FROM THE FLOOR June 12, 1987 Burlingame City Council City of Burlingame Primrose Road Burlingame, CA 94010 Dear Council Members: The Beautification Commission recommends that the City Council reconsider passage of the ordinance to control the placement of newsracks at the Post Office site on Capuchino, the Broadway Train Station and at Stanaway's Market area. We feel that too much of the sidewalks are being used for these stands and can be a hazard to those walking in the areas. We feel that the newsracks at the Post Office on Capuchino could be placed closer to the building where there is adequate room to display the newspapers and leave the sidewalk free. We would like to limit the use of chains or other devices to fasten the newsracks to parking meters, trees and to other newsracks and encourage more modular racks such as used at the Park Road Post Office. Some of these could be upgraded because of appearance of these stands. Sincerely, Ardith Erickson, Secretary Beautification Commission R C=TY OF BURL2NGAME TO: Honorable Mayor and City Council FROM: City Manager DATE: June 29, 1987 SUBJECT: Newspaper Racks Attached is a letter from the Beautification Commission requesting that the City Council reconsider passage of an ordinance regulating newsracks. In 1984, the City Council considered this same subject and after reviewing the possible effectiveness of a proposed ordinance, directed staff to work with the newspapers to encourage more modular racks. Most major newspapers have cooperated in this matter, and modular racks are now at most locations. A number of "independent newspapers" are not participating, but the City cannot prohibit newsracks from public sidewalks, regulate the number, or force them into modular units. The Broadway Post Office and Stanaway's Market already have modular newsracks for most newspapers. A better location for the modular unit at the Broadway Post Office would be possible only with Post Office approval. The City currently has the authority to limit chains or fastening devices on City trees. Given these legal limitations, staff is not sure that an ordinance will help us cor- rect the situation identified by the Beautification Commission. In most cases, the problem is appearance and not safety.
