RESOLUTION NO. 142-2020
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME SETTING THE
RATE OF SHORT-TERM RENTAL REGISTRATION AND RENEWAL FEES PURSUANT TO
SECTION 6.56.040(b) OF THE BURLINGAME MUNICIPAL CODE.
THE CITY COUNCIL OF THE CITY OF BURLINGAME finds as follows:
WHEREAS, cities have experienced growth in the use of residential properties as short
term rentals, generally defined as the use or possession of or the right to use or possess any room
or rooms, or portions thereof in any dwelling unit for residing, sleeping or lodging purposes for less
than 30 consecutive calendar days, counting portions of days as full calendar days; and,
WHEREAS, it is in the public interest for the City to establish reasonable, uniform and
comprehensive regulations of short-term residential rentals with an associated Short -Term Rental
Registration and Renewal process to ensure the protection of quality of life in residential
neighborhoods while balancing private property rights and providing a source of tax revenue to the
City; and,
WHEREAS, Burlingame Municipal Code Chapter 6.56 (Short -Term Rentals) added in the
Municipal Code by Ordinance No. , authorizes the City Council to set the rates for the Short -
Term Rental Registration and Renewal fees by resolution; and,
WHEREAS, on November 2, 2020 the City Council conducted a duly noticed public hearing
and received testimony from City staff and all interested parties regarding the establishment and
setting of short-term rental registration and renewal fees; and,
WHEREAS, all legal prerequisites including public notification to the adoption of this
Resolution have occurred; and,
WHEREAS, the City Council has reviewed the information contained in this Resolution and
the accompanying staff report and attachments at a meeting held on November 16, 2020; and,
WHEREAS, the City Council now desires to set the rates for Short Term Residential Rental
registration and renewal fees.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Burlingame as follows:
Section 1. The foregoing recitals are true and correct and incorporated into this Resolution
by this reference.
Section 2. Each of the fees ("Fees") listed in Exhibit "A" to this Resolution, attached
hereto and incorporated herein by reference, shall be imposed on a July 1 to June 30 fiscal -year
basis at the rate set forth in Exhibit "A." Each Fee shall be administered as set forth in Burlingame
Municipal Code Chapter 6.56 and in the Resolution.
Section 3. Pursuant to Title 14 of the California Code of Regulations, Section 15061(b)(3)
and 15378 (b)(5), this Resolution is exempt from the requirements of the California
Environmental Quality Act (CEQA) in that it is not a Project that has the potential for causing a
significant effect on the environment.

Section 4. This Resolution shall take effect on 60 days after adoption, but only if the
associated Ordinance No.1989 is adopted and effective prior to that date.
NOW, THEREFORE, BE IT RESOLVED that the City Council hereby adopts the Short -
Term Rental Registration and Renewal Fees for the City of Burlingame.
