
its meetlng of october 24 and reviewed an ordinance that would
l:i'eeze such businesses and require a use permit for expansion of
existing businesses; after discussion, the commission recommended adifferent approach based on conf inj-ng car rental use to the most
highway accessible areas and establishing minimum criteria which
would eliminate the types of such uses which have or can be the
targest enforcement problem. The proposed ordinance would now
require a use permit for all car rental businesses except that none

councilman Mangini aqreed that council had asked for a limit on any
more car rental business. He was not sure this ordinance would gj-ve
council control. He mentioned a letter received from an attorney
regarding the councilts denial of a traffic allocation to a car
rental agency; the attorney noted that council cannot control the
car rental traffic now because they will be located in another city.
Councilman Lembi thought the limit to one-acre sites for such
businesses srould greatly limit them, there are few such large sites
left in the industrial area of the city.
Councifwoman Barton thought permit requirement would allow adequate
control .
After more discussi-on, council agreed to discuss further at the next
meeting after the public hearing. Councilman Mangini introduced
oRDINANCE 1383 for its first reading.

a. RESOLUTION 105-88 - ACCEPTING POST STANDARDS FOR SELECTION AND
TRAfN]NG OF POLICE DISPATCHERS
Police Chiefts memo of November 9 recommended approval of the
resolution to receive POST reimbursement of training funds.
b. RESOLUTION 106-88 - EXTEND]NG TEMPORARY SUSPENSION OF SECTION
7.02 OE SAN FRA}ICI SCO WATER DEPARTMENT SETTLEMENT AGREEMENT
Public Works memo of November 9 recommended council approve
this resolution extending the deadline for other cities to
adopt resolutions such as this council adopted in August.
c. RESoLUTION 107-88 - AUTHORIZING APPLICATION FOR GRAI'.IT FUNDS
Park Directorts memo of November 9 recommended council approve
this resolution approving application for grant funds under the

Park Land Bond Act of 1988 for the Airport Boulevard Bike Path,
cP 328.
d. RESOLUTTON 108-88 SUBDIVISION AGREEMENT FOR 740-750 WALNUT
Public works memo of November 15 recommended council approvethis agreement for the subdivision at 740-750 Walnut. Council
approved the parcel map for this subdivision at its meeting of
september 6, 1988.
WARRANTS AND PAYROLL
Finance Director recommended approval of warrants 42L30 -
42585, duly audited, in the amount of $1,116,335.28 and Payroll
Checks 87769 - 88474 for the month of october 1988 in the
3-mount of $769,125.73.
Councilman Manginj- moved approval of the consent Calendar.

Hotel Tax: council-rdoman Barton commented on the proposed
legislation restricting cityrs right to use hotel taxes. She
suggested council keep a close eye on this proposal.
Airport Runway Expansion: Councilman Lembi inquired if staff has
Iearned anything more about the proposal to extend SF airport
runways. Councilwoman Barton noted there is a special meeting on
December 2 which the city Planner will attend to represent the city.
The proposal to extend runway number one would cause more noise in
Burlingame.
SCHEDULE REVfEW HEARING IBIS HOTEL CLASSES
Mayor Amstrup called up for council revi-ew the proposed college
classes to be held at the Ibis Hotel. Hearing was scheduled for the
December 5 meeting.

Council noted that there are too many agencies meeting on airport

BROADWAY ARCH PLAOUE
Council discussed a memo from the city Manager asking direction on a
request from the Broadway Merchants to install a commemorative
plaque in the sidewalk for the Broadway Arch sign restoration. Thisplaque (12 by 18 inches) lists several- businesses which donated tothe arch restoration. Past city policy has been to a11ow only smallhistorical plaques which did not include contributor's names.
Council noted this request put council j.n an awkward posj-tion, it
would have been better if the merchants had consulted with cityprior to ordering a plaque. This is like advertising on a public
sidewalk. City could more appropriately install a small plaque to
simply note the dates of original and restorative installations, andperhaps the Broadway Merchants as the prime movers of the project.If t.he merchants must use this plaque, perhaps it could be installed
on a store front or on private property. Staff wiII notify the
merchants of councilrs direction.

COI'NTY HOTEL TAX PROPOSAL
Mayor Amstrup reviewed a convention Bureau meeting that he and the
City Manager had attended where a County proposal for raising hotel
taxes to improve the county fairgrounds for conventions was
discussed. Councilman Pagliaro asked that a letter opposing this
proposal be prepared. Council concurred.
Council discussed a recent newspaper article where Supervisor
Schumacher referred to Burlingame and South city as obstructing
progressi this referred to an occurrence some 10 years ago \^rhen
Burlingame and South City were planning convention centers.
Mayor Amstrup appointed Councilman Mangini to meet lvith the City
Manager, the Mayor and hotel managers to discuss the hotel tax
issue.
