CONTINUE THE ISSUANCE OF CERTIFTCATES OF PARTICIPATION AND AWARD OF CONTRACT FOR IMPROVEMENTS TO WASTEWATER TREATMENT PLANT City I'lanager reviewed his memo of Uarch 8 which reconmendedcouncil continue the issuance of certificates and the award ofcontract for this project until the April 1, 1991 meeting because of the increased size of the issue based on bids receivedfor construction, additional public notice requirements and a delay in rating from tloodyrs. Standard and Poorrs rating of thecity is AA-. Construction bids were opened on March 5 and the lowest bid includinq alternatives for reclaimed water and cogeneration facilities was $l-0,6oL,25oi there has been oneprotest received regarding the bids. The bond rating conpaniesare requiring a debt service reserve fund be establ,ished in orderto receive a high ratingi this adds no additional cost sinceinterest earnings on this fund wiII equal or exceed the debtservice. Ile responded to council questions regarding the reservefund, construction management and the cogeneration facilities;the City Treasurer r,,rill invest the reserve fund to earn interest;the plant would produce energy to run itself, not for outsidesa1e. Mayor Barton continued the item to the Aprif 1 meeting. ATER RATIONTNG City Manager revj-ewed his memo of l"Iarch 1,3 which recommendedcouncil review staff suggestions for water rationing enforcement.At the Last meeting council discussed the need for adding enforcement criteria to our water rationing plan concerning flow-restrictors and discontinuing water service. During 1990, therationing program included provisions for restrictors and shut-off, but neither were used except for non-payment of bi11s. He recommended: (1) econonic penalties be the major enforcement toolwith penalties of double to ten tirnes the water rates; (2) flowrestrictors be lirnited to customers vrho have received at least one written warning of beingr 50 percent or more over allocation,the restrictor be removed only after three days have el-apsed, andthe customer would have to pay installation and rernoval charges,.(3) if the custoner was again 50 percent over allocation therestrictor would be reinstalled for the duration of the rationingprogram; (4) no restrictor be placed on a customer using lessthan 6,000 gallons per nonth; (5) that allowances be made forbroken or defective plunbing if repaired within five days ofreceipt of notice of the need for repaj-rs; and (6) discontinuanceof lrater service should be the last resort and require anadministrative hearing with vrritten notice and appeal rights tocouncil. Council concurred with staffrs proposed enforcement policies. CANCELLATION OF STUDY MEETING Council unanirnously agEeed to cancellation of the March 20 studyneeting. PROPOSED ANTI-GRAFFITT ORDTNANCE City Attorney reviewed his rnemo of February 5 which recommended counciL review the South San Francisco anti-graffiti ordinance and direct staff regarding adopting a sinilar ordinance. SSFprogram is adninistered by the Police Departnent and allows for removal of the graffiti by city forces; he sugqested the CityAttorney adninister Burlingane's program, and that the citycontract with a private paint company and bill the property ovrners i the procedure would be similar to the sidewal-k repair hearing process with notice, abatement and a cost hearing. Council agreed with the concept; staff will develop an ordinance and bring to the next meeting for introduction. CONSENT CALENDAR Councilman Pagliaro said he lrould abstaj.n from one item under warrants and Payroll, a city payment to Black and veatch, aclient of his. RESOLUTION 35-91 - APPROVTNG CONTRACT T'OR TESTING SERVICES FOR STREET RESI'RFACTNG PROJECT - CP 101 Pub1ic llorks memo of February 25 recommended council approve an agreement with Testingr Engineers in the amount of $20,000for testing and technical inspection of the resurfacj-ngproj ect . RESOLUTION 36-91 - AUTHORIZING SIGNATURES FOR CITY BANK ACCOT'NTS Finance D.irectorts meno of March 14 recommended councilauthorize new signatures for our bank accounts because thecity Treasurerrs secretary is leaving city ernploy. c WARRANTS AND PAYROLL Finance Director reconnended payment of Warrants 13594 - ]^4032, duly audited, in the amount of $866,036.67 and PayroII Checks 35003 - 35769 for the month os February 1991 in the amount of 91, O85,2Lo.94. Council unanimously approved the Consent calendar on rnotion of councilman Pagliaro, second by councilman Harrison. COI]NCIL COMMITTEE REPORTS C/CAG: Councilwoman O'Mahony reported on a recent C/CAG neeting she had attended in the absence of Councilrnen Lembi and Pagl-iaro. They are preparing a computer sinulation of traffic ffows on somecity streets; they discussed bikeways and did not award a grant to Burlingarne because our project did not serve commuter typecycling and went through a parking lot. She said c/CAG supportsbike paths with more utititarian use, not recreational use, toaid commuters. Foster City, Hatf Moon Bay and San l"Iateo v/ongrants. Director of Public Works said the bike path grant request yras for replacement of the Beach Road pedestrian bridge across Sanchez Channel. llayor Barton objected to not receiving a grant, our city has done so much for bike paths along the bay, she did not think the b a. L82 Foster City bike paths were for cornmuters. Councj.lwornan OrMahonysaid c/cAG nould like to see more east-west bike paths across101. CounciLnan Ilarrison wondered about method of selecting thebike path committee. CounciLnan Pagliaro asked if these were Measure A funds, staff responded these are gas tax funds,. staffnoted the city has received several bike path grants previously. Council asked about completion of the bayfront bike path; thereis one section near the Hyatt theater which is not completed;staff said the city needs to wait for re-use of the site sincethis is private property. Airport Roundtable: Mayor Barton said the Roundtable has beendiscussing SB 226, Kopp's bill to lirnit suits for airport noise. Kopp has asked councils to delay taking a stand until 60 dayspass, but neanwhile he hrould be carnpaigning in Sacramento forpassage. The Roundtable suggested allowing him 30 days. Koppwill be visiting the cities to make a presentation on this biII and Uayor Barton would l-ike the airport to present the opposingview at the same neeting. Council"man pagliaro suggested kopp feinvited to an April meeting. Mayor Barton suggested a letter inoff-site betting at the Cow Palaceschools. She objected to off-sitebenefit San Francisco. councilnan should take place at the San Mateo concurred. opposition to a bill atlowingto support San Franciscobetting in San Mateo county toPagliaro said any betting County Fairgrounds. Council OLD BUSINESS Broadway and Burlingame Avenues: Councilman Harrj-son asked aboutthe status of sidewalk cleaning for the business areasr. staffsaid funds would be in the 91-92 budget; sidewalk cleaning takesIots of water and if rationing is still in effect, the cleaningcould not take pl-ace. Councilman Harrison inquired about thelights in parking lot next to Washington park tennis courtslstaff said they would cost about g1o,oOO. councilman Harrisonalso asked about the Burlingane/Donne1ly Avenues fire site andwhen it would be cleared. Councilman Lernbi said the destroyedsite is darnaging to the morale of the area; staff said thereappeared to be a dj-sagreement between the clairns adjuster and theinsurance company. CounciLnan pagLiaro knew they w6re working onplans; council said the site could be cleared in any case. Transportation Authority Annual Report: Councj,lwoman orMahonyacknowledged a report regarding transportation improvements; shewondered lrhen the Broadway railroad grade separation would bedone and why it wasnrt on the Iist. Staff had not received thereport, Broadway should be scheduled for 1996. CouncilmanPagliaro mentioned Burlingane has been receiving g2OO,OOO eachyear for street repairs fron the authority. County Booking Fees: Councilman pagliaro asked that letters inopposition be sent opposing the Uaddy bill and the Wi11ie Bro$/nreqional governnent bill. 347 Prinrose: Councilman pagliaro was concerned about thechanges that occurred at this site; he thought the frane of thehouse was to rernain, it has all been removed. Council agreed theconcept approved was for the appearance of the front of the houseto renain, the design lras approved, not keeping the actual wood,but the look of the original house. llayor Barton was alsoconcerned, she had opposed the project. City planner said theyjacked up the house and it sagged, because oi age the joists would not meet code and they removed the structure I she saidcouncj-l approved the picture, they will have to replace thebuilding to conform to the picture approved by council. Councj,l-asked that staff report back on this project at the next meeting. Planning Connission Appointnents: CounciLnan Lernbi said he andCouncilman PagTliaro recommended reappointing planning Cornmission-ers llike Ellis and Shelley craham to their second terms on the 183 Planning Cornrnission; he thanked the other citizens who applied.Council concurred. CounciL said staff is working on that intersection and a report frorn a traffic consultant $rould be corning to councilshortly.
