PRESENT: COUNCILMEMBERS AMSTRUP,BARTON, LEMBI , MANGfNf, PAGLIARO ERBACHER, KTRKUP, MONROE, WAGNERSTAFF PRESENT: ARGYRES, COLEMAN, 1. REVIEW CREEKSIDE STUDY The Public works Director reviewed the requirements of the interim ordinance which established construction restrictions i-n the 100-year flood area plus ten feet on either side. The interim or- dinance expires on November 20, 1989, unless extended; only one more extension may be granted. IIe then reviewed the preliminary data from the drainage study. our consulting engineer has walked and inventoried the creeks, gathered rainfall data, and calculated L0o-year flows at specific locations. Based on this data, staff needs Council direction in order to identify further studies neededto develop a permanent ordinance. Staff reviewed with Council four different cases of hot^, to estab-Iish setbacks in different tl?es of creek areas. fn response to the discussion questions, Council agreed that the interim ordinance should be extended for nine months to allow for additional study and review by the Planning Commission. Councilman Pagliaro felt that a fixed minimum setback was needed and that this should be determined by the 1"00-year flow line plus a setback areai however, some variance procedure should be con-sidered. He felt that staff needed additional study of the data to determine precisely how large the setback should be. Council con- curred with councilman Pag1iaro. Additionally, they felt that any new creek improvement or construction within the area defined would need a city permit. Councilwoman Barton expressed an interest in identification of areas in which trees and vegetation should be preserved. Council also felt that no new footings or overhangs should be placed within the 100-year flow area, plus the determined setback. It was agreed that some provision needed to be in the permanent ordinance to aI- low rebuilding of existing structures. Staff was directed to bringto the Council a g-month extension of the current interim or- dinance . 2. RECREATION CENTER BUILDING RENTAL POLICIES Mayor Amstrup stated that he has received complaints concerning the August 13 rental of the Recreation center for an auction. This seemed to be a commercial venture which did a great deal of adver- tising. Recreation Director reviewed the current building rental-policy and the unusual types of rentals that have occurred. Coun- cilman Pagliaro felt that we definitely needed more guidelines in order to restrict commercial use of the Recreation center. coun- cilwoman Barton agreed that the Recreation Center should not be used for personal benefit of commercial businesses that would com- pete with merchants /tenants in the City. It was the consensus of the council that the Recreation Department should develop additional guidelines to restrict the use of the Recreation Center for commercial salesi hovrever, this would not in- clude localLy based non-profit groups. 3. COUNCIL COMMENTS The city Manager presented Council with copies of the unreinforced masonry material which will be sent out this week, and the City Planner presented them with the requested information on the Edgehill rezoning in advance of the next council meeting. 423 Mayor Amstrup noted that there was a meeting on September 28 con- cerning the fairground's future and that all Council members are invited.
