HEARING TO FEBRUARY 2 FOR 1730 ROLLINS ROAD APPEAL COMMERCIAL RECREATION FACILITY Mayor Barton noted a letter had been received from George Eshoo, attorney for applicant, requesting another continuance of this appeal hearing. Cj,ty Attorney reconmended council grant the continuance. REVIEW OF INSURANCE OFFICE AT ADELINE MARKET SITE RESOLUTION 8-87 - APPROVING SAME 1502 ADELINE DRIVE Cj-ty Planner reviewed her nemo of January 13 in which she reconnended council hold a public hearing and lake action. The applicant is requesting a special use pernit to open an 828 square foot insuranceoffice in the Adeline MarkeE complex. A use perni! iq required forall uses on this site as part of its rezoning. Ihe proposed office would have three ful1 time and two par! time employees initialLy, andfour full time employees in five years. Daily visitors to the office should be about flve. A11 enployees and customers will park in the 21off street parking spaces provided on the complex's site. Long ternparki-ng needs would be four spaces per day. Planni.ng Commissiongranted the use permit at the December 8, 1986 meeting. Councilman Pagliaro wondered if any parking studies had been done for t.he site. City Planner responded no. Mayor Barton opened the public hearing. Edward Spencer, appl-icant, revier.red that his business is mostly done by telephone or hone visits. Councilman Anstrup questioned running a business with three agents and only one part time secretary, he noted he was familiar with insurance business and was sure Ehey would need more secretarial he1p. He said he ca1led this up for revier.r because he does not uant the Adeline complex to become an office area. Spencer responded noting in their case agents do most of their paper work themselves, thus they do not require nore secretarial help. Councilman Pagliaro asked j-f Allst.ate is the ouner of this business. Spencer responded Allstate is their employer and ovns the business. Councilman Pagliaro stated he nould abstain from any further discussion or Lhe vote because his f i-rm is retained by A1lstate. PLEDGE OF ALLEGIANCE TO THE FLAG Led by Direct.or of Public Works, Ralph Kirkup. ROLL CALL Councilman Mangini noved to continue this public hearing to the February 2 meeting. The motion was seconded and carried unanimouslyby ro11 cal l vote. 497 Gina Hughes, Assistant Manager for Al1state, further explained the business and urged approval. Manora Terrel1, property owner, relayed the difficulty in finding a tenant for this site because of the restrictions on hours of operation and parking; this tenant would cause the least impact. Mayor Barton noted council had received a letter from Terrell. Mayor Barton closed the public hearing. Council noted it uould like to amend the conditions to allow only one part time ernployee. City Planner noted the permi t would be revieved in one year, January 1988. Councilman Amstrup noved to uphold the Planning Commission approvalwith conditions noted and amended. Seconded by Councilman Lembi, carried 4-1 on ro11 call vote, Councilnan Pagliaro abstaining. COMMISSIONER APPOINTMENTS AT NEXT MEETING Mayor Barton stated council has been intervieving candidates and suggesLed that action on appointment of comnissioners be continued to the next meeting, council concurred. Councilman Lembi noted in the report on commissioner absences Ehe Park and Recreation Commission had canceled four of the last six neetings due to lack of a quorum, he was concerned about this. Mayor Barton agreed. Ciuy Manager explained that this commissionrs normal procedure is for the Recreation Director to call conmissj.oners to renind them of meet j.ng, if too few will be present then the neetlng is canceled. Councilman Pagliaro said if meeting is canceled because commissioners will be absent, then their absence should be counted, Council noted no other commission is ca1led before meetings. Staff noted the practice of calling before neetings can be stopped and wewill review the resolution regarding comnissioner absences to see i,fit needs to be changed in order to count these absences. SCHEDULE PUBLIC HEARING FOR TEBRUARY 2 ON FINAL EIR FOR SEALING CITY DUMP, PLACEMENT OF A LEACHATE BARRIER, PUBLIC ACCESS, AND RECONSTRUC- TION AND EXPANSION OF AIRPORT BOULEVARD City Planner reviewed her memo of January 13 in which she reconnendedcouncil schedule public hearing for February 2. Councilman Pagliaro noted he had already read the Final EIR and found it inadequate; he requested that groups who use Bayside Park be notified of this public hearing; he noted the t.itLe of the EIR does not mention the park and the possible impact upon it. Councilman Lembi agreed they should be notified, he said the recreation department would know which groups use the site. Mayor Barton uanted people to be anare this is only the EIR, it is not approval of the project. She noted if any park land is taken for the project, it would be replaced in another adjacert area and that the city is developing a much larger park. Councilman Pagliaro sLated j.f two neH lanes are added to Airport Boulevard in Ehe future it would wipe out almost all of the trees along Ai-rport Boulevard, people who use this park should be aware of this possj.bility. Councilman Mangi.ni stated even if council finds thi s EIR adequate, it does not mean the project is approved. City Manager said the EIR is only the environmental rcork for possibilities that the city might fund in the future. City Planner reviewed legal requirements for noticing people of these hearings. Councilman Lenbi mentioned four groups r.rho use this site. Mayor Barton asked that a letter be sent with the notice explainj-ng that this is only the EIR, not approval of the project. Mayor Barton scheduled Lhe public hearing for February 2, L987. Amstrup wondered if city should require insurance from recreation class instructors, since a child was injured in a judo c1ass. Council agreed it r.rould like to study this question. BURLINGAME City Attorneyts memo of January 5 reconnended council authorize $10,000 to our attorneys so that they can proceed with settlement discussion on a claim for injury to Alexander Rubio who was injured while participating in a city sponsored recreation judo cl,ass. Finance Director recommended approval of Warrants 3301-8 - 33422, duly audited, in the amount of $1,685,990.77 atd Payroll Checks 72036 - 72734 for the nonth of Decenber 1986 in the amount of $736,869.10. concur final Seconded Councilman Lembi noted sone time ago he had suggested that lhe rrFrom the Floorrr section of the agenda be moved to the beginning of the agenda in order to al1ow public conments at the beginning of the meeting instead of people having to wait until the end. He would like this puE on a study meeting agenda. Council concurred. h. DENIAL OF CLAIM - DENIS RICHARDSON City Attorney recommended denial. WARRANTS AND PAYROLL AGENDA ORDER 499 SCHEDULE REVIEW HEARINGS Councilman Amstrup requested council review of the Planning Commission acLion regarding an antenna at 1501 Bayshore. He also requested review of the iten on classes at 1308 Bayshore. Hearings were scheduled for the February 2, L987 neeting. Councilman Pagliaro noted he was not calling up the Harvey sign application for review. ACKNOWLEDGMENTS a. California Trucking regarding access for large Council inquired if city has access for large trucks. that an ordinance was adopted a year 3go, and staff iswhether it meets the current legislative requirements any changes to council. Staff responded re s ear ching and will bring OLD BOWLING ALLEY Councilman Lembi asked if city could require cleanup of the oldbowling al1ey building. Staff responded t.hat cities have the abilityto abate nuisances, but they did not believe Lhe building was a dangerto the public health and safety at the present Lime. FROM THE FLOOR A representative from Senator Quentin Koppts office asked council forinput on legislat,ion council would like to see introduced by SenatorKopp. Mayor Barton agreed with Kopprs concern about campaign spending 500 and it is a major concern of the people, and is a major concern. Barton noted the county of transportation. Councilman AmstruP noted the recommendation sent Lo council was compl-etely opposed to this councilrs stand on the issue. He suggested Millbrae Councilman Frank Cannizaro would be a good representative. Councj-Lman Pagliaro moved to support Frank Cannizato as a candidate to the JPA, seconded and carried unani-mously by voice vot.e. CLOSED SESSION - ADJOURNMENT IN MEMORY OF DR. MARTIN LUTHER KING JR.
