A duly noticed regular meeting of the Burlingame city Council was
held on the above date in the City HaII Council Chambers. The
meeting was caIIed to order at 7232 p.m. by Mayor frving s. Amstrup.

Mayor Amstrup opened the public hearing.
Stephen Antonaros stated the owners are willing to submit revised
drawings that wiII comply with the declining height envelope
requirements, therefore at this time they are only asking for the
parking variance. He noted that they can and do park two cars in
the garage, and the bathroom in the garage is adjacent to a room
used by the elderly mother who Iives $rith the Mariani's and the
bathroom is also needed for the backyard pool.
Cj-ty Planner responded to council questions regarding measurement of
garage for parking spaces.
Mrs. Mariani spoke in favor of the request, stating a need for theaddition, and the bathroom in garage for her aged disabled mother.
Speaking in opposition to the declining height variance was Alan
Horn, 1325 Paloma. when council pointed out that the request for
variance to declining height had been dropped, Mr. Horn had no
further obj ections .
Mayor Amstrup closed the public hearing.
Council agreed that it had no objections to the parking variance
since two cars would fit in garagei they $rere opposed to the
variance to the declining height envelope; they noted the bathroomin the garage is needed for the disabled mother.

Councilwoman Barton moved to sustain the Pl-anning Commission denialof the variance to the declining height envelope and to approve theparking variance to width and length of the garage as requested byapplicants. Seconded by Councilman Lembi, carried unanimously 4-0 on
ro11 call vote.
APPEAL FOR AMENDMENT TO CONDITIONS OF ZONING AT 1501 EL CAMINO REAL/
1508 ADELINE DRIVE
Mayor Amstrup closed the public hearing.
Council members commented that they supported the Planning
Commission denial; this j.s a local market for the neighborhood and
7:00 p.m. closing time should be adequate; this area should stay
smaIl, it is not meant to compete with l-arge supermarkets.
Councilwoman Barton moved to uphold the Planning Commission denial .
Seconded by Council-man Lembi, carried unanimously 4-0 on ro11 call
vote.
APPEAL OF SPECIAL PERMfT AND PARKING VARIANCE FOR TEA ROOM AND STORE
AT 1105 BURLINGAME AVENUE
City Planner reviewed her memo of April L0 which recommended council
hold a public hearing and take action. Herb and Karen Strange are
city Planner reviewed her memo of April 7 which recommended council
hold public hearing and take action. In January 1984, the council
adopted ordinance 7266 rezoning the subject properties from R-3 to
C-1 (retail and service commercial). At the time of rezoning theproperty on Adeline was developed as a neighborhood shopping area
including a grocery store and the property fronting on El camino was
used as a gas station. The gas station site is presently vacant.
Because of the surrounding residential area council placed eight
conditions on the zoning; one of these conditions limited the hoursof operation of these sites. The applicants had presented apetition signed by 625 persons in support of the amendment tozoning. Three letters in opposition were received, and tonight she
had been presented srith tvro petitions in opposition which had been
circulated by neighbors of the project. The Planning Corunission
recommended that council deny this request because of the impact on
the residential neighbors and because of the intention for use of
the site for a convenient coflunercial area for the immediate
neighborhood.
Mayor Amstrup opened the public hearing to those in favor.
Mufid Shehadeh, applicant, asked approval because of the need to
serve customers at a later hour and to compete vrith nearby markets
which are open 24 hours. He noted that he has been at that site for
four years and has never had any problems. He urged a trial period.
AIan Horn, 1325 Paloma, spoke in favor; he shops at this store, this
change in hours would be a convenj-ence to shoppers. Another
resident spoke in favor, she arrives home after 7:00 p.m. and would
appreciate the store being open then.
Speaking in opposition was Margaret Lake, 1148 Oxford. She notedthat the store is frequently open now after the 7:00 p.m. closingtime. She had observed people knocking on door after closing and
being allowed in to shop. She had spoken to the manager of Lucky
who was surprised that the Adeline Market was losing business
because of their being open 24 hours; they had been open until 11:00
p.m. when the market at Adeline was approved. she objected to the
large signs and banners at the site and feared it would attract
passers by from EI Camino ReaI if it were open at a later hour.
An employee of the market stated that it takes three hours to close
the market and agreed that sometimes people have been alIov;ed to
shop during the closing-up time; she said they are trying to serve
the neighbors and urged approval of the request to extend hours.
Inez Kosta, L517 Adeline, spoke in opposition, she lives very near
and feared disturbance with later hours.

requesting a special permit and parking variance in order to operate
an English tea room/gift shop and office on the second floor at 1105
Burlingame Avenue (zoned c-1, Sub Area A). A special permit is
required for a food establishments in Sub Area A. The code aIIows
31 food establishments in this area and with the recent closure of
Agatha's there are 30. The parking variance for three spaces is
required because of the change and intensification in use proposed
for this upstairs area. The Planning Commission denied these
requests at its April 10 meeting.
Mayor Amstrup opened the public hearing.
Herb Strange, applicant, reguested approval; he noted the office
would be for his use for his personal business, not rented out; he
was concerned that council members had not visited the site, council
assured him that they were aII familiar with the property, and
Councilman Lembi noted he had worked next to the store for 72 years.
Strange said he has been a resident of the city for 23 years; thisis a new concept for Burlingame Avenue; he noted that rents on thefirst floors on Burlingame Avenue are just too high; he found
adequate parking in the surrounding area, excluding the parking 1otat rear which is fuII of employees of nearby stores.
Mayor Amstrup closed the public hearing.
Councilwoman Barton stated that council is spending $4 million on
downto\"rn parking so it is well aware of parking problems, and she is
amazed that someone would ask for a parking variance on Burlj.ngame
Avenue and say there was no parking problem; she was surprised that
no one from the Chamber of Commerce was objecting to this request.
Council members agreed with Barton.
city Planner reviewed her memo of April 21 which recommended council
review the request and take action. There is one request for atraffic allocation for a hotel on the property adjacent to Kincaid'srestaurant. The applicant, Pranav Hotel, is requesting allocationfor a 150 room hotel on 2.4 acres of vacant land off Bayview Place
and Airport Boulevard. The project wouLd be at a density of 62.5
rooms per acre, where the Specific Area Plan allows a maximum
density of 65 rooms an acre. The traffic impact will be within theallocation to the critical intersections from this parcel.
Councilwoman Barton moved to approve the traffic allocation.
Seconded by councilman Lembi, carried unanimously by voice vote.
AMUSEMENT PERMIT - HYATT HOTEL: DAWSONI S RESTAURANT AND ATRIUM AREA
City Attorney reviewed his memo of April 12 which recommended
council grant an Amusement Permit to the Hyatt Hote1 for the Atrium
area of the hotel and for the new Dahrsonis Restaurant. There were
no adverse cornments from city departments.
Councilman Lembi said while he worked in that area he had observed
employees and business owners feeding meters in the public parking
lot at the rear of this building, they are impacting business in the
area by doing that; he said the tea room was a good idea, but the
h,rong location.
councilman Pagliaro moved to sustain the Planning Commission denial.
Seconded by Councilwoman Barton, carried unanimously 4-0 on roIIcall vote.
TRAFFfC ALLOCATIONS - MAY 1989
councilman Pagliaro expressed concern about parking, particuJ-arly inIight of the problems at Marriott Hotel; there appears to be a realproblem with parking at some of our hoteJ-s, he thought the overallparking requirements might not be adequate. Richard Adie, ceneral
Manager of the Hyatt, responded that the Hyatt has over 800 parking
spaces and parking has not been a problem; the original permit forthe hotel included these entertairunent functions. other council
members noted they have never experienced parking problems at the
Hyatt .

Councilman Lembi moved approval of the Amusement Permit for the
Hyatt Hotel. Seconded by Councilwoman Barton, carried unanimously
by voice vote.
REQUEST FOR STOP SIGNS ON BROADWAY AT LAGUNA AND AT PALOMA
Dj-rector of Public Works reviewed the memo of April 20 which
recomnended council concur with the Traffic corunission and deny the
reguest for stop signs as requested by Broadway merchants.
Councilman Pagliaro moved to uphold the Traffic Commission's denial-.
Seconded by Councilwoman Barton, carried unanimously by voice vote.
REO UEST FOR TWO HOUR PARKING ON ANITA BETWEEN BAYSWATER/PENINSULA
Director of Public works reviewed the memo of April 19 whj-ch
recommended couneil concur lvith the Traffic Commission and deny the
request for two hour parking along the west side of Anita Road
between Bayswater and Peninsula Avenues. Putnam Buick originatedthis request; the Traffic Comnission denj-ed hrithout prejudice in
order for the auto dealer to negotiate vrith SP railroad for use ofits land for Putnam employee parking.
Councilman Lembi stated that area on Anita is greatly impacted with
auto dealers and the dealership has a large parking garage in that
area that should be used for his employees. He moved to uphold the
Traffic Commission denial without prejudice. Seconded by
Councilwoman Barton, carried unanimously by voice vote.
REOUEST FOR ENCROACHMENT PERMIT FOR FENCE AT 1309 BALBOA
Director of Public Works reviewed the memo of April 25 which
recommended council deny the request for a backyard fence which
encroaches four and one half feet into the ten foot aIley easement.
The fence does not appear to impact the sewer main that runs through
the back of the properties along the 1300 block of Ba1boa and Cortez
but staff recommended denial to discourage future similar applica-
ti-ons which could block the easement or build over the sewer main.
Councilman Pagliaro inquired about fence permits and height of
fence .
Council members noted that this is a nice fence and yard, but they
could not go along with allowing people to use cityrs proPerty for
their private yards.
Keith BorraII, son of applj-cant, requested approval and told of
misunderstanding about ownership of property, they thought it
belonged to PG&E and that entity had no objection to use of land so
the applicant built the fence.
councilwoman Barton moved to deny the request for an encroachmentpermit. Seconded by Councilman Lembi-, carried unanimously by voice
vote .
REOUEST FOR ENCROACHMENT PERMIT FOR WALL AT 2920 TROUSDALE
Director of Public Works reviewed the memo of April 27 which
recommended council approve this request subject to standard
conditions and the conditions that an open visibility handrail be
added to the wall to a minimum height of 20 inches with supports
5 foot centers to avoid a possible hazard.

Councilwoman Barton moved approval of the encroachment permit with
conditions. Seconded by Councilman Lembi, carried unanimously by
voice vote.
REOUE ST FOR ENCROACHMENT PERMIT FOR FENCE AT 2T2O ADELINE
Director of Pub1ic Works reviewed the memo of April 26 which
recommended council deny the requested permit for a six foot wooden
fence at the back of sidewalk with a sliding gate on the driveway;
if council chooses to approve the permit staff suggested that the
fence be angled back toward the driveway and that swinging gates be

instal-Ied to j-ncrease visibility at the driveway. This is a corner
lot which fronts on Adeline; the subject fence and garage/driveway
are on Columbus Avenue .
Seamus Davine, applicant, requested the fence with sliding gate asoriginally requested. He would not be able to close the swinging
gate with a car in driveway and if opened the other way the gates
would block the sidewalk. He discussed with council various
alternatives; Davj-ne noted there is very littIe traffic on this sideof his property which opens onto Columbus. After further
dj-scussion, council agreed there was no other alternative and they
could approve this request because there is little traffic on
Columbus.
Councilman Lembi moved approval of the encroachment permit as
requested by applicant, Seconded by Councilwoman Barton, carried
unanimously by voice vote.
CONSENT CALENDAR
Councilman Lembi asked if the sidewalk project (b) was all that was
proposed for this year. Director responded that the project had
been split into t$ro parts; this being the first part. Councilman
Pagliaro inquired about the large contingency reserves for that job.
Director said this would be reduced after residents pay for theirportions of the proj ect.
a RESOLUTfON 55-89 - AMENDING AGREEMENT FOR SHARING ELECTRICAL
COSTS - PENINSULA AND EL CAMfNO REAL INTERSECTION
Public works memo of April 2L recommended council approve this
agreement with cal-Trans to include the intersection of
Peninsula and EI Camino in the sharing of costs of Statefacilities in the city.

RESOLUTION 57-89 - AMENDING AGREEMENT FOR DES]GN OF DIGESTER
IMPROVEMENTS - CP 429
Public works memo of April 27 recommended council approve this
amendment for the design contract for the Anaerobic Digester
improvements with Nolte and Associates amending fees from
$88,480 to $136 ,1-61 .84, funds to be appropriated from the Sewer
Fund.
RESOLUTION 58-89 - AMENDING AGREEMENT FOR DESfGN OF AIRPORT
BOULEVARD Pii}/IP STATION fMPROVEMENTS - CP 431
Public workrs memo of April 27 recommended approval of an
amendment to the agreement with Nolte and Associates for designof the Airport Boulevard Sewer Pump Station improvements at an
increased cost of $13,1-00, funds to be taken from the sewer
Fund .

CLOSED SESSION - LABOR NEGOTfATIONS
Mayor Amstrup adjourned the meeting to a closed session regarding
Iabor negotiations at 9:05 p.m. and he asked that the audience join
in a silent prayer in honor of the National Day of Prayer and also a
moment of sj-lence in memory of Marianne Ziganti, sister of the
Mayor's wife, who died recently; the meeting would be adjourned in
her memory.
