The meeting was called to order aL 7t44 p.m. by Vice Mayor lrving S. Amstrup . PLEDGE OF ALLEGIANCE TO THE FLAG Led by City Attorney, Jerome F. Coleman. ROLL CALL COUNCILMEMBERS PRESENT : COUNCILMEMBERS ABSENT: MINUTES BARTON, LEMBI , MANGINf ( vacation ) AMSTRUP, PAGLIARO Minutes of the Regular Meeting of March 21,, 1988 were approved. 25. 42.030-h - RESTAURANTSAPPEAL OF CODE DETERMINATION - SECTION IN M-1 ZONE city Planner reviewed her memo of March 30 in which she recommended council review the request and take action. Bob Blunk, architect, requested a determination on the clarity of the wording of Code section 25.42.030-h. He feels that this section can be read to a1low large freestanding restaurants. This section, because of its emphasis on size and dimension, implies regulation of smaller coffee shop uses. The Planning corunission reviewed this request at the meetinq of March 28 and determinedthat it was the intent of Section 25.42.030-h to regulate smaII coffee shops and delis and to preclude large freestandingrestaurants. She acknowledged a letter to council dated March 31 from Blunk. vice Mayor Amstrup invited comments from Bob Blunk. Bob B1unk, architect, explained that his clients would like tobuild a restaurant in the M-1 zone at a site that is currently an eyesore warehouse at the corner of Burlway and Bayshore. He andhis clients have been discussing this project with the Planning Department for over four months and applied for a special permit and have received a traffic allocation for the project, then recently the Planning Department determined that the code did not aI1ow restaurants; they appealed to the Planning Commission which also found restaurants are not allowed. He noted that the Sheraton Hotel and Hyatt Hotel are in this zone and have restaurants; that bars are aIl-owe and that Gullivers Restaurant is section was intended to regulate d,in sma as is commercialthis zone. He requested that council decide in favor of the applicant's interpretation. councilwoman Barton agreed that the intent of the code section was to regulate delis, but also felt that council did not want large restaurants in this area. She thought the code section was confusing. councj-Iman Mangini supported the Planning Commission, which held the code section regulated delis and precluded restaurants !'rhich were the primary use of a building, and he felt the language needed clarification in the code. CALL TO ORDER 187 Councilman Lembi stated he agreed that the code was ambiguous; objected to persons going through ]engthy application process find that a use is not alIowed. The code needs clarifying. he to Councilman Mangini moved to sustain the Planning commission's determination and also that clarification of this code section be studied and brought to council-. Seconded by Councilman Lembi. In response to council, City Planner noted that Gulliver's Restaurant is in the M-L zone therefore not complying vrith the code section as they sa$, the language but was built before this item was added to the code. The motion was carried unanimously 4-0 by ro11 call vote, with Mayor Pagliaro absent. a RESOLUTION 29-88 - ACCEPTING STATE GRANT FOR LIBRARY, OLDER ADULTS MATERIALS city Librarian's memo of March 29 recommended council acceptgrant of $5,000 to the Library from the state to provide for purchase of library materials of interest to senior citizens. RESOLUTION 30-88 - ACCEPTING COMPLETfON OF WATER SYSTEM IMPROVEMENTS - JOB 525 city Engineerrs memo of March 30 recommended council accept the improvements installed by Manuel C. Jardim in the amountof $336,542.05. c RESOLUTION 31-88 WITH ANGUS NELSON - APPROVING AGREEMENT FOR DRAFTING SERVICES LTD. Public Works Director's memo of March 30 recommended council- approve this agreement $10,000 and the transfeSalaries to Professiona drafting services not to exceedf $10,000 from Engineering ervices. DENIAL OF CLAIMS: (1) WITLIAM MEYER; (2) NERINA DI BELTA; (3 ) PETER BRA]LLIER City Attorney recommended denial of these claims for (1) a branch falling on a car, and claim being late; (2) trip on sidewalk and (3) alleged assault by police officer. RESOLUTION 32-88 . AGREEMENT WITH CALLANDER ASSOCIATES FOR SHORELINE B]KE/PEDESTRIAN PATH - JOB 8538 Assistant Civil Engineer's memo of March 30 recommended council approve an agreement for landscape architectural and BCDC permit application services in the amount of $5,534.50. f. ENCROACHMENT PERMIT FOR BRICK PITASTERS 72]. BAYSWATER city Engineerrs memo of March 29 recommended council approvethis permit with standard conditions and with a maximum hedge height of three feet. SCHEDULE HEARINGS vice Mayor Amstrup scheduled an appeal hearing for 14 Bloomf iel-d Road for the May 2 meeting. councilvroman Barton called up for council review the crowne Plaza Hotel project, she felt the floor area ratio was too great and should not be reduced by eliminating parking. This hearing was also scheduled for the May 2 meeting. b forroIS CONSENT CALENDAR d. Councilman Mangini moved approval of the Consent Ca1endar. Seconded by Councilwoman Barton, carried unanimously by voice vote. tB8 VANDALISM AT BAYFRONT AREA vice Mayor Amstrup mentioned extensive vandalism which happenedin the Bayfront Area and to the Hyatt Hotel project. Staff responded it appeared to be caused by a large group of juveniles. Amstrup suggested a reward be posted for the conviction of these vandals. ACKNOWLEDGMENTS a b. Letter from Senator Kopp asking councilrs position on AB L69, change in funding of LAFCOS. Council discussed briefly, teague of California Cities is supporting this legislation. It would transfer part of costs of supporting LAFCOs to cities; Burlingame's cost would be about $5, ooo. Proclamations: National Tefecommunicators Week, and cancer Awareness week. Letters regarding Hetch Hetchy from Bay Area Water Users Association and from congressman Lantos. Letter from Chamber of Commerce about Burlingame Days at Embassy Suitesr Woolley State Park on September 24 and 25. Letter from San Mateo Association for Young Children requesting a proclamation. Vice Mayor Amstrup directed a proclamation be prepared but that the suggested wording be changed slightly. S. Letter from County cultural Arts Commission with request to make a slide presentation to council. Vice Mayor Amstrup inquired if council wanted a presentation andj-f so at a regular or study meeting. Councilwoman Barton suggested they send information to council first. councilman Mangini noted city has studied this before. Vice Mayor Amstrup suggested a brief five minute presentation might be appropriateat a future time . FROM THE FLOOR There were no comments from the fIoor.
