The meeting was cal1ed to order at 7:30 p.m. by Mayor Don Lembi. PLEDGE OF ALLEGIANCE TO THE FLAG Led by Public works Director Ra1ph Kirkup. ROLL CALL COUNCIL PRESENT: COUNCIL ABSENT: MINUTES BARTON, HARRISON, LEMBI , OIMAHONY, PAGLfARO NONE Minutes of the ReguLar Meeting of August 20, L990 were approved on motion of Councilwoman o'Mahony, seconded by Councilman Harrison. SECOND READfNG - ORDINANCE T42L - AMENDING ANIMAL CONTROL REGULA- TIONS AND INCREASING AND ADDfNG FEES city Manager reviewed his memo of August 10 which recommended council hold a public hearing and take action. As a result of rapidly increasing costs to cities from our contract for animal services, the Animal- Control Task Force (comprised of city, county and Humane Society representatives ) met to study costs and revenues. ft was agreed that a net reduction of $104,000 sras needed in 1990-91 and this reduction would be from a combinationof expenditure cuts and revenue increases. It is intended that al-I the cities and the county wiII adopt identical fees. Mayor Lembi opened the public hearing. There being no corunents, the hearing was closed. councilwoman Barton moved adoption of oRDINANCE 1421. Seconded by Councilwoman O'Mahony, carried unanimously 5-0 on roII call vote. INTRODUCTION OF ORDINA}iICE 1422 FOR SIDEWALK REPAIRS - LIMIT]NG RESIDENT RESPONSIBILITY Public works Director reviewed his memo of August 29 which recommended council introduce this ordinance. At the last meeting, council directed staff prepare an ordinance which would limit the circumstances in which homeowners would be required to pay for sidewalk repairs. Currently the city pays for repairs caused by city trees and the property owner pays for afl other repairs. The proposed ordinance would limit the homeownerrs responsibj-lity to damage they had actively caused and would apply to the R-1 and R-2 zones onIy. Council discussed excluding the R-2 zone because that is income property and the purpose of this ordinance is to help homeowners on fixed incomes i they wondered if there were a way to exclude properties which are used for home businesses, some of which have large trucks parked in front which can do damage to sidewalks and curbs; staff said it would be difficult to determine which properties in R-1 are income/rental property. Mayor Lembi was concerned about people who have been billed in the past, but he noted there has to be a starting point for this ordinance. councilman Harrison moved to forgive bills for current sidewalk project costs to homeowners and introduce oRDINANCE 7422 to limit homeo\"rner responsibility for sidewalk repair in the R-1 zone only. Seconded by Councilwoman Barton, carried unanimously. BURLINGAME, CALIFORNIA September 5, 1990 85 YEAR-END FINANCIAL STATUS City Manager reviewed his memo of August 27 with the Finance Directorts attached report and the sales tax analysis provided by the city's consultant Hinderliter, de Llamas and Associates. The report shows that the balances in the general fund, and the water and serrer enterprise funds are up as compared to last year's decreases. The city ended up in a better than anticipatedposition. He felt the sales tax analysis by the consultant wouldgreatly assist the city in following state collections and he recommended continuing this service on a quarterly basis. Councif members were pleased with the good news and particularly pleased rrith the consultant's report on sales tax; they found it very helpful and easy to understand; they complimented the Finance Director and city Treasurer on the reports. WATER RATIONING REPORT city Manager reviewed his memo of August 27 which reported that the city is 3.5 percent over our water allocation from the San Francisco Water Department. He noted that in 1988 the cj.ty $ras 8.9 percent over its allocation at this same time of year. Thecity received a penalty charge of $6,837 for the August billing period and our water billing office started penalties to city users with meter readings on or after the first of August. STATE BUDGET - NEW COUNSY FEES FOR CITIES City Manager's memo of August 24 reviewed the proposed new fees which the county would be charging cities as a result of the State budget. The county is proposing to charge a fee of $181for each prisoner booked into county Jai1. For Burlingame, this is estimated to be approximately $S0,000 for 1990-91. Burlingame's costs are considerably less than other cities because of our o$rn short-term holding jai1. Also mandated by State law are county charges for collection of property tax. The estimated apportionment of the county cost for Burlingame is $93,000 for 1990-91. Although the fees are manageable within ourcity's financial picture, there wilI be considerable discussion between the county and other cities which will be more heavily impacted by these fees. Councilman Pagliaro thought the city might charge the county forfire and police services in the unincorporated areas. City Manager noted the city already does charge the county for fire services; Police Chief said the police have a mutual aid agreement in which he can call on other cities and the countysheriff department for aid, he recommended against charging forthis service. Councilwoman o'Mahony wondered if the city can keep its prisoners for longer detention periods. Chief said that would require major improvements to our jail; we can now keep aprisoner for nine hours. Councilwoman Barton wondered about thecity handling its own property tax colLection; City Manager saidit would be an administrative nightmare; she asked what percentage of property tax goes to city and to county, city Manager responded 17 percent to city and 23 percent to county, the county has traditionally assumed all the cost of collectingproperty taxes, now they propose to charge costs to cities. Councilman Harrison said it was a one time fee. Councilwoman o'Mahony said the city has lost its cigarette tax money and thereis also a proposal for a hrater connection fee for the State; she asked that council write to legislators about the city's hope forrelief, council concurred. The Finance Director cornmented these taxes will fall hardest on people least able to pay. DELEGATE TO LEAGUE OF CALIFORNIA CITIES CONFERENCE councilman Pagliaro indicated that he would attempt to attendthis conference; no other council members or staff planned onattending. councilman Pagliaro was designated the delegate. Councilwoman Barton said these conferences are great, but she wondered who represented our area on some of the issues the League has taken positions on; she was particularly concerned about SB 2011 on which the League was neutral; this bill takes away local control of housing. City Manager said originally the league opposed this bi11, but now has taken neutral position; they probably negotiated some issue out of the bill and agreed not to oppose it; he noted it is a very political issue. CONSENT CALENDAR Councilman Pagliaro had a conflict on item C regarding Mi11s Canyon Slide Repair. a.INTRODUCTION ORDINA},ICE T423 - AMENDING URM ORDfNANCE TO ALLOW TIME EXTENSION BASED ON ECONOM]C HARDSHIP Public works' memo of August 29 recommended council introduce this ordinance and set public hearing for September 17. The council adopted ordinance 1419 on August 29 vrith an amendment to the timetable to requj-re all ownersto submit plans by January 1, 1995. The change affects language used in other sections of the ordinance and staff recommended this amendment for consistency. Council also directed staff to present a procedure for extending time periods and staff recommends limiting time extensions to circumstances of economic hardship. Council also discussed adopting a resolution which wouLd record with each property that there was a URM buildins on the site. It \"ras notedthat property owners are still- suppfying the city with engineering information and some buildings may be removed from the Iist. once the city has a firm list it will be presented to council. RESOLUTION 114-90 - ACCEPTING COMPLETION OF 1988-89 SIDEWALK CURB AND GUTTER REPAIRS - CP 825 B Public works memo of August 24 recolunended council accept this project as completed by Whiteside Construction in the amount of $238,47 4.69 . (1) RESOLUTION 115-90 - AUTHORIZING AGREEMENT FOR SOILS ENGINEERING SERVfCES - CP 802 Public Works memo of August 29 recommended councif approve an agreement r/rith Hallenbeck & Associates in the amount of $25,500 for geotechnical engineering services for thisproject to repair slide damage and replace sewer access road in Mills canyon. b (2 ) RESOTUTTON 115-90 ENGINEERING SERVICES - - AUTHORIZING AGREEMENT FOR CIVIL cP 802 d Public Works memo of August 28 recomrnended council approve an agreement with Brian-Kangas-Foulk in the amount of $8,921for the Mi11s Canyon Slide Repair. RESOLUTION 117-90 - AMENDING RESOLUTION 87-90 AND ADOPTING FEES FOR BYPASS METERS ON FIRE LINES Public works memo of August 29 recommended council adopt a fee of $250 for furnishing and installing a bypass meter on fire tines. This fee was inadvertently omitted when council adopted Resolution 87-90 establishing water rates, charges and related procedures . RESOLUTION 118-90 - DENYING VARIANCES, SPECIAL USE PERMIT AND CONDOMI NIIN{ PERMIT FOR 51 EL CAMINO REAL City Attorney's memo of August 21 recorrunended council adopt this resolution formalizing action at the August 20 meeting to deny this condominium project at 51 El Camino; the vote on this resolution wilf reflect that Mayor Lembi was absent. 86 f. DENIAT oF CTAIMS: (1) MARY CHAPPELL; (2) GARDINER BOSEY SMITH IfI HTS WIFE AND CHILDREN City Attorney memos recommended denial of these claims for(1) sidewalk faII and (2) physical and emotional injuries resulting from Pofice incident. Councilman Harrison moved approval of the Consent calendar. Seconded by Councilwoman OrMahony, carried unanimously. COUNCIL COMMITTEE REPORTS City/county Association of Governments: Mayor Lembi reported on recent meeting of mayors at which this draft agreement was discussed, he needed more input before the next mayors meeting. Councilman Pagliaro colunented on a recent Council of Mayors meeting which three Burlingame council members attendedi he also cornmented on the latest draft of the agreement for this proposed agency, there have been some positive changes made in response to cities' concerns, but he still felt it needed work and he would not support it as long as the supervisors have two votes. This draft agreement was placed on the agenda for the next regular meeting of September 17 for further discussion. NEW BUSINESS Host Council of Mayors: Council-woman Barton said Burlingame has been asked to host a council of mayors meeting; Mayor Lembi said it would take place october 26 at the Hyatt. Staff said the State would be requiring that the city provide its !'fair sharert of low income housing; in Burlingame this would require high density projects, since there is no land available for new housing. Councilwornan Barton urged a letter to the Governor. The majority of council concurred. Parkinq Meters: Councilman Harrison reported that five meters in Lot C are not working. BART: Councilman Pagliaro said he would be attending a meeting in Sacramento on September 19 which will deal with transportation and he will speak for Cattrain; he noted a letter regarding BARTto the airport and suggested we support BART going directly into the airport. Councilwoman O'Mahony noted that the citizens voted Measure A funds to improve CalTrain, she suggested a letter to cTc regarding the CalTrain extension into San Erancisco and including the BART issue. Council concurred. California/Broadway: Councilman Pagliaro mentioned the hugetraffic jams occurring at this intersection because of the newtraffic signals and paving work. Councilwoman Barton also had been involved in the traffic. Public works Director said the work should be completed in a week or two and things will improve . Recycling: Councilman Pagliaro said local restaurants do not recycle; he suggested a letter to them urging that they do theirpart in recycling. 87 Bocci BaII: councilvroman Barton said the courts still Look inpoor repair. Schedule Appeal Hearing: Mayor Lembi schedule a public hearingfor a special permit amendment for 890-J Cowan Road at the September 1"7 meeting. ACKNOWLEDGMENTS a.
