RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME
APPROVING NON-EXCLUSIVE INSTALLATION AND SERVICE AGREEMENT
BETWEEN THE CITY OF BURLINGAME AND METRICOM, INC.
RESOLVED, by the City Council of the City of Burlingame:
WHEREAS, in 1995, the City and Metricom, Inc. entered into an agreement to allow
Metricom to install and maintain its system radios and receivers on certain City light poles and traffic
signals to provide mobile data transmission to its citizens and public agencies; and
WHEREAS, the radios and receivers have been unintrusive and well-maintained and have
served the community during these five years; and
WHEREAS, it is in the public interest to enter into a new agreement to allow this
relationship to continue to serve the community; and
WHEREAS, nothing contained in the new agreement or the 1995 agreement shall be
construed in any way to constitute a franchise nor to confer any right of title in any public or private
real property,
NOW, THEREFORE, IT IS RESOLVED AND ORDERED:
1. The City Manager is authorized and directed to execute the Non-exclusive Installation
And Service Agreement Between The City of Burlingame And Metricom, Inc. as contained in
Attachment A hereto.
2. The Clerk is directed to attest to the signature of the Manager.
