A duly noticed regular meeting of the Burlingame City CounciL was
held on the above date in the City HalI council Chambers. The
meeting was called to order at 7:31 p.m. by Mayor Donald P. Lembi.

Motion to approve minutes of the Regular Meeting of November 20,
1989 by Councilman Harrison, seconded by Councilwoman Barton,
carried unanimously by voice vote.
RESOTUTION 724-89 - APPROVING INCREASE IN REFUSE COLLECTION RATE .
RESOLUTION 125-89 - APPROVING INCREASE IN RECYCLING RATES - ADVISE
BFI NOT TO COMBINE RECYCLING AND REFUSE RATES ON CUSTOMER BfLtS
Finance Director reviewed his memo which recommended council approve
an 11.9 percent rate increase for refuse collection services by BFI
and a 10 percent increase in recycling charges to be effective
October 1, 1989. BFI also requests that council advise t/thether the
rates should be combined into one rate on customer bi1Is or kept
separate. The present agreement with BFI was negotiated in 1987 and
this agreement requj-red a rate freeze until October 1989, however
rates have not changed since 1984.
Councilman Pagliaro inquired why the agreement does not provide for
a definitive period. Director responded that the master agreement
of 1987 contains the definitive period; rates would be reviewed each
october. Councj-Iman Pagliaro also wondered vrhat the rates are based
uponi Director responded the rates are for residential and
commercial collection.
Councilman Harrison wondered about possible increased costs of use
of Aponolio Canyon. Director said any increased costs might be
considered extraordinary charges and the master contract allows for
renegotiation of the contract in that case. Councilman Harrison
calIed the public's attention to the fact that Burlingamers rates
woutd still be lower than other cities; Director agreed, the city
would be 21 percent lower than the average of county cities.
Councilwoman o'Mahony inquired about the losses from the recyclj-ng
program; Director felt the losses are the result of the falling
market for recycled materials.
Councilwoman Barton moved adoption of RESoLUTIoN 124-89 Approving
Rate Increase for Refuse Collection and RESOLUTION 125-89 Approving
Rate fncrease for Recycling Program. Seconded by Councilman
Harrison, carried unanimously by voice vote.
Council briefly discussed the combination of the refuse and
recycling rates on customer bills and agreed that the rates should
be kept separate. Councilman Harrison moved that council advise BFI
to keep rates separate. Seconded by Councilwoman Barton, carried
unanimously by voice vote.
COIiNCIL ASSIGNMENTS
Mayor Lembi distributed a list of his appointments for council
assignments to various committees and commission interview teams.

Councilman Pagliaro moved approval of the Mayorrs assignments.

COMMISSION CANDfDATES
City Manager reviewed list of 29 candidates to the various
commission vacancies. councilman Pagliaro asked that since there
are only three candidates to the Beautification Co[unission the
filing period be continued until December 15. He also noted that
there may be another opening on the Planning Commission in a few
months and suggested council might interview for both openings.
councilwoman Barton agreed, noting council wants to appoint Planning
Commissioners early in order for them to have an preparatory period
before beginning their term. Intervier^, teams are to inform City
Manager of dates for interviews.
CANCEL DECEMBER 18 COUNCIL MEET]NG
Mayor Lembi asked if council had any objections to cancelinq the
neit regular meeting due to the holidays. council had no objection.

CONSENT CALENDAR
Mayor Lembi commented on the preposterous requirements of one
government agency from another government agency regarding San
Francisco water Departmentts lease agreement, Item c, which requires
the city to provide a faithful performance bond. Mr. Sopko
requested to make co[unent on Item G which was removed from consent
Calendar.
ENCROACHMENT PERMIT FOR DRAINAGE LINE IN DRAINAGE EASEMENT AT
1718 ROLLINS ROAD
Public works memo of November 294 recommended council approve
this permit subject to the requirement that the property owner
be responsible for the maintenance of this drainage pipe.
FOR IAND AT BROADWAY AND ALONG CALIFORNIA DRIVE
Public Works memo of November 29 recommended council approve an
agreement with San Francisco Water Department for leasingt
property along California Drive from Broadway to a point 170
feet south of Trousdale Drive. The terms of the lease are five
years wj-th an option to extend the term an additional five
years with the lease being on a monthly basis thereafter.
There is provision for condemnation if the city decides to
acquire part or all of the property by fee simple. It also
requires that the city provide a surety performance bond in the
sum equal to six months rental to ensure the city's faithful
performance of the lease.
RESOLUTION T27-89 - AGREEMENT BETWEEN SAN MATEO COUNTY AND CITY
FOR UPGRADE OF CIVIL DEFENSE MICROWAVE SYSTEM
City Managerrs memo of November 28 recommended council approve
this agreement with the county to fund replacement components
for the county-wide mj.crowave system. Burlingame's share of
the project cost is estimated to be $10,378.

terminating the earthquake emergency. On October 17 the Mayorproclaimed a local emergency due to the great earthquake ofthat day, councj-I ratified the proclamation on October L8. Thesituation is now vrithin control- of normal protective services
and council can termj,nate the emergency.

s DENY REOUEST FOR APPEAL HEARING FROM LONNIE SOPKO FOR SE I
City Attorney's memo of November 21 recommended council denythe appeal as untimely. On November 13 the Planning Conmission
denied a use permit for commercial recreation at 1317 NorthCarolan. The applicant, Mr. Lonnie Sopko, rras informed of the
appeal deadline at the Planning Commission meeting as was his
son who vras also present at that meeting. The son was at the
Planning Department on Friday November 17 and was again
informed that the time limit was the end of the next council
meetingr; he was offered writing material to make an appeal atthat time but declined. On Tuesday November 21, the day afterthe close of the appeal period, the City Clerk received an
appeal letter by hand delivery from Mr. Sopko.
Mr. Sopko said he felt an injustice was done at the Planning
Commission meeting because the denial was based on inappropriate
information about parking. City Attorney advised council against
accepting the late appeal . Councilman Pagliaro inquired about the
age of Mr. Sopkois son, he responded 20 years of age.
Councilwoman Barton felt council should take the advice of its
attorney and moved to deny the request for an appeal hearing.
Seconded by Councilwoman orMahony, carried unanimously.
City Attorney advised Sopko that his only recourse is the courts, orthat he could reapply to the Planning Commission for the permit forthis use at this site in one year.
COUNCIL COMMITTEE REPORTS
Councilman Pagliaro said he and Councilwoman O'Mahony had attended a
recent meeting offered by Congressman Lantos regarding earthquake
damages, he noted they were the only council members present fromthe Peninsula. He wondered when the "unreinforced masonryfi issue
would be coming before council. Director of Public works respondedthat it would be reviewed by council at the December 6 studymeeting. Councilman Harrison wondered if there were any
recommendations for URIII other than in those in the study packet,
Director responded no.
NEW BUSINESS
Councilwoman Barton coflunented on the report by the City Manager
regarding convention centers and suggested this report be sent tothe local papers. council concurred.
Mayor Lembi asked if councj-I had any objections to a vote for
Councilmember Stangle of Redwood city at the upcoming Council of
Mayor meetj-ng. Council had no objection.
Councilman Harrison moved approval of the consent Calendar,excluding Item G. Seconded by Councilman Pagliaro, carried
unanimously by voice vote .
Mayor Lembi adjourned the meeting at 8:00 p.m. to a closed session
regarding labor negotiations.

Councj.lman Harrison noted an upcoming issue for Traffic Commission
regarding 741,/761 Rollins and that he hoped the commission would
