The meeting was called to order at 7:31 p.n. by Mayor Gl-oria Barton. RESOLUTION 73-91 FIXING ASSESSMENTS FOR WEED AND RUBBISH ABATE- MENT - CP 9107 Public Works Director reviewed the memo of July 25 which reconmended counci1 hold a public hearing and then take action. The City Engineer has posted the subject properties, contractedfor v/eed and rubbish rernoval and gj-ven the City C1erk the Assessment Report. The Clerk has published and posted the required notice. Once adopted the assessments wil-I betransmitted to the County Assessor for collection on the taxroIl,. tlayor Barton opened the public hearing. There being no comments,the hearing was closed. Councilnan Harrison noved adoption of RESOLUTfON 73-91 f ixj-ng assessments for weed abatement. Seconded by Council-nan Lembi,carried unanimously 4-0 by ro11 cal,l vote. RESOLUTION 74-9], ADOPTING SAN]TARY SEWER USE RULES AND REGUI,ATIONS PLEDGE OF ALLEGIANCE TO THE FLAG Led by Park Director Rich Quadri. ROLL CALL COUNCIL PRESENT: BARTON, HARRISON, LEI!{BI, PAGLIARO COI,NCIL ABSENT3 O IMAHONY MINIJ]TES Uinutes of the Regular Meeting of July 15, 1991 were approved unanirnously on motion of Councilnan Harrison, seconded by Councilman Lembi . Public llorks Director reviewed the memo of July 31 which recommended council hol-d a public hearing and adopt the proposed Rules and Regulations. The city adopted Sewer Use Ru]es and Regulations in 1983. Subsequent changes in EPA and State requlations require the city to update our discharge and enforcement regulations. The sewer discharge requirenents setlimits on the volune, constituents and strength that can be discharged into the sanj,tary sewer so that the treatment plant isnot overl"oaded causing either damage or a violation of EPA orState regulations. The rules provide for Notice of Violation bystaff, an Administrative Order to Correct, fj.nes, and finally discontinuance of sewer service. The discontinuance would come onl"y after a show cause hearing before cj-ty council. Councilman Harrison asked how these rules would be policed and whether the city experiences any problem with the present rules. PW Director said the city issues pernits to regul,ate specificindustries; each i-s sampled throughout the year. Council-man Lenbi asked if this involved hazardous wastes and wondered $rhat happened to the county hazardous waste pl-an the city approved some tirne ago. Councilman PagTliaro and City Manager respondedthe plan was approved by cities and forlrarded to the state, theState turned it down and it is presently beingr modified by the county. 250 Dlayor Barton opened the public hearing. There being no conments,the hearing was closed. CounciLman Lembi moved adoption of RESOLUTION 74-91. Councilman Harrison, carried unanimously 4-O by ro11 seconded by call vote. RESOLUTION 75-91 FIXING I99L-92 9IATER RATES Pub1ic Works Director revier^red his merno of August 1 which recornmended council adopt the resolution raising water rates from $1.64 per thousand galLons to $1.99 per thousand gallons (21.3percent) to be effective September 1, 1991. San Francisco Water Departnent has imposed rationing and increased the rates 40percent. The Burlingame Hi1ls rate wilL increase from $1.81 to $2.19 per thousand 9a11ons. The Burtingane Hills surcharge forfire flow improvements will remain at $1.09 per thousand gallons. He noted the new cornbined water and sewer rates will stil-I rnake Burl,ingame the l-owest rate city in the area. Mayor Barton commented how difficult it is to explain the needfor raising water rates $/hen people are reducing vrater use. Councilman Lembi moved adoption of RESOLUTION 75-91. Seconded by Councilman Harrison, carried unanirnously by voice vote. INTRODUCTION OF ORDTNANCE 1442 FTXING SEWER TES AND CHARGES Public Works Director reviewed his merno of August l- which reconmended council adopt the revised se$/er rates by introducingthe ordinance and setting a public hearing for the next meetingat which the ordinance wiII be adopted. EpA regulations requiiethat operation and maintenance costs for the sewer system are tobe paid from the sewer rates and specifies the rnethod ofcalculating that rate. Burlingarne Hills and Hillsboroughcontract lrith us for sewer treatrnent; those flows and loadingswere removed from the program before calculation of our new rate.Analysis is difficult because of the water rationing. Theproposed rates show an increase of 8.9 to 9.9 percent; singlefamily residential increase is 9 percent. He noted thatcornmercial sel^rer charges nake up 60 percent of revenue. Councilman Harrison moved introduction of ORDINANCE L442. Seconded and carried 4-0 on voice vote. TRAFFIC ALLOCATTONS - AUGUST 1991 City Planner reviewed her merno of August 5 which recommend.ed.council review the request and take actj-on. Keith Tsurepresenting the property o$rner is requesting a trafficallocation so that he can appty to convert six acres of the 16acre drive-in theater site at 300 Airport Boulevard into long-tern airport parking use for a maximun of five years. the sixacre portion woutd be along the Airport Boulevard frontage on thenorth side of the 1ot. The traffic irnpact on al_l three criticatintersections would be considerably less than six acres of theplanned office use for the site. An additional trafficallocation will have to be made for the change in use for therenaining 10 acres of this site; also the Loiation of thedriveway access to the longT-tern airport parking wi11 becritical. The public works departrnent wiII have to approve thelocation of the driveway. Counc j.l.rnan Harrison noted they hrould have to get a special permitfor this net use. councilnan pagliaro mentioned his previousdiscussion on the possibility of taxing this type use] heinquired of.City Attorney if such a tax could be ailopied bycouncil or if it had to go to the voters. city Attoiney siia ifthe tax receipts went into the General Fund, council coul-d adoptsuch a tax. Councilnan Pagliaro asked that council consider thisat a fall study meeting. 251 Councilman Harrison moved approval, of the traffic allocation asrequested. Seconded by councilnan PagIiaro, carrj-ed unanimously4-o on voice vote. TRAFFIC, SAFETY AND PARKING COMMISSION RECOI.{I{ENDATION FOR FLASH- rNG YELLOI{ LTGHT S ON CALTFORNIA AT CARMELTTA Public Works Director reviewed the memo of July 22 which recommended council consider the TSPC recommendation and directstaff accordingly. In response to a letter to Mayor Barton, the cornrnission considered this request for additional safety measuresfor pedestrians at this intersection. They reconmend theinstallation of flashing yellow beacons at the j.ntersection withcross-hatching of the existing pedestrian crossing and additionalsignage as a means of warning drivers that they are approaching apedestrian crossing. They also recommended that the city applyfor federal funding for future traffic signals to servepedestrians and traffic entering from carmeLita and thereconstructed Caltrain parking lot. The cost of installation isestinated at $10,000 and funds can be transferred fron the Broadway Street Lighting proj ect. councilman Harrison asked that it be rnade clear that the fundingis excess money lef t f rorn the Broad\,,ray Street Lighting pro j ect because that project came in under estirnated costs. Councilnan Lernbi expressed concern about putting traffic lights at thisintersection; California Drive is the only street with unimpededflow of traffic. He also mentioned that Howard Avenue isterribly congested. Councilnan Harrison rnoved approval of installation of yellowflashing lights as reconmended. Seconded by Councilnan Lembi,carried unanimously by voice vote. LETTER FROM MI RAE MAYOR REGARDTNG COOP TIVE SERVfCES City Manager reviewed a letter from Mayor Janet Fogarty ofMillbrae which requested BurlingTame consider come cooperative orjoint efforts to irnprove service and economies,' she suggested thearea of fire services rrould be a good place to start discussions.City Manager said our cities had an automatic aid agreernent a fewyears ago; Millbrae is having financial difficulties, there are some trade offs, $re might achieve some cost savings but we needto maintain Burlingamets current service 1eve1s. Councilman Harrison said when he was on LAFCo some years ago theypushed for such agreements, nothing ever came of it. councilmanPagliaro said the Millbrae council have been good friends. MayorBarton said she had talked to Mayor Fogartyr. the city needs help, she would like to help but does not want the Burlingame serviceIevel to drop; Mayor Barton suggested joint training of firefighters. City Manager said we have fire staff support thatItlillbrae does not have; how can we increase service 1eveI forthen but not raise their cost; our city is not in financialtrouble now, but rnight be in the future. Councilman Pagliarosaid perhaps Millbrae could sit in on our fire training sessi,ons and help pay cost of trainer. City }lanager reviewed the processthat Belnont and San Carlos went through to merge services. Mayor Barton suggested the City Manager and Fire Chief neet withDfillbrae officials. Council concurred. CANCELLATION OF AUGUST 19 AND 21 COIJNCTL MEETINGS City Manager reviewed hj,s rnemo of JuIy 31 noting two council members would be absent from each of these meetings. Hesuggested counci-L cancel or cornbine these meeti.ngs. The onlybusiness which might be affected is the sewer ordinanceintroduced tonight,' its effective date would be moved to octoberif meetings were canceled. The architects were scheduled to makea presentation on August 21 on plans for the bus depot and allcouncil members would like to see that. Counci,l concurred oncancellation of both meetings. 252 PARK AND RECREATION COMUISSION RECOMMENDATION TO INSTALL LIGHTS ON BI'RLINGAME HIGH SCHOOL TENNI COURTS City Manager revier.red the Recreation Directorrs memo of JuIy 18 which tol-to instal Burl- ingam f rorn the do11eH ol,d f the Park and Recreation Commissionrs recommendationights on the four courts next to the swimming pool atiSh. City Manager suggested councilrefer to the next study rneeting. Council concurred. CONSENT CALENDAR Councilnan Pagliaro asked why there was only one bidder for thetree pruning project; Park Director responded that only aboutthree companies have the resources to meet the city bond and insurance requirernents, he said the bid was a reasonable one. I"Iayor Barton asked Park Director about the fence instalLed atHeritage Park; Director said city instalLed fence on cityproperty but most property is private; staff noted lights wouldbe installed there soon. Councilman Lembi cornmented on the large amount of money the city is spending on sidewalk repairs. councilman Harrison asked about the C/CAG amendment, it refers to 18 participant cities, he thought 19 cities belonged. CouncilmanHarrison also mentioned that there are severaL blocks on Rollins Road which have no sidewalks; staff said council could hold apublic hearing and order the property owners to installsidewalks. Mayor Barton wondered just how nucb C/CAG was goingto cost the city; city Manager said he had budgeted g3o,ooo; Mayor Barton had attended a recent neeting and gave San Brunocredit for not belonging to the group, but san Bruno does attendthe neetingsl she said our city needs to watch this groupcarefully. Councilman Lembi noted it would cost more for ourcity to do the State required projects C/CAG is doing for us. a.INTRODUCTION OF ORDINANCE 1443 - AMENDING TRANSIENT OCCUPANCY T PROVIS TONS City Attorneyrs memo of Juty 23 recommended councilintroduce and adopt an ordinance naking amendnents to the TOT ordinance. A number of j-ssues over the past years haveindicated that we need to clarify or modify severiL aspectsof our ToT Lalr. The Finance Director and Treasurer haveasked for several amendnents i the proposed changes have beensent to the hotels for comnents. b. RESOLUTION 80-91 - AUTHORIZING DEDICATION OF OPEN SPACE - EASTON CREEK MITIGATION - CP 009 Public Worksr memo of July 30 reconmended council approve aresolution authorizing dedication of open space. As acondition of the Arny Corps of Engineers' perm.it to allowwork in Easton Creek between Bayshore and the freeway, thecity is required to return .12 acre to wetland. In the bayat the north and south ends of the Anza bridge two areaswill be excavated and graded to below the Line of high tidein order to satisfy this condition. Because the area j,s within BCDC jurisdiction, the city was required to secure apermit and the city nust permanently restrict this area as open space. s. Councilman Harrison rnoved approval of the Consent Calendar. seconded by Councilnan Lernbi, carried unanimously. COUNCIL COMMITTEE REPORTS Hotel Council: councilman Lenbi had attended a hotel councilneeting, they are attenpting to reach a consensus on theconvention center. Schools: He had also attended a rneetingrrith School Superintendent Beuthel and Board Member John Rooti discussed needs and priorities and will meet again in October. He recommended aII council rnembers carefully review the draft congestion nanagement plan sent to council. Airport :Mayor Barton thanked City Planner for the report on theDraft EfR for the Airport. She suggested councilmembers eachreview and contact the City Planner with conments. She noted theAirport Roundtable was going to discuss the DEIR and there wouldbe more comments. She added that the city write its concerns about backblast noise from increased use of Runway One. CrirninalJustice: Mayor Barton had attended a recent meeting at whichSupervisor Huening requested Criminal Justice Council to endorsethe rrBest Schoolsrr program. She had concerns about raising evenmore taxes. OLD BUSINESS Fire Fioh s Union: regarding purchase ofFire Chief said this iraise funds, adrninistr Council members had received ca11stickets to a game to benefit fire fighters.s an effort by the Fire Fighters Union to atj-on and city have nothing to do with it. 254 oak Grove: Mayor Barton asked when this street $rou1d berepaired. NEW BUSINESS Letter from san ta Clara Countv:Mayor Barton conmented on a 1600 Broadlray:City Attorney sato abate the apato rent up to th ACKNOWLEDGE},,IENTS flyer and letter she had received about a questionnaire sent toresidents in that county on regionalismr. some of the questions were rrloadedrr and she wondered what group this is sponsorinq thequestionnaire; senator Ton canpbell is on the board of thisgroup. council members agreed with her concern about the santaClara flyer and asked staff write a strong letter of concern tothis group with copies to Senator Canpbe11. she also noted theletter and report from Councilwoman NeLson of cilroy on BayVision 2020, she hras glad to see someone else taking a closerlook at this concept.
