In January, the Pl Commission took action on a request by the India Club for an 18 parking varlance so they could use the former Tait Aucti-on Gal1e first floor retail and second floor office use. The council cal this up for review and, before it came before council, the appli requested to return to the Planning Commission with a new propos 0n March 9, the Planning Commlssion reviewed this new plan and v 3-3 to grant the variance. A tie vote is a denial, and the appl appealed the denial to council. The revised proposal is to use 4,658 square feet first floor for retail and 4,724 square feet o second floor for office use. Plans include parking for L4 space order to implemenL the proposed project the applicant needs a L4 parking variance, 28 spaces are required by city code for this project. In order to increase the number of parking spaces from original 10 to L4 spaces, Lhey narrowed 9 spaces by 6 inches and narrowed four para11el parking spaces by 18 inches and shortened 10 perpendicular spaces by 24 inches. The one handicapped parki space meets all requirements. He noted that cars are much smaller today than when L code was written, other cities have smaller requirements for par space dimensions. He had measured cars and the longest he found 18 feet long. His illustration included ful1 size cars, not com Architect Davallou showed overhead illustrations of parking spac sizes on the streets in area. The spaces on the street appear t smaller, being from 7.2 to 8.6 feet wide. A bank across the str has a backup aisle of L7 feet, anoLher has backup of only L6 fee walked around parking lots and counted 68 compact si-ze cars and standard sj-ze cars. After brief conditions in space be parking spaces and that a Motion vas seconded by Councilman Amst.rup, on ro11 call voEe. and carried unanimously 5-0 PUBLIC HEARING - ABATEMENT OF IMPROPER SEWERS ORDERING ABATEMENT OF IMPROPER SEWERS RESOLUTION 33-87 Director of Public Works reviewed hi.s meno of April 11n which he recommended council hold public hearing by listening ta individualprotests and r ule on each one heard, then adopt a resolution ordering abatement of improper sewer connections. In early 1986, Public Works Department senE notices to all residences which appeared to have sewer1eaks. In November 1986, counci.1 adopted a resoluti.on rrDeclaring Improper Sewer Connections a Nuisance. rr In March 1987, PubIic Workssent a second notice to parties who had not made repairs to theirsewers. This notice requested that objections by submitted in urj-tingLo the City C1erk by March 24, 1987 and that a public hearing would beheld tonight. Trro protests were received from CuI1en, 745 Farringdon, and Hectemat, L628 Quesada. Should any work remaj-n to be done aftercouncil adopts this resolution ordering abatement, staff w111 contractto make repairs, proceed with bill-ing and, if not paid, will place onthe tax rolls after another public hearing at a later date. Mayor Barton noted Councilmen Anstrup and Lernbi had interviewed candidates for one position on the Planning Commission tonight would nake a recommendation at the next meeting. n) nd ing Councilrnan Lembi inquired if this hearing is differeot fron the one held in January. Publ-ic Works Director replied the January hearing was for inproper yard drains, roof drains and sump pump connections to sewer lines; this hearing is for leaking sewer laterals. Mayor Barton opened the public hearing. Roy Hectemar,, L628 Quesada, objected strongly to the fact that city knew about this a1"J,eged leak since April 1983 and only notified him last year. He just bought the home in July of 1983 and the former owner should have been held responsible for Lhese corrections. He has to take time off work to be there when ciLy or plumber makes tesiEs and he has nissed work twice and will have to take off again for the retesting. He also objected to having t.o make repairs within a year, when the city did not notify him until three years after it becalne aware of the problen, He received notice that he must move cleapout to city property. He had plumber out to look at these problems and it will cost him $3,000 to $5,000. Director of PubIic Works clarified for council that Hecteman does not have to nove cleanout, but if he wants city to be responsible for the cleanout, it must be noved to city property. He revieued the 1983 snoke testing program and staff and council review of the leaking sewer problen which 1ed to adoption of our present inproper sever abatenent progran. He noted that llectenanr s objection should be continued to the next neeting. Council sympathized wlth Hecteman, Mayor Barton feared due to t.he Lengthy process council would have more conplaints like this one. Council continued Hecteman to next meeting. There being no other conments, Mayor Barton cl,osed the public hearing. Councilman Mangini moved adoption of RES0LUTION 33-87 with proration of Ruthellen Rosenbergerrs bil1j,ng for a four year period and uith twoproperties continued to the next meeting (Hecteman and Boden). Seconded by Councilnan Amstrup, carried unanimously by voice vote. PLANNING COMMISSION APPOINTMENT CONTINUED and INTRODUCTION YARDS OF ORDINANCE 1341 RESTRICTING PARKING IN FRONT AN SIDE CiLy Planner reviewed her memo of March 31, in which she reconmen council introduce this ordinance for proposed changes to parking requirements which eli-minate parking in the front and side yards except in driveways. I SPECIAL ENCROACHMENT PERMIT FOR FENCE AT 1701 BROADWAY Senior Civi-1 Engineerts nemo of March 27 recommended council approve this permit subject to standard conditions and additional conditions requiring fence and hedge height and tree trinming1j-mits be met as requi-red by city code. Councilrnan Pagliaro noted this gate is on the diagonal at the cornerloL and does not block sight line. The property owner protests the city requirement that he cut height of gate. Ci.ty Planner said the owner needs a fence exception if present height is a11oved. DENIAL OF CLAIM: HELEN ROGERS 34 Council unanimously voted to deny Lhe claim of Helen Rogers. Councilman Amstrup moved to a1low the encroachmenL permit as recommended by staff, reducing the height of gate to three feet. motion was seconded and failed,2-3 on ro11 call vote, Councilmen Lembi, Mangini and Pagliaro voting no. Councilman Pagliaro moved to all-ow Lhe encroachment permit and a grant a fence exception to allow the gate to remain at its four one half foot height. Seconded by Councilman Mangini, carried 3 ro11 call vote, Councilman Anstrup and Mayor Barton voting no. COUNCIL OF MAYORS, TRANSPORTATION SALES TAX Mayor Barton reviewed the past Council of Mayors meeLing at whic had objected to the makeup of the Transportation Committee. Cit want t,o have four representaLives on this committee but Board of Supervisors had recommended t,wo representatives. Now the Board agreed to allow four representatives from the cities. Councilman Amstrup stated he would like to represent the mid cou this transportation committee. This committee will decide how m from the proposed half cent tax would be spent; people will pay tax for 15 years if it is approved; the Supervisors are talking BART link when originally they talked about improving streets; c needs to have input int.o this committee. Mayor Barton also noted the stand taken by San Francisco Supervi on moving CalTrain depot for the Mission Bay project in San Fran she asked staff write a letter to San Francisco objecting to its position on the train and ask other cities in county as well as Board of Supervisors to also wriLe San Francisco with their objections. PARKING LOT STICKERS Councilman Pagliaro noted council had recei-ved letter requesting stickers for autos using all day lots, because when they leave a lunch they cannot get their space back and must pay for another parking space or risk getting a ticket. He requested Traffic Commission sLudy this idea. Councilman Pagliaro also i-nquired about the item in Newsletter regarding undergrounding utilities on Airport; he wondered why v undergrounding on the bayfront when there are so many residentia areas needing this service. DirecLor of Public Works reviewed t need to underground the high tension lines on Airport and that will use all undergrounding funds until 1991. City Manager recommended thi-s be allocated during our regular Budget process in June to groups that received funding previously. Councilman Pagliaro did not see why we should limit this to groups previously funded. SAVE OUR DELTA Mayor Barton asked if council wished to support the letter fron the Coalition to Save Our Delta. Councilman Pagliaro noted no c j-ties from San Mateo County showed any support, he favored support. City Attorney and Director of Public Works will report back to counciL. Mayor Barton inquired about any uater conservation measures city is considering, Director of Public Works responded city will print notices on water bills asking citizens to conserve water. PARKING 72 HOURS Mayor Barton wondered what can be done to controL people parking for oter 72 hours in same place, City Attorney and Chief of PoLice revj.ewed overnight parking pernits, need for public to notify police sooner since police have to tag the car, then wait for 72 hours before they can tow. STATE I"IANDATE WATER CONSERVATION Councilnan Pagliaro suggested city write opposition to legislation mandating district elections in all cities. ACKNOWLEDGMENTS a.
