The neeting was cal1ed to order at 7:31 p.m. by l.{ayor Gloria Barton. PLEDGE OF ALLEGIANCE TO THE FLAG Led by Dennis Argyres, City Manager. ROLL CALL COI'NCIL PRESENT: COUNCIL ABSENT: MINUTES BARTON, HARRISON, LEI,IBI , O I I,{AHONY, PAGLIARO NONE Minutes of the Regular Meeting of october 2!t ]-99L were amended with a change on page 5 from councilmen to councilmembers, and on page 2 to show Mr. Asplundrs son was not present, and on page 6 that the TSM comrnittee rrapproved a draft letterrr and rrere then approved on motion of councilman Harrison, seconded by Councilwoman o I Mahony. Tom Mortensen, Manager of the san Mateo office of csAA, presented council with the 1990 Pedestrian safety Citation for two consecutive years with no pedestrian injuries or fatal-ities. Mayor Barton thanked hirn and congratulated the Police Department and Traffic Engineering Department for helping the city achieve this award. PUBLIC HEARING - APPEAL FOR TWO VARIANCES FOR LOT COVERAGE AND FOR PARKING FOR AN ADDITION AT 2845 MARTPOSA city Planner reviewed her memo of october 25 which recommended council hold a public hearing and take action. The applicants, Kuang-Hui Lee, property owner, and Kai-Yee woo, architect, are requesting variances for lot coverage (48.5 percent requested, 40 percent allowed) and parking dimension (18 foot v/idth requested, 20 foot required) in order to add to the first floor footprint of the house at 2845 Mariposa. The addition hrill change the present three bedroom, two bath house to a four bedroom, four bath house with a total square footage, including attached lJarage, of 3,945 square feet. The applicants previously applied for a two story addition and were denied, In developing the site in a one story structure some problems have affected the design; the garage and dri.veway orientation were changed j.n order to add at the front of the building, this required reorientation of the driveway and lowering of the garage to achieve a 10 percent slope for the driveway; lowering the garage required rnore stairs to access the kitchen and these stairs encroach into the 20 foot width required for parking two cars in the garage. Another inpact of developing this site with a single story is that the structure has becone wider; the originaf structure was 44 feet wide, the proposed structure is 66 feet wide. Keeping the same pitch for a wider roof causes the height of the highest roof ridge to increase. The appJ.icants presented s1i9ht1y revised plans after preparation of the staff report,' the revj,sedplans moved the front of the structure back three feet which lowers slightly the highest roof ridge and the 1ot coverage. AIso received after the staff report was prepared $/as a letter in support of the application from the Brattesanirs, the irnmediate adj acent neighbors at 2849 Mariposa. The Planning Commission denied this application without prejudice. 288 Councilman Harrison asked staff if the new plan was a differentproposal and should go back to the Planning Commission, staffsaid it was basically the sarne pIan. Councilnan Pagliaro askedabout the new foyer plan and if this house was considered threeor four bedroorn; staff said the library area nust be considered a bedroom. llayor Barton opened the public hearing. Urs Lee, applicant, thanked council and her neighbors for weJ,coming her to Burlingane; her hillside construction permit was denied a year ago and they have hrorked with their neighbors toachieve a new single story design to satisfy all parties; she asked her architect to explain the plans. I{illian Joseph, architect, said the 1ot coverage variance shouldbe approved because of special circumstances since the rear ofthe 1ot is an open slope which cannot be developed and becausethey cannot build a second story,. the neighbors support thisproject; they extended the building in the front because addingto the rear $rouId encroach into the required rear setback, usetoo much rear setback area and could also affect the view of theneighbors - views on Mariposa are toward the rearl neighborstructures on both sides extend more toward the front of lotsthan their house; they can make the garage stairs narrower todecrease the encroachment into the parking area to one foot. Councilwoman OrMahony asked the architect if these pLans areapproved lrouLd he confirm during this hearinq that the revisedroof plans received October 30 v/ould be adhered to; Joseph saidyes and reviewed the rnaximurn heights on various roof ridges asshown on the p1ans. Speaking in favor hrere Joseph and Donna Brattesani, 2849Mariposa, they approved of the revised plans which lower theroof; they have compromised with the Lees and are giving up theirview from the Living/dining area in order to keep the rear- vj,ews. Mayor Barton closed the public hearing and said it was refreshingto see neighbors working together like this but she said she wasconcerned about 1ot coverage, citizens are complaining to councilabout too big houses; this lot coverage is almost 50 percent; shewondered if there were any way to reduce the Iot coveiage.Joseph said it would be difficult, especially at the sides; theyhave already pushed back the front three feet in the foyer area;he reiterated that the lot coverage would not appear as greatbecause of the open hillside at the rear of the 1ot. Councilman Lenbi appreciated neighbors working together but hewas also concerned about the lot coverage; this would send signalto others that council would al.1ow greater 1ot coverage; hethought the roorns in.the proposed house were aI1 very large, theycould cut down the library from 27 feet to 23 feeti a fO by fffoot foyer is very 1arge, that could be cut backr. he could notvote to approve this great a lot coverage. councilman Pagliaro tas concerned about the butky feeling thishouse would havei he erould be rnore inclined to favor it if itwere set back parallel with the Brattesani housel he was alsoworried about the parking variance. Joseph said if the Leespushed the front back any nore the house would appear straightacross in front. Pagliaro said if the house were set back - another two or three feet he could approve. Councilman Harrison asked if the front were pushed back would itraise the roof line; staff replied it would ictually lower theroof Iine because it would be shorter. Harrison was concernedabout the 1ot coverage, people canrt see the rear dropoff fronthe street - it would appear massi.ve. Council discussed amount of1ot coverage if house were pushed back; deternined the deck areais not included in lot coverage; if entire house were pushed backthey could build a larger deck for yard area. Councilman Leurbifavored denying without prejudice so the applicants could revise 289 290 and cone back to councj-l- with srnaller project and Less 1ot coverage. Councilman Pagliaro could go along with the plan if they cut back the front another few feet. Councilrnan Lernbi suggested cutting a foot off each sj-de also to reduce the footprint. council suggested getting the lot coverage down to about 45 percent, Staff noted the ridge line of the roof wouLd be lorrered if the size of house were reduced. Architect discussed with his clients and agreed they could work on further revisions. Mayor Barton asked for a motion and council agreed that she should be allohled to make al-1 notions tonight, since it was the last meeting before she retires from council. Mayor Barton moved to approve the parking varj.ance for 19 foot wide garage. seconded by Councilnan Harrison, carried unanirnously. Mayor Barton then moved to deny without Iot coverage variance so the applicants reduce lot coverage to about 45 percent Seconded by Councilman Harrison and carr ro11 call vote. prejudice the request for could revise pJ-ans to and return to council. ied unanimously 5-o on PUBLIC HEARING - URGENCY ORDINANCE :-447 - AUENDING HII.,LSIDE AREA CONSTRU ION PERMIT REGU LATIONS city Planner reviewed her memo of October 29 which recomnended couircil discuss, hold a public hearing and take action. At the october 21 council meeting, staff was directed to revj-ew the Hillside Area construction Pernit regulations and see how they night be anended to address additions to single story structures which would raise the roof height or change substantially the bulk of a single story structure to block existing views.from aajacent prop6rties. She presented two options for_ consideration of single st-ory regulation - 1) is to require a hillside perrnit for anf change to ltructure footprint or new roofed area; this could incluae Uay windows. 2) vrould provide nore latitude to a property owner; if an addition would extend the portion of the ila1l of-the structure next to the side property fines more than 15 feet then a hillside pernit would be required; it also-address new accessory structures or expansions. Another new section of the proposed ordinance would address height of ne!, single story residences. councilrnan Pagliaro found sone of the language regarding rnaximum eLevations coifusing. There were no open coirments and council asked Planning Conrnissioner DeaI what he thought of this proposed ordinance; DeaI said it would be more hrork for the connis;ion and staff. Mayor Barton thought it was stil1 sonething that council had to do. The Ashe farnily is requesting an adjustment to their bilt based on aIeak that occurred in their water Iinel staff policy perrnits adjustments to sewer charges and penalties in cases there theIeak is underground or difficult to detecti the customer muststill pay for the water, the sewer is adjusted because norrnally aleak does not go through the sevrer lines. They requestadjustnent because they have two extra boys living at home. The Ashe fanily has requested two prior rationing adjustmentsl in.fuly 1988 they notified the city that their daughter returned home to live; in 1990 they appealed for five oceupant allocation,but they already had five allocations and the appeal was denied.The Ashe family was not present. Mayor Barton moved to deny the appeal. Seconded by CouncilmanHarrison, carried unanimously by voj,ce vote. TRAFFIC ALI.,OCATIONS - NOVEMBER 1991 llayor Barton rnoved adoption of TRGENCY ORDINANCE 1447. by councilnan Harrison, carried unanimously. city Planner reviewed her rnemo of October 2council review the requests for traffic allaction. There were two requests for all-ocaextension for the allocation to a 3.29 acreparking lot at 765 Airport Boulevard and (2a 4.4 acre extension of the Alamo Rent-A-Ca Highway (onto the Anfac site). seconded 8 which recornrnendedocations and taketions: (1) anlong-term airport ) a new aLlocation forr use to 1380 Bayshore Polytech Associates is requesting an extension for an allocationgranted Lo 765 Airport; presently 2.04 acres of the site arevacant and have never been developed, the adjoining 1.25 acre lotis part of the Metro parking long-tern airpoit parlling 1ot. Thelot combination is being proposed because zoning code requires athree_acre rnininum parcel for long-terrn airport parking 1ots.Negotiations between property owners have been cornpJ,etea and lotcombination can continue, but the traffic allocation expired. The second request is for an expansj,on of Alamo Rent-A-Car toinclude the 1380 Bayshore site; this is a 4.4 acre site adjacentto the Alamo operation and the appticants propose to denolish theAmfac hotel and pave the lot for additional auto storage. Councilrnan Harrison said he would be glad to be rid of thedanaged Amfac Hotel. Councilman pagliaro agreed and expressedhj.s concern about these long-tern pirking lots which pr6duce noj.ncome for the city but cause wear and tiar to city slreets andcreate traffic; he hated to see a storaqe parking 1ot where thehotel.was located, it does not meet crii.eria for approval oftraffic allocations. City Manager told council th;L Alarno is oneof the cityrs highest sales tax producersi the long-tern airportlot does not produce any income to the city. CouniilwonanotMahony said rentaL car cornpanies are the second highest salestax producer in the city, she was glad to see this positive change in the bayfront. llayor Barton said with the state of theeconomy we nust face reality, she hoped some day this 1ot wouldbe developed rrith a nice structure. Councilnan Harrison said hewas ready to discuss doing sornething about taxing long ternparking fots as Councilman Pagliaro has suggested in tne past. Mayor Barton moved approval of the two traffic allocationrequests. Seconded by Councilnan Harrison, carried 4-1 on voicevote, Councilman Pagliaro voting no. FIRE DEPARTMENT CONTTNGENCY PI,ANS FOR WILDLAND FIRES Fire chiefrs memo of october 2g reviesred the oakland hillsdisaster and the sinilarity to our Burlingame hills area,. f ire 292 attached was a report entitled Itwildland-Interface Presuppression Plan f or !,!i11s canyon and the Burlingame lli]ls. I' Councilman Harrison lrondered if our city could faee similar problems with power failures and pump and reservoir failures during a fire. Public works .Director told of new lrater line at Mercy sitei he said the city has a portable power glenerator available for emergency usei a standby irenerator will be installed in the hills area in the spring of L992; staff is looking at usirig this and connecting directly to the san Andreas Lake for water needs during fires. llayor Barton said she read about fire hoses which did not fit the hydrants; Chief said Oakland and San Francisco are the only cities that do not have standard hose fittings. Councilman Lenbi wanted to discuss hiltside fire protection at the next study neeting; council .should consider fire retardant roofing rnaterials being required for buildings in those areas. Mayor Barton asked the Fire Chief to thank fire crews which worXed during the oakland fire; the council had received copies of letters ttranking the crews frorn people who lived in oakland. councilman Pagliaro drove through the area with Assistant Fire lilarshal Keith Marshall; he said it was amazing hol^, the f ire skipped some areas and devastated othersi he was.concerned about the- burlingame Hi1ls unincorporated area over which our city has no control regarding fire safety. Councilnan Lembi said the county is working tolrard some fire safety controls. John Freeman, 1415 La l"Iesa, expressed concerns about the Mills canyon area near his hone; he asked about evacuation plans for residents and water sources; there were dead brush and trees in the canyon which hasnrt been clearedl he sometimes sees Boy scouts working to clear areas of canyoni he asked about length of fire hoses in relation to hydrants on his street; he sees kids playing in canyon and off-road vehicles driving in the canyon irtriih ioufa be fire hazard. Mayor Barton informed Freenan that council woutd be reviewing this matter at the study neeting; councilwoman OrMahony invited Freeman to attend that rneeting on November 20 at 7:30 P'm. Council of Cities: councilwoman OtMahony had attended a meeting with a speaker on public financing; she received a handout which showed weighting given to targe cities. d. 294 NEI^I BUSINESS Parkingr Lot H: Mayor Barton noted a letter of conplaint regarding use of Parking Lot Hi she suggested council discuss this issue at a study meeting. Drunk Driver Drop-off Center: uayor Barton acknowledged a letter frorn Millbrae Mayor askirig support for a Drop-off Center; chief of Police said this does not affect our city because we have our own jail to hold drunk drivers. Building Departnent: Mayor Barton said she received letters comnending this department. Bassett letter: Mayor Barton nentioned a letter she received regarding the city's purchase of the Duncan addition to the r,ibrary; City Attorney will be responding to this letter. Halloween: councj"Iman Lernbi visited the conmand post at oLAi it has made this holiday to be more quiet; itrs had a very qood impact on the area. FROM THE FLOOR a b c d e f s h Marti Knight, 455 chathan, said November 12 the county Board of Supervisors will be discussing a fire safety study; she wondered about city policy regarding Eucal-yptus trees, staff said only certain sma11 varieties are approved for street trees.
